that i'm sure you've dealt with in your

career if you're a new agent you will
[8]
deal with in your career and something
[9]
you are uniquely
[11]
unqualified to really deal with
[14]
so we're we're putting insurance agents
[17]
in a strange position
[19]
because
[20]
there's so many different types of power
[22]
of attorney that we start talking to
[24]
clients and we just use a general power
[27]
of attorney term and i think if i just
[30]
you know give you a little basic
[31]
information it might make your life a
[34]
little bit easier as an insurance agent
[36]
so let's get started the first thing
[38]
about power of attorneys
[39]
when you're dealing with let's say for
[41]
example a medicare advantage
[43]
client and they say oh i have power of
[45]
attorney over my mom you know we've
[47]
trained you to say that's fine if you
[49]
have power of attorney you have the
[51]
legal ability to sign for your mom so it
[54]
means you can do everything for your mom
[55]
your mom does not need to be present i
[57]
would do my presentation for you
[60]
go through my
[61]
completely compliant
[63]
you know presentation and
[66]
you would make the decision for your mom
[67]
you would sign on your mom's behalf so
[70]
i'm never actually required to talk to
[72]
your mom now this is the part that is
[75]
unusual
[76]
is that i never have to actually
[79]
see or hold or retain a copy or provide
[83]
to the insurance company that power of
[85]
attorney so back in the old days back in
[88]
2005
[89]
we did we had to secure a copy of the
[92]
power of attorney and submit it with an
[93]
application when somebody was signing
[95]
okay which kind of made sense then a
[97]
couple years later the insurance
[98]
companies said we don't want it it's
[100]
more paper we don't want to deal with it
[101]
if we want it we'll ask for it
[104]
so that was kind of nice to relieve that
[106]
burden on us
[107]
but now insurance agents
[109]
just take the word for it that there
[111]
actually is that legal document
[113]
conveying the power
[114]
so i had a client personal client and
[119]
i did everything for her
[121]
and then her daughter called in
[122]
screaming because she has power of
[124]
attorney over her mom and how dare i
[127]
sell her mom a plan
[128]
so i'm like
[130]
mom
[131]
appeared to be totally
[133]
competent
[134]
and i had no reason to suspection power
[136]
of attorney i wouldn't ask people i
[138]
wouldn't ask somebody to somebody have
[140]
power for attorney over you you know
[141]
that's kind of insulting so i no way to
[144]
know but i'm very sorry you know
[147]
what type of power of attorney do you
[148]
have and can you furnish me a copy so
[150]
that's when the conversation took a
[151]
different turn because then it turned
[153]
out she did not have power but she was
[155]
gonna get one
[157]
okay whatever

this is the thing you guys deal with all
[161]
the time
[162]
and
[163]
last week
[165]
we had a son call in and he said hey
[169]
i already changed my mom's insurance for
[171]
2022. i already did the research with
[173]
the agent
[175]
i have part of her journey
[177]
and i did it and i enrolled her
[179]
since then since october 15th
[183]
she's already changed her plan
[185]
six times
[187]
she met with six different agents
[189]
i mean she did some of them on the phone
[191]
and she's enrolled in six different
[193]
plans he goes what can i do
[196]
to prevent her from doing that and
[198]
there's nothing i can do
[201]
there's nothing we can do on our end he
[204]
can go get guardianship so that she's
[205]
not able to enter any contract
[209]
but
[210]
a simple power of attorney is not enough
[211]
to stop her from doing that now there's
[214]
a lot of different powers of attorney so
[216]
why don't we just back up a little bit
[218]
and let's talk about different powers of
[220]
attorney because this will help you guys
[221]
in your own life because most people
[223]
have cause to use a power attorney with
[224]
their own parents in-laws
[227]
your kids
[228]
and of course your own estate planning

so

limited power of attorney that's real
[233]
easy i got to close on my house i'm not
[235]
going to be here for the closings i have
[236]
to be at a conference i can give power
[238]
fraternity to my sister with the
[240]
specific limited scope to
[243]
work with the mortgage company so a
[245]
limited power of attorney is very simple
[248]
um a lot of times people give that away
[250]
because they're like you know i'm
[252]
totally mentally cognizant but i'm
[253]
really bad with financial affairs my
[255]
husband always handled that he died so i
[257]
could give financial power of attorney
[258]
to my daughter for insurance banking
[262]
whatever but i'm still doing the other
[264]
stuff so limited power of attorney
[267]
something you might use like again in
[268]
your own family
[270]
general power of attorney is much
[272]
broader and that's typically what we're
[274]
dealing with
[275]
and
[276]
it will say it would still have you can
[278]
delineate the different things you you
[280]
do have access to or not
[282]
but
[283]
this can vary by state
[285]
and the thing that catches you guys off
[289]
is that if we're not supposed to look at
[290]
it
[291]
we're not supposed to verify they even
[292]
have it we're just supposed to take
[294]
their word for it do we as agents have
[297]
any liability
[298]
and no as long as you have no reasonable
[303]
expectation that they're trying to
[304]
commit fraud
[306]
right then you're good we haven't seen
[308]
that in the medicare space
[310]
let's hope we don't throw salt on our
[311]
shoulder or whatever we do that but it's
[314]
something that i see more and more as
[317]
you know the volume of people are
[319]
streaming into medicare is that we're
[321]
dealing with these power of attorneys
[322]
we're not really sure what to do with
[324]
them so let's talk about the other type
[326]
of
[327]
springing power of attorney and that
[329]
will come into effect if something
[331]
happens so that's typically in a medical
[334]
situation where you guys aren't
[335]
generally dealing with the springing
[336]
you're more likely dealing with a
[338]
durable power journey which you have to
[340]
make it while you're mentally competent
[342]
and then it will
[344]
work it's made it with the anticipation
[347]
that you're going to be incapacitated by
[349]
illness or injury okay so
[351]
you feel like your dad's starting to get
[353]
some dementia he's still legally
[356]
competent you know he he still has the
[359]
ability to give you the power
[361]
and he does and then when he does slide
[364]
in deeper into dementia you already have
[366]
it you don't have to run to court to get
[367]
a guardianship you have this durable
[369]
power of attorney durable means it
[371]
continues to work even after he's
[373]
incapacitated and everybody needs a
[375]
durable power attorney so single people
[378]
you're single out there if you don't
[380]
have a power of attorney and you go to
[382]
the hospital
[383]
then your boyfriend lover
[385]
whatever your family or the hospital can
[388]
deny them access so a power of attorney
[390]
is very important for all single people
[391]
out there hello cutie pie parents you
[394]
need a power of attorney because
[396]
otherwise your kid's doctor my 18 year
[399]
old's doctor won't allow me any
[400]
information if i don't get a power of
[402]
attorney on file
[404]
that's frustrating when you send a kid
[405]
away to college so
[407]
there's a lot of information here the
[409]
thing i'm trying to impart to you guys
[411]
is
[412]
you're not really you're not really well
[413]
versed in this you're not attorneys
[414]
right you don't know most of you've
[416]
never had a power attorney so if
[417]
somebody says i have power of attorney
[419]
over my mom you're gonna take their word
[420]
for it your duty starts
[423]
with as long as you there's no obvious
[425]
signs of fraud that you have something's
[427]
up then you're okay to proceed with that
[430]
person
[432]
they are taking the liability when they
[434]
sign as power of attorney that they
[437]
that they have private journey that they
[438]
have the power for which
[440]
they are represented to you and they may
[443]
not so they might only have we have a
[445]
different powers attorney they might
[446]
have had a power of attorney for health
[448]
care
[449]
but they didn't have a power of attorney
[451]
for
[452]
insurance again i had this
[455]
i had a client call me from california
[458]
and she wanted to buy a medicare
[460]
advantage plan
[461]
no problem she said my daughter has
[464]
power of attorney she lives in new york
[466]
she'll be calling you
[468]
fantastic daughter calls me who took
[470]
care of everything
[471]
simple smooth just another day at the
[473]
office
[475]
about
[476]
a month later i get an irate call from
[479]
another daughter in a different state
[483]
how dare me do this she's gonna sue me
[486]
that's what you you know talk about your
[488]
blood pressure going up always being
[489]
threatened to be sued all the time
[491]
because she has power of attorney over
[493]
her mother and i did not have the
[494]
ability to do what i did so now i'm like
[498]
whoa
[500]
i asked both of the daughters to fax me
[503]
their copies of their power of attorney
[505]
one
[506]
had
[507]
the broad power of attorney to do
[509]
everything with finances insurance any
[511]
of that
[512]
one had a very limited power of attorney
[516]
so thank god the one that i
[518]
dealt with was right and everything went
[520]
through but even the daughters didn't
[522]
understand what what they had they
[524]
didn't know
[526]
they they just power of attorney but
[528]
there's different types of power of
[529]
attorneys and when you make a power
[531]
attorney you can be very specific you
[533]
can say i want my kids to be able to
[535]
have access to this this but not this
[538]
you know so
[540]
as an agent you're not an attorney you
[543]
are not
[544]
typically able to read and figure out
[547]
what's going on so just remember the
[549]
liability for you ends when that person
[553]
signs
[555]
okay so they're taking the liability
[557]
that they're doing the right thing
[558]
now

another easy question is

how do you sign for a power of attorney
[564]
because if you've never done it say
[565]
you're a new agent do you sign on the
[567]
line where it says applicant do you sign
[570]
so if you had power returning for me
[571]
sylvia gordon would you sign sylvia

gordon power of attorney because a lot
[575]
of people get confused
[577]
no power attorney doesn't give you the
[578]
ability to forge somebody else's name
[580]
nothing ever gives you that ability

you're going to write what your name is

bob smith

power of attorney for sylvia gordon so a

lot of times the power of attorney
[592]
doesn't know how to sign it and they're
[593]
asking you
[594]
so they're going to sign their name as
[596]
power of attorney for the person you're
[599]
providing insurance for i'm sure you
