all rely on the company of our choice聽 to respect our privacy at the time.聽聽

But what happens when it decides to say go public?聽 Well, that's the dilemma 23andMe could be facing聽聽

following a merger with a company owned by聽 controversial billionaire Richard Branson.聽聽

So joining me now to go further in聽 depth on this story is Sara Papantonio,聽聽

associate attorney at Levin Papantonio Rafferty.聽 Sara, it's great to have you on the show today.聽聽

I want to start by looking at the details聽 of this case. So 23andMe is merging with聽聽
[42]
VG Acquisition Corp, which is owned by Richard聽 Branson's Virgin Group. How much control does he聽聽
[48]
now have over a company that many of us have聽 used and trusted with sensitive information?聽

Well, control is the major issue here because聽 Richard Branson's company now has control聽聽
[60]
over people's private information as a majority聽 shareholder here. You know, see when most of us聽聽
[65]
got the 23andMe test, we, it was fun. You know,聽 we were looking to see who our ancestors were,聽聽
[70]
what the genes in our family were like. It all聽 seemed harmless, but what we didn't expect was聽聽
[75]
for that information to then go public. See,聽 this is essentially a massive attempt at data聽聽
[80]
mining involving all of our health data, with聽 that data being sold to the highest bidder and聽聽

Richard Branson is sitting at the聽 head of the table with that control.聽

Yeah, that's a great way to put it. I know we聽 talk a lot about Facebook and social media and how聽聽
[94]
much data they gather from us. But we're talking聽 about a company that literally has our DNA samples聽聽
[99]
along with information about who we may be聽 related to, our conversations with those聽聽
[104]
people. There's definitely a lot going on there.聽 Now, of course, when we're talking about money,聽聽
[109]
this merger will allow 23andMe to go聽 public with a valuation of $3.5 billion.聽聽

Many are seeing the dollar signs here, of聽 course, but are there legitimate concerns聽聽
[120]
that a quest to continue to grow could change the聽 privacy standards that customers have relied on?聽

Yes, absolutely. Now understand that health聽 virtually controls every aspect of our life.聽聽
[132]
That if you have access to our health information,聽 that data can effectively be used to control聽聽
[138]
the market for anything. If you have that聽 information, then you can market based on聽聽
[142]
our nutrition, our medical care, you can market聽 all the way to our grave. So this data can now聽聽
[147]
be broadly given to anyone willing to pay for聽 it. And the problem with that is that once the聽聽
[152]
public understands this and reacts to it, that聽 there's going to be a potential for backlash,聽聽
[157]
both in the public and popular realm of backlash,聽 as well as legislative backlash. And what that's聽聽
[163]
going to do is it's ultimately going to affect聽 the value of this company in the long run.聽

Yeah, certainly. And that could be,聽 you know, backlash of the company,聽聽
[170]
as it's hoping that it's going to make even聽 more money by going public. Now, when we're聽聽
[174]
talking about companies like 23andMe, they have聽 become increasingly in recent years with many,聽聽
[181]
not necessarily considering the privacy aspects聽 of, you know, handing over their DNA at the time.聽聽

What legal standings do customers have over the聽 protection of their information in the long run?聽

At this point, customers don't really have聽 much legal standing or really any protection聽聽
[199]
at all. And I anticipate that this is going to be聽 huge. It's going to be a huge field of law that's聽聽
[203]
going to be litigated in the years to come and聽 that's basically mostly because our Congress and聽聽
[208]
the department of justice just seems so unwilling聽 to aggressively protect those privacy rights for聽聽
[213]
individuals and protect consumers in this route. Yeah. I know there have been a lot of concerns聽聽
[220]
about exactly what our privacy is and where聽 it stands when it comes to social media. Now,聽聽
[226]
when it comes to these genetic testing companies聽 moving forward. So we'll see exactly where that聽聽
[231]
