And today I want to talk to those of you who are waiting

more information on an overpayment waiver.

Back in December with the stimulus bill, we had a provision
[10]
that was optional for States to include an overpayment waiver
[16]
to Claimants that were paid more than they were allowed with
[20]
their Pandemic related programs and then were required to
[23]
pay some back, sometimes with a penalty.
[26]
Well, if the overpayment was no fault of your own, you did
[29]
not. It a false statement knowingly and it creates financial
[33]
hardship. Then an overpayment waiver was created as an option
[37]
while in the state of California.
[39]
The California EDD stated that they would be opting into
[42]
this program, but we have not heard any mention of it or
[46]
additional details since winter.
[49]
Yesterday, on May 5th, a Department of Labor released
[53]
new guidance on the implementation of overpayment waivers.
[57]
This answers the question of why Edd has not stated any additional
[62]
information about the overpayment waiver.
[65]
This additional guidance from the Department of Labor very
[68]
specifically outlines how the States can implement the overpayment
[72]
waivers. So I would anticipate that following the release
[76]
of this guidance that the California Edd will release some
[80]
sort of a statement and an upcoming press release that more
[84]
information on overpayment waivers is available.

I want to go through the Department of Labor guidance for
[89]
you so that you can see the program details and what the
[93]
Department of Labor is allowing the States to choose from
[96]
in terms of how they are implementing the overpayment waivers.

Keep in mind that the California Edd will need to determine
[103]
exactly how they are going to be implementing this based
[107]
on the options of the Department of Labor provides once California
[111]
Edd decides how they're going to implement this and shares
[114]
exactly their own specific program.

Now, first up, this only applies to Pandemic related programs,
[123]
Pua, FPUC, which is the 300 dollars boost mixed earners compensation,
[128]
which is MEUC, which is not yet up and running in California
[133]
and PEUC.
[134]
It also applies to the first week of regular unemployment
[138]
compensation. Why only the first week of regular unemployment?
[142]
Because the first week is the pandemic federally funded week
[146]
of unemployment compensation so that there wasn't a gap in
[150]
a waiting period after you apply.
[152]
Now they stay here under waving Recovery of Over Payment
[155]
of Cares Act programs.
[157]
Federal law sets out the authority to waive recovery of overpayments
[161]
under certain circumstances for PUA, FPUC MEUC, PEUC in the first
[166]
week of unemployment compensation.
[168]
It is a matter of state discretion whether to exercise this
[171]
waiver authority, so it is optional for States to implement
[176]
this. It is not required.
[177]
A state may only waive repayment of an overpayment if the
[181]
state determines that number one, the payment of such compensation
[185]
was without fault on the part of any such individual.

And number two, such repayment would be contrary to equity
[194]
and good conscience.
[196]
They then go on to define what equity and good conscience
[200]
means means that it would cause financial hardship to the
[204]
person for whom it is sought.
[207]
Or the recipient of the overpayment can show, regardless
[210]
of their financial circumstances, that due to the notice
[213]
that such payment would be made, or because of the incorrect
[218]
payment, either they have relinquished a valuable right or
[222]
change positions for the worse, or recovery would be unconscionable
[227]
under the circumstances.

Now, the state can choose to either automatically determine
[234]
if this applies to every overpayment case, or they can provide
[239]
individuals with the ability to make a request.
[242]
These guidelines also lay out a provision for States to apply
[246]
blanket waiver, which means that the States may approve a
[249]
waiver of recovery for over pants using a single set of facts
[253]
which they are calling a blanket waiver.
[255]
There are two specific circumstances where States can provide
[258]
a blanket waiver.
[260]
Number one would be when an individual is eligible for payment
[264]
under an unemployment benefit program for a given week, but
[268]
through no fault of the individual, they were paid incorrectly
[271]
under either the PUA or FPUC program at a higher weekly benefit
[277]
award amount.
[278]
The state can also apply a blanket waiver if specific to
[282]
PUA claims, when, through no fault of the individual, the
[286]
state paid the individual a minimum weekly benefit reward.
[290]
Based on DUA guidance, the States must choose from three
[294]
different options.
[295]
They can choose number one, to not implement the overpayment
[299]
waiver option at all.
[301]
Or they can choose to exercise the waiver and not process
[305]
blanket waivers.
[306]
Or they can choose to exercise the waiver and process blanket
[310]
waivers. The state is opting into overpayment waivers.
[314]
Then they must notify all individuals with a non fault overpayment
[319]
of their ability to request a waiver.
[321]
If they are opting into using blanket waivers after they
[326]
assess and apply all of their blanket waivers, then they
[329]
need to alert anyone who was not covered under a blanket
[334]
waiver that they may request an overpayment waiver.
[338]
States also must, upon receipt of the waiver request, pause
[343]
further collections until a determination of waiver eligibility
[347]
is made.
[347]
That means that if you apply for an overpayment waiver while
[351]
that application is in process, the state cannot collect
[355]
any further overpayments from you until they determine a
[359]
decision. Some of you may have already paid back over payments
[363]
and you may be eligible for an overpayment waiver.
[366]
What this States here is that the state must refund any amounts
[370]
that were collected towards the applicable overpayment prior
[374]
to the determination of waiver eligibility.
[377]
But they do state here that given the many demands of state
[381]
agencies, it may take, for example, up to a year for the
[386]
States to program their computer systems and notify individuals
[390]
before they process such refunds.

So now that the Edd has this guidance from the Department
[396]
of Labor, I would hope that we would see something in a Press
[399]
release in upcoming weeks about more information about specifics
[404]
to how California will be implementing the overpayment Labor.
