[35]
as one digital asset investor put it
[37]
ethereum received a free pass and there
[39]
was a lot that went wrong here
[41]
he discovered something considerably
[43]
worse throughout the course of this
[44]
lawsuit and it is the footage in which
[46]
joseph lubin describes how he intended
[49]
to assist in disguised whale purchasers
[51]
during the ethereum pre-sale
[53]
he defined it as a picture paints a
[55]
thousand words which is accurate
[57]
apparently this is a screenshot from the
[59]
ethereum pre-sale as reported by digital
[62]
asset investor
[64]
let's have a listen so there you have it
[66]
all they needed was an email address to
[68]
identify the masked whales who were
[70]
participating in the ethereum ico
[73]
to add to that james felin put this out
[75]
in today ruling judge torres ordered
[78]
three documents unsealed now
[80]
172-1 the notice of brad garlinghouse
[83]
deposition in the security and exchange
[85]
commission formal investigation 179-4
[89]
a chris larson email string and 179-5
[93]
a brad garlinghouse email
[95]
interestingly as has been the case
[97]
throughout this probe chris larson and
[99]
brad garlinghouse have been under more
[101]
scrutiny than anybody else in the
[103]
industry yet they have remained as clean
[105]
as a whistle at every step they have not
[107]
been accused of fraud or anything of the
[109]
kind
[110]
they sent out an email from chris larson
[112]
and brad garlinghouse that was
[113]
essentially phrased in the manner of the
[115]
prose that they have always been
[117]
there is nothing shady going on here
[119]
based on the emails it seems that there
[121]
is no evidence to support the security
[123]
and exchange commission action
[126]
according to the larson email thread he
[128]
is just a plotting ripple for its
[129]
ability to facilitate cross-border
[131]
transactions
[133]
in the email larson says from ripple
[135]
perspective we could not be more excited
[137]
about ex-border payments using
[139]
blockchain and digital assets like xrp
[142]
over swift the recent moneygram
[144]
announcement is a great example of
[145]
incumbents agreeing with our vision
[148]
our view is to grow at full speed into
[150]
these huge opportunities we are hiring
[153]
as fast as we can at the same time funds
[156]
like xpring are investing in new
[157]
additional verticals and teams
[160]
there are many many great opportunities
[162]
of course that is not the whole email
[164]
but i cannot just read out the entire
[166]
email thread as then the video will get
[168]
too long
[169]
however i should point out that there is
[171]
no specific proof for the security and
[173]
exchange commission in these emails
[175]
and the brad grilling house email
[177]
secondly just last week more than 20
[180]
ripplers including me had a very
[182]
successful showing it comes the biggest
[184]
blockchain conference of the year one of
[186]
our company objectives is to build
[187]
liquidity for the digital asset xrp so
[190]
banks and payment providers can use it
[192]
to significantly lower the costs of
[194]
their cross-border payments
[196]
our primary goal at consensus was to
[198]
advance deals with digital at exchanges
[200]
and payment providers that build 3p
[202]
liquidity and payment volume
[204]
mission accomplished both leading into
[206]
the event and coming out of the event we
[208]
cannot have great momentum in adding
[210]
exchanges and payment service providers
[212]
as ripple partners
[214]
the bottom line is that we are committed
[215]
to making xp the best digital asset for
[218]
payments
[219]
while cannot predict future market
[221]
dynamics this is a very exciting time
[223]
for us as the market is recognizing crp
[226]
real use case liquidity for cross-border
[228]
payments and technical superiority
[230]
compared to other digital assets
[233]
so do you see anything that is going to
[234]
hurt xrp
[236]
this is something i have been saying for
[238]
a long time all of this stuff you're
[240]
looking at is either a stage set and
[241]
everything we are witnessing as a movie
[243]
or there is something very horrible
[245]
going on here
[246]
i am not sure which it is there is a
[248]
middle ground in this situation which is
[250]
that everything has been arranged by the
[252]
government and all of the other things
[254]
then there is the possibility of a few
[256]
bad actors thrown in for good measure
[259]
that is sort of where i am leaning right
[261]
now and a lot of stuff was planned a
[262]
long time ago so i am not surprised
[265]
i will explain why i believe this but
[267]
along the route there are some terrible
[269]
actors whether they are major mega banks
[271]
or bad actors that decided they wanted
[273]
to throw a wrench in the works
[275]
i will explain why i believe this later
[277]
to put it another way i believe that
[279]
there is an overarching strategy in
[281]
place but that there are some corrupt
[283]
activities taking on inside the plan as
[285]
well
[286]
unfortunately a handful of paragraphs in
[288]
an email from brad garlinghouse to
[290]
workers concerning xrp holder's
[292]
expectations for the price of xrp and
[295]
ripple control over the digital currency
[297]
might be detrimental to the ripple case
[300]
as brad garlinghouse says in the email
[302]
despite a proven track record of being
[304]
good stewards of xrp we had continued to
[307]
hear concerns in the market that ripple
[309]
could hypothetically sell our 61 billion
[312]
xrp at any time a scenario that would
[314]
certainly be bad for ripple
[316]
so with the decision to lock up 55
[319]
billion xrp in escrow we have given
[321]
investors a predictable supply schedule
[323]
and removed what skeptics have suggested
[325]
has been a barrier to broader xrp
[327]
adoption
[329]
according to jeremy hogan who reviewed
[331]
the piece of evidence ripple seems to
[333]
have put a significant amount of thought
[335]
and effort into the xrp pricing and the
[337]
usage of the phrase investors is
[339]
regrettable
[340]
as he says in a tweet it is not all that
[342]
bad for ripple as it was sent only to
[344]
ripple employees and the issue was
[346]
whether xrp purchasers expect ripple to
[349]
increase the price of xrp
[351]
xrp holders back in 2017 never saw this
[354]
email
[355]
what do you think is jeremy hogan right
[358]
moving on john deaton thinks judge
[360]
torres findings are a good indication
[362]
for xrp investors
[364]
judge torres obviously supports public
[367]
information as seen by these opinions
[369]
deaton says that what these rulings
[371]
clearly show is that judge torres favors
[374]
public disclosure
[375]
ripple cannot seal certain documents
[377]
that is legal the same applies to the
[380]
security and exchange commission think
[382]
ahead we may ultimately get to see the
[384]
63 hinman emails we may eventually be
[387]
able to view the 63 hinman emails
[390]
i do not think we will ever see the 63
[392]
hinman emails because i do not think
[394]
they will be able to show you those
[395]
emails
[397]
it would in my opinion place much too
[399]
much pressure on not just the security
[401]
and exchange commission but also the
[403]
cftc
[404]
i feel that many of these branches of
[406]
government were engaged in all of this
[408]
and that they do not want to be in the
[409]
limelight
[410]
so will the judge also disclose emails
[413]
of hinman's speech so could judge torres
[416]
stepping in means that the lawsuit might
[417]
end in august as hogan predicted
[420]
but at the time hogan expected a
[422]
five-month briefing schedule before the
[424]
judge even gets the case to make a
[425]
decision which could take about three
[427]
months
[428]
if we take the dpp chapter into account
[431]
that could mean the case will not be
[432]
over before 2023
[434]
he added that the parties can stipulate
[436]
a shorter time frame and the judge would
[438]
agree with that
[440]
but do you think the security and
[441]
exchange commission would agree to
[442]
shorter time frames
