pretty House Democrats celebrating
[1]
tonight as a second federal judge gives
[3]
them a win on their efforts to dig into
[5]
not only the president's finances but
[7]
also those of his children grandchildren
[9]
and in-laws as well let's talk about it
[12]
with our legal eagles tonight former
[14]
deputy assistant attorneys general Harry
[16]
Lippmann and Tom Dupree thank you guys
[18]
both for joining us tonight you
[19]
shouldn't make change
[20]
okay so let's talk about this ruling I'm
[22]
Robert Barnes an attorney who's been on
[23]
with us as well says this in a tweet
[25]
another Obama appointee rubber-stamps
[27]
one of the most invasive congressional
[29]
subpoenas in American history privacy
[31]
from spying politicians eyes is dead
[34]
this remains the law he quotes that
[36]
Watkins be us there's no general
[38]
authority to expose the private affairs
[39]
of individuals Harry does this go all
[42]
the way to the Supreme Court and should
[44]
people regardless of either side of the
[46]
aisle that they're on be worried about
[48]
the potential release of any president's
[50]
personal finances not this one Shannon
[54]
this the the the there are other issues
[56]
that may but this is just a standard
[58]
subpoena of the sort that Congress and
[61]
and prosecutors would do any and every
[64]
day for any investigation the argument
[67]
on the other side and it's the same one
[69]
by the way significantly that secretary
[71]
minuchin is saying in taxes there is no
[74]
valid legislative purpose and what both
[77]
judges have said now is the same thing
[79]
they said in favor of Trump on the
[81]
immigration order we don't second-guess
[84]
here of course there could be a valid
[86]
legislative purpose they are possible
[88]
financial conflicts of interest it's
[90]
this is a very straightforward daily
[93]
pedestrian kind of subpoena and I don't
[96]
expect if there it to be overturned on
[99]
appeal okay Tom both of you have served
[102]
within the DOJ I want to read something
[104]
from Democratic congressman ted Lieu
[105]
obviously not a fan of the president he
[108]
says this in a tweet dear at the Justice
[111]
Department bill Barr this judge Ramos
[113]
ruling is the second court loss you had
[115]
this week shows your legal arguments
[117]
suck you want the imperial presidency
[119]
but your actions will result in a
[121]
weakening of the office of the president
[123]
cut your losses
[124]
and stop the cover-ups Tom your response
[127]
shed and I have too many thoughts to fit
[129]
in a 20 second answer but I guess my
[131]
first response is look I mean the fact
[133]
you lose to court cases doesn't say a
[135]
whole lot to me I mean there is a lot of
[137]
litigation going on in a lot of
[139]
different countries a lot of a lot of
[141]
different courtrooms a lot of different
[142]
forums a lot of different issues so the
[144]
fact that they've lost - isn't a big
[146]
deal particularly since we know both of
[147]
these decisions will ultimately get
[149]
appealed to the Court of Appeals I think
[151]
that the administration has set a legal
[152]
strategy of doing everything they can to
[154]
fight these congressional efforts our
[157]
efforts by investigators to get at the
[159]
president's documents to dig into his
[161]
finances I suspect they will meet with
[163]
success in some other courts so the fact
[164]
that they've had two losses out of the
[166]
gate doesn't say a whole lot to me okay
[168]
charlie kirk conservative commentator
[170]
often seen on our air as well tweets
[172]
this the irony of Nancy Pelosi accusing
[175]
Donald Trump of quote the biggest
[176]
cover-up in US history
[177]
all while President Trump is working to
[179]
expose the what really is the biggest
[182]
cover-up in history is truly incredible
[183]
Democrats know they're in trouble okay
[186]
the meeting blew up this morning after
[187]
she accused him of covering up crimes
[189]
Harry
[190]
are Democrats feeling the heat or not I
[193]
don't know I mean it seems to me she was
[195]
sort of goading him and it worked I see
[198]
the irony going both ways here Shannon
[200]
this is the president who has accused
[202]
the FBI leadership within the last week
[204]
of treason a capital offense so you know
[208]
he I think has a much thinner skin than
[212]
then when he's you know actually dishing
[215]
it out but what she's saying is he won't
[217]
let anyone testify that that's his legal
[220]
right to try to do but it's on it hasn't
[222]
happened in other scandals so you know I
[225]
think now it's a sort of political war
[227]
of words yeah I mean Tom but we know the
[229]
legal and the political both continue
[230]
and they're two very different fronts
[232]
some of it is you know in a courtroom
[233]
some of it is the optics in the PR
[235]
battle that happens but the president
[237]
would say he has let people testify for
[239]
a lot of hours and a lot of people and a
[240]
lot of documents but Democrats say not
[242]
enough yeah and I think the president
[245]
has a fair point I mean we all know the
[246]
resources that went into the Moller
[248]
investigation we know that the president
[249]
allowed his officials including Don
[252]
McGann to meet with Muller for extended
[255]
periods of time and so I think from the
[256]
president's perspective was like what
[258]
more is there why are the Democrats so
[260]
insistent on plowing the same ground
[262]
thinking that they the members of the
[264]
House Judiciary Committee and their
[265]
staffers could uncover evidence
[267]
that Bob Muller failed to seems very
[269]
unlikely we all know Muller had a real
[271]
dream team very experienced
[273]
investigators if they didn't find it I'm
[274]
not quite sure why the members of the
[276]
House Judiciary Committee think that
[277]
they'll track it down well as those
[278]
investigations continue we know of at
[280]
least three investigations into the
[281]
investigators that were waiting on as
[283]
well much to chew on so please come back
[285]
gentlemen Harry and Tom thank you thank
[288]
you Tom
