A very common question, one that we've been seeing聽a lot recently probably because everybody is聽聽

filing their taxes is what to do when your spouse聽is a foreign national. They're an immigrant and聽聽

they don't have a Social Security Number yet. What are you supposed to do when you're filing聽聽

your taxes? A lot of individuals think that they聽are supposed to file single or 聽聽

they're stuck and they're not sure what to do. We want to let you know that a lot of you might聽聽

use programs like H&R Block and TurboTax and聽things like that. Those are really very basic聽聽

form-filling software that can't handle聽more complex and other unique situations like聽聽

having a spouse who is a foreign national. For those of you who are married to individuals聽聽

who live in another country and they聽haven't received their green card and don't have聽聽

a Social Security Number yet and you're聽still going through the immigration process but聽聽

you're legally married. You should really聽be filing taxes jointly because you are married.聽聽

I want to preface this with: I'm聽not a tax expert, I am not going to give tax聽聽

advice but I will give advice from聽an immigration standpoint and what I do聽聽

know about taxes. We've seen a lot of聽individuals that say, "I was trying to file on聽聽

TurboTax or H&R Block and it asks for my spouse's Social Security Number.聽聽

He or she doesn't have one yet. Do I file single or聽聽

what are my options here?" From聽an immigration standpoint, if you're married聽聽

you want to show immigration that you have a real聽relationship. A lot of you are just starting聽聽

out in your immigration journey or those who are聽in the middle of your journey know that one of聽聽

the parts of your immigration case is showing聽immigration that you have a real relationship聽聽

based on love. That you are joining your lives聽together so filing taxes single would be聽聽

something that would hurt you because that's聽usually something that you can use for evidence聽聽

that you file your taxes jointly like a聽married couple would. What a married couple does聽聽

also from a tax standpoint, there are certain聽 things that you can't claim. There are聽聽

certain instances when you can't file head of聽 household or you shouldn't legally file聽聽

single. What we recommend is that you聽look for someone, a Certified Public Accountant.聽聽

Someone who is more than just an H&R Block form filler. Not to bash on H&R Block, all of those聽聽

programs are great for individuals. For whom聽those programs can work that have a more basic聽聽

filing. But you really want to find someone who聽can help you prepare your taxes that understands聽聽

that you're married to an individual who lives in聽another country and doesn't have a Social Security聽聽

Number yet. There is something called an ITIN,聽an Individual Tax Identification Number that's聽聽

typically used for individuals who are not聽yet lawful permanent residents or United States聽聽

citizens. Finding someone who can聽give you expert advice in the realm of taxes and聽聽

help you to properly prepare your taxes to be聽filed jointly is going to help you because聽聽

you want to be in compliance with tax law in聽the United States and also because typically聽聽
