Channel: Law Offices of Jacob J. Sapochnick

Hello, everybody. In this video, we're going聽
to talk about a few very important topics.聽聽
[3]
They're going to give us a glimpse into Biden's聽
administration's plan for immigration reform聽聽
[8]
and where we are heading. First, we're going to聽
talk about the temporary family visitation act聽聽
[13]
that is being proposed by Senator Rand Paul and聽
Senator Blumenthal. This legislation is going聽聽
[18]
to make it easier for families of US citizens聽
and green card holders to be able to apply for聽聽
[23]
visitor visas and be able to come for special聽
events like weddings and funerals without the聽聽
[29]
hassle of getting their visas denied. We'll talk聽
about that, and how you may be able to benefit聽聽
[34]
from this legislation if passed. Next, we'll talk聽
about Biden's meeting with six DACA holders last聽聽
[40]
week in the White House and his specific agenda聽
to push further immigration reform in the next few聽聽
[45]
months. So, we'll talk about that as well. Very聽
important things for you to know. And finally,聽聽
[49]
we'll talk about the latest proclamation that聽
Biden revoked, the health insurance proclamation,聽聽
[54]
that proclamation that required immigrants to get聽
health insurance upon entry to the United States,聽聽
[59]
that has been revoked. We'll talk about what聽
this means to you and the implications for future聽聽
[64]
immigrants coming to the United States. So, what聽
are you waiting for? I'll see you on the other聽聽
[68]
side. Hello, everybody. And welcome back to our聽

like so YouTube will be able to share this video聽聽
[104]
with more people just like you. In this video, we聽
got a few important updates for you. Specifically,聽聽
[109]
when it comes to Biden's future immigration聽
reform things that are happening right now,聽聽
[113]
give us some clues as to where this administration聽
is heading when it comes to immigration reform.聽聽
[119]
And also, when it comes to legislation that will聽
make the immigration process a lot more humane聽聽
[124]
and reasonable. So, let's start with the聽
temporary family visitation act. So, under our聽聽
[128]
current visa systems, American families that have聽
relatives abroad, whether they're US citizens,聽聽
[135]
or green card holders, and their families聽
overseas are not able to reunite with their聽聽
[140]
families overseas for family events like weddings,聽
funerals, or other things that require them聽聽
[147]
to arrive in the United States fast without聽
waiting for months and months and sometimes years聽聽
[153]
to get their visas approved under the temporary聽
family visitation act. A new visa will be created.聽聽
[159]
They're going to call it the B3 visa. Currently,聽
we have the B1, B2. B1 is designed for business聽聽
[164]
tourism, that B2 is the most common visa that聽
allows visitors to come and visit their family聽聽
[170]
members or for tourism to the United States.聽
This new category is going to be called B3.聽聽
[175]
What can you do with this B3 visa as a US citizen聽
or green card holder, you'll be able to petition聽聽
[181]
the B3 visa for the following family members,聽
spouses, children, grandchildren, parents,聽聽
[189]
grandparents, siblings, uncles, and聽
aunts. This is the only visa category聽聽
[194]
that allows us citizens and green card holders聽
to petition for uncles and aunts. and finally,聽聽
[200]
nieces and nephews. The application will require聽
that the petitioner typically a US citizen or聽聽
[205]
green card holder to send a special petition聽
for the relative before they apply for the visa聽聽
[215]
and also purchase, for them, travel insurance聽
before they come to the United States.聽聽
[220]
That travel insurance should cover them throughout聽
the duration of their stay. The idea is that the聽聽
[225]
US citizen or green card holder sign some sort of聽
declaration that they are financially responsible聽聽
[230]
for their relative to stay in the United States聽
and return safely to the home country. And this聽聽
[235]
way, discouraging people from overstay because now聽
we have the petitioner involved in the assurance聽聽
[242]
that their family member will go back home.聽
And we hope that with this visa, if and when聽聽
[247]
it's available, we'll see more of these consular聽
officers issuing those visas because there's聽聽
[251]
going to be less likelihood of these people聽
to overstay because now we have a third party聽聽
[256]
that guarantees they're returning. Currently,聽
there is no visa that specifically allows people聽聽
[261]
for temporary reunification with family members聽
for a specific event or because they really have聽聽
[266]
to come to the United States urgently. B1, B2 visa聽
that we have at the moment is not good enough.聽聽
[271]
It's very complicated to get it and most people聽
get denied under Section 214 B, which basically聽聽
[276]
says that they don't have sufficient ties to聽
return back home and most applicants will get聽聽
[281]
denied for their tourist visas. Section 214 B is聽
the main reason why they get denied and people try聽聽
[287]
for years and years to apply. It doesn't help them聽
even to say that they have a family member here or聽聽
[292]
there's an event or they need to go to consular聽
offices typically don't care because again,聽聽
[297]
there's no guarantee that their personal聽
return home. Hopefully, with the B3 visa,聽聽
[301]
there'll be more assurances, and more people are聽
going to be able to get that to be able to reunite聽聽
[306]
with their family members in the United States.聽
So, in summary, we hope that this legislation聽聽
[311]
is going to pass, it's going to be good for聽
many reasons, it will bring families together,聽聽
[315]
it will reduce the unnecessarily denial rates will聽
impact over a million visa applications per year,聽聽
[321]
he will open a path for US citizen and green聽
card holders to petition for their family members聽聽
[326]
abroad, specifically to come to visit them. And聽
for family reunification, he will stimulate the聽聽
[331]
US economy, the more people come to visit and聽
spend money here... the better for everybody.聽聽
[335]
And finally, it'll provide financial assurance to聽
the US government, that these people are going to聽聽
[340]
go back home at the end of their visit. Overall,聽
good news. Of course, I'll keep you posted once I聽聽
[344]
have more information about this legislation. But聽
overall, I'm very excited about this. So, let's聽聽
[349]
move on to our next topic. Biden's meeting with聽
six DACA recipients in the White House last week.聽聽
[355]
And they talked about immigration reform, and聽
the plans of this administration to move forward.聽聽
[361]
Each one of these dreamers had a聽
chance to ask Biden one question.聽聽
[365]
And he answered them in private. But we do know聽
about this meeting, which is important for us.聽聽
[370]
Because we're all wondering what's happening聽
with immigration reform, it feels like things聽聽
[373]
are a little bit stuck. Well, the statement that聽
came from the White House after this meeting聽聽
[379]
states the following. President Biden reiterated聽
his support for dreamers, TPS holders,聽聽
[384]
farmworkers, and other essential immigrant聽
workers. The White House said in the statement,聽聽
[388]
the President and the dreamers also discuss聽
the continued need for immigration reform,聽聽
[394]
and the White House strong support for聽
the DREAM and Promise Act, and the Farm聽聽
[398]
Workforce Modernization Act, two bills that have聽
already passed the house with bipartisan support,聽聽
[403]
and are awaiting action in the Senate. As聽
you can see, it was an important meeting,聽聽
[408]
because many of us are wondering what's happening聽
with immigration reform. We haven't heard too much聽聽
[412]
action going on in this in the past few months.聽
Yes, we have two bills that passed the house. And聽聽
[417]
now, we鈥檙e anxiously awaiting action from Senate.聽
And hopefully, we're going to see that in the next聽聽
[422]
couple of months, because something must happen.聽
And remember, the reason why he met with those聽聽
[427]
DACA recipients is because now, we are waiting聽
for a federal judge to make a decision about DACA,聽聽
[434]
and maybe completely eliminate it. And if that聽
happens, it's going to be devastating for over聽聽
[438]
a million of these young individuals that are聽
working here that are legally contributing to聽聽
[443]
our economy. And so, I think Biden wanted to聽
show everybody that no matter what happens聽聽
[447]
with their court decision, this administration is聽
going to protect the dreamers and hopefully make聽聽
[452]
the DREAM Act a reality in the next few months.聽
Once the Farm Workforce Modernization Act passes,聽聽
[458]
it will open the door for major comprehensive聽
immigration reform. Because without that,聽聽
[463]
it's going to be very difficult to pass a full聽
amnesty unless we're going to go piecemeal,聽聽
[469]
legalizing the DACA recipients, the聽
farmworkers, the TPS holders, and then finally,聽聽
[475]
going full-blown immigration reform for the 11聽
million undocumented that are currently waiting聽聽
[480]
for this to happen every single day. So, I think聽
these are good news for us to expect to hear more聽聽
[485]
and we expect to get more clues and action from聽
the White House in the next few months. One other聽聽
[491]
thing is our final topic for today's video is the聽
revocation of the health insurance Proclamation.聽聽
[498]
And once again, while the administration is聽
pushing for comprehensive immigration reform,聽聽
[502]
Biden continues with his promise from the early聽
days, and that is to modernize and improve our聽聽
[508]
immigration system, reversal of Trump's inhumane聽
orders, including this one, Proclamation聽聽
[513]
9945 that suspended the entry of immigrants who聽
would financially burden the US healthcare system.聽聽
[520]
And once again, it's under this administration's聽
effort in restoring faith in our immigration聽聽
[525]
system. So, this proclamation is聽
now gone. Made it very difficult聽聽
[530]
to a lot of immigrants who can't really afford聽
to buy the expensive health insurance that was聽聽
[534]
required under the original Proclamation. And聽
it also gave a lot of room to the government聽聽
[538]
to decide who could financially burden our聽
healthcare system. So, again, because of a聽聽
[543]
lot of fear and anxiety on immigrants, and now聽
this proclamation is gone. So, again, while Biden聽聽
[549]
is doing a lot of efforts to restore faith in our聽
immigration system, what we do need right now is聽聽
[554]
full comprehensive immigration reform. And I think聽
those two things are working side by side on hand.聽聽
[561]
They're trying to get rid of a lot of these bad聽
proclamations from the Trump era. There's a lot聽聽
[566]
of new legislation that is being introduced,聽
like the Temporary Family Visitation act,聽聽
[571]
and at the same time, the administration continues聽
to push for immigration reform. And of course,聽聽
[577]
