attorney I wanted to briefly go over

what permanent disability is under a
[15]
claim for workers compensation benefits

now in workers comp if you're injured at
[21]
work and after you've had medical
[23]
treatment if you go on to have a
[24]
complete recovery and you have no
[26]
residual disability or impacts on what's
[29]
referred to as your activities a day
[31]
living
[31]
basically you're injured and you have a
[32]
full recovery and workers comp you are
[35]
not compensated for those damages now
[38]
you are compensated if after your
[41]
medical treatment you've not had a
[43]
complete recovery that is you do end up
[45]
with residual permanent disability now
[49]
the word permanent disability is sort of
[50]
a legal abstract what that means is if
[53]
you end up with ten percent permanent
[55]
disability it doesn't mean you've lost
[57]
10% of your functional capacity or that
[60]
you know if you've lost 50% disability
[63]
rating that doesn't mean that you've
[65]
lost half of your ability to work or
[68]
half of your ability to function it's a
[70]
legal abstract what that means is this

it's based on a few things it's based on
[77]
your injuries and the impact it has on
[80]
something called the activities of daily
[82]
living what that means is cooking
[85]
cleaning grocery shopping running
[88]
errands standing sitting for prolonged
[90]
period of time personal hygiene
[92]
getting dressed just the things you do
[94]
every day now let me give you an example
[98]
somebody's injured at work and they
[100]
injured their back now after treating
[102]
they still have some back pain and that
[105]
back pain still bothers them when they
[107]
put on their shoes when they stand and
[110]
take a shower or they cook or they try
[112]
to carry groceries if they've not had a
[115]
complete recovery and those injuries do
[117]
still affect them in those activities of
[119]
daily living
[119]
then in workers comp they should be
[122]
compensated for that permanent
[124]
disability now it's based on something
[127]
called the AMA guides this is an
[130]
American Medical Association book that
[133]
you clot you the injuries are classified
[135]
based on objective and subjective
[138]
complaints now if it's a psychological
[141]
injury
[141]
based on something called the gaffe
[143]
scale which is based on symptom ology
[146]
all of the permanent disability is based
[148]
on medical evidence now sometimes I
[152]
think I'm smarter than a doctor I'm not
[154]
a doctor so I can argue in front of a
[156]
judge two on blue that I think my client
[158]
is perfectly disabled and has very
[161]
severe permanent disability judge can't
[164]
even award it it's all based on medical
[167]
evidence so I have to have medical
[169]
evidence indicating what if any
[170]
permanent disability my client has and
[173]
once again that permanent disability is
[175]
based on impact on those activities of
[179]
daily living and the classifications
[182]
under the American Medical Association
[184]
guidebooks and in a psychological injury
[188]
it's based on something called a gap
[190]
scale but basically if you've not had a
[192]
complete recovery you have potential
[194]
permanent disability that is how an
[196]
attorney works up your case to provide
[199]
compensation for you now the permanent
[201]
disability is not paid in a lump sum for
[204]
instance if you're a maximum wage earner
[207]
currently and you have one percent
[209]
disability it's approximately around
[211]
seven hundred dollars what that means is
[213]
you're paid approximately seven hundred
[218]
dollars over a period of time and
[220]
currently that's paid at around two
[222]
hundred thirty dollars a week you get
[224]
that until that's all paid out now in
[226]
the for instance a ten percent
[227]
disability case it's approximately seven
[229]
thousand dollars what you still get
[231]
those checks for two thirty a week it's
[234]
just paid in a longer period of time so
[236]
the greater the permanent disability
[238]
you've sustained in a work comp injury
[239]
the greater the amount of compensation
[241]
you're potentially entitled to and once
[244]
again it's generally not paid in a lump
[245]
sum it's paid overtime but as an
[248]
attorney our goal is really a few things
[250]
to do for you get you the best medical
[252]
treatment we can get you and if after
[254]
that treatments been completed and
[256]
you've reached what's called a maximum
[257]
medical improvement state and you had
[260]
you're still having pain and symptoms
[262]
that are affecting you in those
[262]
activities the data living then we do

our job to look at medically what
[267]
classic
[268]
would fall under those AMA guidebooks

and really to try to lock in the
[272]
greatest amount of permit disability to
[274]
get you the greatest amount of
[275]
compensation once again this is just
[277]
gently touching on what permanent
[279]
disability is and how you're able to
[281]
obtain compensation for that any
