my wife and I first got married my

grandfather had passed just a couple of
[21]
months before and left me a very sizable
[24]
inheritance with a note to make sure I
[26]
use it smartly to start a good life for

my wife and I my father-in-law owns a
[32]
real estate company that buys foreclosed
[34]
houses and rehabs them and he knew of a
[37]
great starter home for my wife and I and
[40]
agreed to pay to have it rehabbed with
[43]
the understanding that we would pay him
[45]
back when we were better established or
[47]
after two years when we sold the house
[50]
so we bought the house and it took about
[53]
90 days to rehab it before we moved in
[56]
this is an important fact later on so we
[60]
finally moved into our house and had
[63]
been there about two weeks when someone
[66]
came and knocked on our door stating
[68]
that they were the homeowners
[69]
association president and asked for my
[72]
landlords contact information I
[74]
explained that we didn't rent the home
[76]
and that we were owners and then they
[79]
followed up by asking to speak with my
[81]
parents I reiterated again that I was
[86]
the home owner and asked them what they
[88]
wanted they explained that there was a
[91]
homeowner's association for the
[92]
neighborhood and that I needed to sign
[95]
the HOA rules and that I owed $90
[98]
prorated for my dues but that they would
[101]
give me 30 days to pay his courtesy
[103]
however they needed me to sign the rules
[106]
right then I told them I wanted to read
[109]
and review them first before I agree to
[112]
sign anything and they were extremely
[114]
pushy about signing them right then
[117]
I refused and they told me that I had
[120]
seven days to sign them and explained
[123]
that they have legal power to find me if
[125]
I do not turn in a signed copy in that
[127]
time I called my in-laws because I
[130]
didn't know anything about HOAs and
[133]
asked them for advice my father-in-law
[136]
got tagged saying that it should have
[139]
been disclosed prior to the sale but
[141]
sometimes with hood houses that get
[144]
smashed

we agreed that the $30 per month fee
[147]
wasn't horrible especially because they
[150]
did provide a really nice playground for
[152]
the neighborhood so I agreed and signed
[155]
the rules there were a couple that
[157]
seemed a little over-the-top to me but I
[160]
agreed anyway because from my
[161]
understanding at the time I really
[164]
didn't have any choice it seemed fine
[167]
enough until about a month passed and we
[170]
had a small housewarming party with a
[172]
couple of friends literally there were
[175]
less than eight people there including
[177]
my wife and I the house was small but it
[181]
had a nice deck so we were out back
[183]
having a small fire using a fire pit one
[186]
of our friends had just given us when I
[189]
heard someone knocking at the door no
[192]
pounding like a freaking cop I just went
[195]
around the house and there was the HOA
[198]
president with his car in front of my
[201]
house with a yellow police light on top
[204]
yes I'm serious I asked him how I could
[208]
help him and he very sternly told me
[211]
that I was in violation of the HOA rules
[214]
by throwing a party outside of approved
[217]
hours a 10:00 p.m. curfew and that I
[220]
needed to send my friends home or
[223]
quietly take it inside I checked my
[226]
watch and it was 1005 p.m. I was amazed
[230]
but we took it inside regardless the
[233]
next day the very next day I had a
[237]
letter from the HOA stating that it was
[239]
my official warning for violation of the
[242]
HOA rules by throwing a anti quo wild
[247]
bonfire that was a safety hazard while
[250]
drinking
[251]
I literally hadn't drank at all whatever
[254]
I brush it off and figured it was no big
[257]
deal
[258]
flash-forward six to nine months we were
[262]
hosting a teen group devotional for our
[264]
church one afternoon and we were playing
[266]
a game of football in the street we
[269]
lived on a connecting street that got
[271]
virtually no traffic and had only two
[274]
houses on it ours and the family across
[276]
from us whose kids were also playing in
[279]
the game all of the sudden I hear a
[282]
police siren and see the yellow light
[284]
flashing HOA president gets out and
[288]
tells us that we have to break it up
[290]
immediately as it's a safety hazard
[292]
because one of the kids could get run
[294]
over I was fed up with him and told him
[298]
that we were fine and that we've been
[300]
watching for cars and he was literally
[302]
the first car we've seen and we had been
[305]
playing for over an hour at that point
[307]
he insists and asks what would happen if
[311]
an ambulance or police officer needed to
[314]
come down that street to save someone's
[315]
life this was stupid because literally
[319]
both streets we were connected to have
[322]
entrances from the main road I gave in
[325]
and we went inside the next day I get a
[329]
letter explaining that I was being fined
[331]
$60 the maximum fine allowed for a first
[335]
offense and that if I wanted to protest
[337]
it I could attend the next HOA meeting I
[340]
decide that I want to protest the fine
[343]
but notice that the fine was due in 30
[346]
days and the next meeting wasn't for 35
[349]
days

I opted not to pay until after the
[354]
hearing and wrote a letter back to the
[356]
HOA president stating as such I go to
[360]
the meeting and it's literally myself
[362]
the HOA president the HOA secretary who
[366]
is the president's wife the vice
[368]
president who is the president's
[370]
neighbor and the treasurer the vice
[373]
president's wife my protest was
[376]
immediately overruled and I was also
[379]
charged $30 late fee for not paying on
[381]
time despite notifying him
[384]
I was fed up I couldn't take it any
[388]
longer but realized I really didn't have
[390]
any recourse about four to five months
[393]
later we gave birth to our first child
[396]
and about a month after that I was
[399]
driving home when I I was working a
[401]
second job in retail at the time and my
[404]
buddy in the military called me he had
[406]
been deployed when my daughter was born
[408]
and was calling to congratulate made
[411]
when I got home I didn't want to risk
[414]
waking up my sleeping newborn daughter
[416]
so I just sat in my car with the engine
[419]
running as it was a little chilly
[421]
outside i sat there for about half an
[424]
hour when I heard the police siren and
[427]
saw the yellow lives now keep in mind
[430]
police sirens and choir and this was
[433]
right in front of my house his stupid
[436]
yellow light was flashing everywhere
[438]
including into my daughter's bedroom I
[441]
got out of the car and rather rudely
[444]
told him to turn off the light as to not
[446]
wake my daughter
[448]
he explained that I looked suspicious
[452]
sitting in my car with it running
[454]
outside of my house I explained the
[457]
situation and he told me I had to go
[460]
inside and that my history of being a
[463]
troublemaker wouldn't grant me any
[465]
leniency I basically told him where I
[469]
thought he could go and proceeded to sit
[472]
on the hood of my car he sat there for
[474]
another 15 minutes telling me I needed
[477]
to go in and at one point touched my
[480]
shoulder I explained to him that if he
[482]
touched me again I would take it as a
[485]
sign of aggression and defend myself
[487]
which he responded by getting in his car
[490]
and leaving he circled the block about
[493]
four times the next thirty minutes which
[496]
was when I got too cold to stay out and
[498]
finally went inside next day I get a
[502]
hand delivered letter from him and the
[504]
vice-president and he also asked me to
[507]
step outside to talk about last night's
[509]
incident he explains that he was being
[512]
nice by not calling the police on me
[515]
after I threatened him
[517]
at which point I cut him off and told
[519]
him that he needed to get off my
[521]
property before I called the police on
[523]
him for trespassing I read the letter
[526]
and saw that he was giving me two
[528]
different fines for a hundred and eighty
[530]
dollars each which were the maximum
[533]
amounts one for violating curfew and one
[536]
for disobeying the night watchman I was
[540]
done I had reached my breaking point
[543]
this is where the revenge comes in I
[546]
start looking into the homeowners
[548]
association laws and regulations
[550]
regarding fines and how to protest them
[553]
because I felt like this was clearly
[555]
abuse I find that the law states that
[558]
you must be notified of an HOA ten days
[561]
prior to closing on a house and must be
[564]
served with the HOA rules within 45 days
[568]
of purchase or you are not subject to
[571]
being forced to participate in the HOA I
[574]
remember that we weren't served until
[577]
after we moved in which was close to 90
[580]
days after we closed so I called my real
[584]
estate agent who is a very close family
[586]
friend my in-laws have bought literally
[590]
thousands of houses from her over the
[592]
past thirty five years and asked if she
[595]
had the paperwork still and she said she
[598]
can get me a copy I looked and it was
[600]
over 90 days after purchase that we were
[603]
notified and there was no disclosure
[606]
statement at closing realtor says she
[610]
must have misplaced it because it's
[612]
required by law to be provided prior to
[615]
the sale and basically that she wouldn't
[617]
miss something like that because it
[619]
comes to her when they do a title
[621]
inspect on the house whether or not
[623]
there is a registered HOA she does a
[626]
little digging and calls me back two
[628]
days later and says that my neighborhood
[631]
doesn't have an HOA registered with the
[633]
city or county which is required
[636]
I end up calling the county office in
[639]
charge of registering and give them the
[641]
neighborhood name and she says that our
[643]
neighborhood is registered in the other
[646]
city not in our city and that if we want
[649]
it to start an HOA we would have to
[652]
follow these certain steps and without
[654]
those the HOA wouldn't be allowed to
[657]
collect any money or have any authority
[660]
apparently what had happened was our
[663]
neighborhood was originally all in one
[665]
city but when the city lines changes the
[669]
neighborhood was split in half the other
[671]
neighborhood kept the HOA that was
[673]
registered and our HOA president was
[677]
supposed to register with the state but
[679]
didn't feel like jumping through all of
[681]
the hoops that it required it I was
[684]
ready to walk down to the president's
[686]
house and rip into him but decided to be
[689]
smart for a minute I talked to my
[692]
neighbor across the street who also
[694]
hated the HOA and told him what I found
[697]
out he was furious about it as well we
[702]
talked to a few more and get a group of
[704]
about ten of us together that we agree
[706]
we need to show up at the next HOA
[708]
meeting word has apparently spread
[711]
because there ended up being more people
[713]
than the library meeting room could host
[716]
I had specifically asked to be the
[719]
speaker for the group which they were
[721]
nice enough to let me do the president
[724]
tried to prevent me from speaking due to
[726]
being overdue on my fines at this point
[729]
I'm about three weeks lay on my last set
[731]
of fines with the $30 a week penalty on
[734]
each fine so my current bill is set to
[737]
be about five hundred and forty dollars
[739]
but I spoke anyway
[742]
I explained to him that I had contacted
[745]
my in-laws attorney who is also a family
[747]
friend who had drafted together a
[750]
lawsuit regarding the fact that they
[752]
were impersonating a registered HOA in
[755]
order to collect money from us which was
[757]
fraud the president dismissed me and
[760]
said I had no idea what I was talking
[762]
about and that he had enough of my
[765]
antics the staff members all left
[768]
immediately while the rest of
[770]
stayed and talked a month later we
[773]
served them formally myself and 20 other
[776]
homeowners suing them for all fines in
[779]
HOA Jews we had paid to the tune of
[782]
approximately $50,000 as some of these
[786]
families have been there over 10 years
[789]
the President and Vice President got
[792]
their own attorney who attempted to
[794]
legitimize the HOA but it required the
[797]
signature of like 90% of the homeowners
[800]
they got three signatures including the
[804]
two of themselves some other old bitter
[807]
hag signed after that they tried to
[810]
settle to agree to abolish the HOA and
[813]
showed that they hadn't financially
[815]
gained from air and that all funds had
[817]
been used for the park upkeep snow
[820]
removal and other neighborhood events we
[824]
took a vote and this was turned down in
[826]
overwhelming fashion I was surprised I
[829]
actually voted to accept this then about
[833]
a week later one of the other families
[835]
calls and mentioned something about the
[837]
park maintenance and snow removal
[840]
apparently he had given a quote to do
[842]
the landscaping for the park cutting the
[845]
grass mulching etc and his quote had
[848]
been a couple hundred books cheaper than
[850]
what they were paying and that it always
[853]
bothered him because the person that did
[855]
the jobs was the vice president's son
[857]
and that what they were paying him was
[860]
pretty much outrageous in terms of what
[863]
standard eventually it went to core
[866]
where the judge looked at everything and
[869]
mandated that they paid $21,000 $1,000
[874]
per homeowner plus attorney and court
[877]
fees which were like another two
[879]
thousand dollars for a total of twenty
[881]
three thousand dollars in damages
[885]
additionally they were fined by the
[887]
city's governing body after it was
[889]
reported I don't know how much that fine
[892]
was though we ended up selling the house
[895]
that following summer but I talked to a
[897]
couple of friends that still lived there
[899]
about a year after
[900]
and they said that the President and
[902]
Vice President both sold their houses
[905]
and moved away because they were pretty
[907]
much hated by everyone in the
[909]
neighborhood and that they had an
[911]
informal HOA that people donated to for
[915]
upkeep of the park Wow
[919]
that guy was on some serious power trip
[922]
right there oh my goodness like putting
[925]
a siren on your car I'm pretty sure
[927]
that's probably illegal like Wow and
[929]
when they started mentioning the fake
[931]
HOA I thought this person was gonna set
[933]
up a real one and start like doing it to
[936]
them but I mean that works as well hey
[940]
