is the form you never want to get it's like聽 getting the pink slip at work or the detention聽聽

notice at school it's a serious document and the聽 reason that you don't want to get it is it means聽聽

that you've failed to perform a responsibility as聽 the fiduciary you failed to perform some required聽聽

timing responsibility with the court and you're聽 going to get into additional problems if you聽聽

fail to cure or correct the particular failure聽 now it can be used in a variety of of contexts聽聽

which we're going to cover in a moment with all聽 of the scale forms they are created by either聽聽

statute or core rule or both and this particular聽 one is created by mcr 5.203 that particular聽聽

court rule provides that the probit court is to聽 notify fiduciaries of when they are deficient聽聽

of a particular responsibility and give them an聽 opportunity to cure or correct that deficiency now聽聽

failing to cure it can mean all sorts of things聽 it could mean you're suspended you're sanctioned聽聽

your surcharge a special fiduciary is appointed聽 all sorts of bad things can occur also one of the聽聽

requirements of the court rule is for the court聽 to not only notify you of the deficiency but also聽聽

to notify sureties uh bonding companies if there聽 are any sureties involved so this particular form聽聽

if you receive it take it seriously and respond聽 to it don't ignore it so let's kind of understand聽聽

how it's used and what it may apply to depending聽 on the various context that you would receive it聽聽

remember this is not a form that you're creating聽 it's a form the court is creating sending you聽聽

notice that you are deficient you've broken your聽 your duties you've breached your duties you've聽聽

failed to do something you're required to do聽 under statute or court rule top left corner will聽聽

identify the court top right corner the county聽 now often this form gets sent out by the court聽聽

and it gets crossed in the mail so you filed your聽 document and the court sends out the notice almost聽聽

at the same time we see this happen a lot or聽 maybe it got filed but the court didn't docket聽聽

it correctly these are computer generated usually聽 by the course so they're fired out by a computer聽聽

algorithm so if the court doesn't recognize聽 that you fulfill the responsibility it gets sent聽聽

so sometimes there are mistakes it happens but聽 don't ignore it if you receive it don't assume聽聽

it's a mistake make sure you've clarified that聽 it is or was sent improperly at the top you'll聽聽

see the court address as well as the estate name聽 and then the recipient of the particular notice聽聽

again pretty intuitive the next part identifies聽 what the deficiency is it says it appears from a聽聽

review of the court file and then there are lots聽 of check boxes so let's cover each one of these聽聽

one at a time the first is when an inventory is聽 filed in a deceased estate the court has to have聽聽

sufficient information to be able to determine聽 the inventory fee that gets assessed to the聽聽

probate estate and must be paid so for example聽 if you file an inventory and it's blank or you聽聽

file no inventory or an inventory that doesn't聽 give sufficient information the court doesn't聽聽

have enough information for it to assess the gross聽 inventory fee second box would just simply be that聽聽

the inventory hasn't been filed and it must聽 be filed pretty straightforward next one is聽聽

you've filed your inventory or presented under聽 the statute your inventory but you failed to pay聽聽

the inventory fee so you're delinquent in the聽 payment not in the filing or the presentation聽聽

of the inventory but rather in the payment聽 money is owed next box relates to guardianships聽聽

of miners and this has to occur on an annual basis聽 on the anniversary of the letters of guardianship聽聽

for a minor that box provides that you have failed聽 to do your annual report pretty straightforward聽聽

checkbox so the court can fill that section in聽 and the provision says that you are now notified聽聽

you have to correct it within 28 days from the聽 date of the notice not the date you received it聽聽

from the date of the notice and you can always ask聽 for an extension the court rule does provide you聽聽

can make a extension request and the court can聽 grant that extension for time in addition the聽聽

court can impose a requirement for you to appear聽 at a conference for an explanation of the status聽聽

of that deficiency so again look at the particular聽 check boxes and any requirements or dates that are聽聽

set forth there if the court is ordering you聽 to appear at a memorandum or status conference聽聽

the next part is simply what i've been saying聽 throughout the presentation of this particular聽聽

scale form do not disregard the notice because聽 the court rules are in place to keep you in power聽聽

keep you in authority and to ensure that you're聽 fulfilling your responsibilities your fiduciary聽聽

responsibilities in that fiduciary role failure聽 to do so can cause all sorts of problems for you聽聽

so if for for some reason you can't fulfill the聽 responsibility because of health or otherwise聽聽
[375]
advise the court let the court know don't just聽 ignore it that will get you into all sorts of聽聽

problems then there's a date provision there and聽 that date provision is set forth by the register聽聽

or the court clerk and the reason that date is聽 really important is it's the 28 day time frame聽聽

from that date that triggers the appointment of a聽 special fiduciary the suspensions or whatever may聽聽

occur thereafter so it's 21 28 days from that date聽 that's uh indicated there in addition the court is聽聽
[406]
advising that if there are special disabilities聽 or foreign language issues or otherwise聽聽
[413]
let the court become aware of it so the court can聽 provide suitable accommodations for that issue聽聽

again most importantly make sure that you don't聽 disregard a notice of deficiency because that聽聽
[425]
notice of a deficiency is step one to greater聽 problems that will come on down the road聽聽

now with this this is a good time to just suggest聽 that whenever you're administering a guardianship聽聽
[438]
conservatorship to cease to state we strongly聽 urge you to work with a skilled competent聽聽

probate lawyer because these types of noticing聽 and dates should be well understood by the the聽聽

probate lawyer they may not be so intuitive to聽 you even though when you become the guardian the聽聽

conservator the personal representative all of聽 those dates are set forth on that initial notice聽聽

that the court gives you so you have to calendar聽 those dates and pay particular attention聽聽
