#1 PROVEN Strategy to Remove a Charge-off From a Credit Report - YouTube

Channel: Ask Kristin

[2]
Today we are once again talking about how to remove really
[5]
difficult accounts like Capital One, or anything where there's a
[9]
bank involved, it doesn't matter if it is a mortgage, if it's a
[12]
repossession, if there's a bank involved, you know, for a fact,
[16]
you cannot lie to me, you know for a fact that these things are
[19]
really difficult. And if you don't know how to dispute them
[21]
correctly, then you're not going to be able to get them removed
[23]
in a reasonable period of time. And that is what we're going
[26]
over today. So look at your screen right now, I do have
[28]
permission from this client to use this without blocking their
[31]
account numbers, we are looking at a capital one charge off. Now
[35]
as you can see, everything is all over the place, we have
[38]
different date last active, we have a different date last paid
[42]
we have a totally in congruent payment history. And guess what
[46]
this is what factual basis building is we are using the
[49]
information that they the credit bureaus to creditors, the
[52]
collectors are reporting themselves. And that is what
[56]
we're using to support our argument just as an attorney
[59]
would in court to get our deletions. Right. So let's start
[63]
with the very first thing that you would use to remove this
[66]
account. And I did remove this account. So take a look at the
[69]
date last active that's right down here we have 1020 2019,
[74]
three 121, and six 120. Those are three different dates. And
[81]
that's three different years. How the heck can you have three
[85]
different years in the dealer stock? Do you know what this
[87]
means? This means that this account will naturally be
[90]
removed three different times, you get what I'm saying? Because
[94]
the deal is active is the date that determines when your
[97]
account will naturally fall off the credit report. So if we have
[100]
three different dates, then this is going to come off on three
[103]
different years. Okay, so that is going to be your biggest
[106]
impact. That is your smoking gun right here, my friend right
[110]
here, okay. Now, if that doesn't work, because most of the time,
[113]
it's not going to when you're dealing with these very
[116]
difficult accounts, stop believing just pausing right
[118]
there, stop believing these people, when they're telling you
[122]
that it is as simple as sending a one round of disputes. Because
[125]
if you were like that, it wouldn't go on your credit
[127]
report to begin with. They do this because they know they're
[131]
making a consequence and letting other people know what type of
[134]
borrower you are. Alright, so now we have date last paid.
[138]
Alright, so two of these dates are the same to 1121. We have
[142]
one that is six 120. I mean, is that a big, big, big gun? I
[146]
wouldn't really say so I would probably skip that. Use that on
[149]
round three, and go over into payment is really good. This we
[153]
have charged off charge charge charge off charge off we have
[155]
okay, but we're down here. It's 115. I mean, you don't have the
[161]
unless you're colorblind, obviously, I mean, you can see
[163]
the different shades. You can tell that this makes absolutely
[167]
no sense. Okay, if this information is coming from the
[170]
same creditor, which it is, then why do we have such incongruent
[175]
information. So the very first thing you can do is go back to
[178]
the very first late payment that you see. And just because we're
[181]
dealing with a two year payment history, we're gonna choose
[183]
August 2019. And we're gonna say, Hey, I paid on time because
[186]
guess what, they are not going to be able to legally verify a
[188]
late payment without furnishing a copy of their the bank's
[192]
credit union bank statement showing that you did or did not
[196]
pay on time. All right. So you can say I paid on time on August
[200]
2019. Delete this account, don't see update there, no way to
[202]
update this. Delete this account for inaccuracy and false
[207]
reporting. Okay. Now, when it comes back, and they say, Oh,
[210]
well, it's verified bla bla bla, guess what? Look at the comments
[213]
section right here. It's supposed to say disputed by
[216]
consumer, the notice of dispute is required to be there within
[220]
30 days of receipt of your first dispute. If it's not, then guess
[223]
what? violation? Okay. So pursuant to Section 623, they
[227]
are required to put this notice of dispute if they don't, then
[230]
that is it, my friend. So if that doesn't work, no, you can
[234]
go over here and you can see that they have activity and
[238]
reporting is activity after this account was closed. So I'm
[242]
assuming that this account was charged off, let's just say
[244]
March 21. Right? So there shouldn't be anything after
[248]
this. It shouldn't say okay, it shouldn't say charged off there
[250]
should be nothing after okay. So if that doesn't work, now, you
[255]
can start looking for violations, why are they still
[257]
reporting it when you already pointed out that there is a
[259]
violation, you can choose any other date here and ask for
[262]
deletion for inability to verify you have a whole horde of things
[266]
that you can work with. Now, if they say verify, but they don't
[270]
change this date do is reported where it says 715 21 715 21 and
[275]
seven 121 then it means that they verified it without
[278]
investigation because otherwise, this date would have been
[282]
updated to the date that they quote unquote, verified the
[285]
account. Okay. So you have so many things that you can go
[288]
after, don't bother saying I don't owe $589. Don't even
[292]
bother with that. Don't go after the date open. I don't care that
[295]
we have different dates here. This is not going to remove that
[298]
account. Don't go after them, saying Hey you didn't I don't
[301]
have a contract with you you don't have my signature that is
[303]
not going to remove that account I am showing you right now what
[307]
needs to be used in your argument to get the account
[311]
removed. If you use anything other than that then you are
[314]
running into the possibility or the probability that you're not
[318]
going to be able to remove your account in any decent period of
[320]
time Okay, you have so much to work with and this goes for any
[324]
type of account. Now, just as a side note here, you would not
[326]
use this method to remove portfolio recovery I have a
[329]
video specifically on that and I will post it down in the
[333]
description where you can find all the other links
[337]
to everything else that I have okay. So, just Just so you know,
[341]
how you would remove portfolio recovery Midland second round
[343]
all of those, you are going to be looking for a limit a past
[348]
due and as well as payment history okay? So unless you like
[353]
physically paid to them, there should not be any payment
[356]
history. And then you would actually go after date last
[359]
active and then go down the hierarchy. Alright, so that is
[363]
it for today. This is how you remove charge offs. This is how
[366]
I remove charge offs. This is how my clients get their charge
[369]
offs and their repossessions and foreclosures in their late
[372]
payments removed. And it's all using the fact that they the
[376]
credit bureaus, the creditors, the collectors, whatever are
[378]
reporting directly on their credit report that my friend is
[381]
called factual disputing. Alright, so I will see you again
