so the reason we're going to discuss

this today is because i recently had a

conversation with someone who wanted to
[35]
know whether or not

she could find out if one of her
[38]
grandparents had an estate plan
[41]
and i think it's important information
[43]
that everyone should know
[45]
so let's just jump right in

if we're talking about
[50]
estate planning typically i mean
[53]
lots of different documents but for this
[54]
video you can find out if someone had a
[57]
will
[60]
by looking at
[62]
the probate court's website if your
[64]
court is up to date or you have to go
[67]
down to the probate court
[68]
and figure that out yourself through
[70]
their documents

and i'm also talking about trust in a
[74]
little bit so first

wills

when someone passes away if they had a
[80]
will and their estate was over the
[83]
threshold amount and currently that is
[85]

then the person who

had a copy who has a copy of the will

usually that's the personal
[94]
representative named in the will has to
[96]
file that will with the probate court

the will has to be scrutinized in order

for everything to be

passed

along and and debts to be paid all of

that

that's public probate is public so any
[112]
document scanned in certain things might
[114]
be redacted um you know like
[117]
personal information uh social security
[119]
numbers if there was something like that

which your will should never contain

that anyway um point being wills are
[126]
public so you would go and check the
[128]
probate court where probate would be
[130]
filed for that person so it's the county
[133]
in which they lived in
[136]
and that should be where
[138]
their probate case was filed
[140]
in some cases it could be multiple
[142]
places but for the most part that's a
[144]
good place to start

some courts have documents online and
[147]
you're probably going to have to pay for
[148]
the documents

but you could probably look to see if
[152]
there was at least a probate case open
[153]
without paying
[155]
otherwise you'd need to go to the
[157]
courthouse talk to the clerk talk about
[159]
finding and locating the file and making
[162]
copies of the documents so wills are
[164]
public
[165]
trusts on the other hand are not public
[166]
documents

so the only way that you would find out
[170]
if someone had a trust besides asking
[173]
they their
[175]
immediate family members if you weren't
[176]
one and they can tell you whether or not

they know they do not have to tell you

is if you were a beneficiary of the

trust you will receive notice when that
[186]
person's trust becomes

effective and your
[192]
your rights are

then vested so

unless you were contacted by

the trustee

then you're not going to be able to find

out

unless you think that there was a trust

that no one knew about or someone passed

away so here's what i would do

if i thought that my parent had a trust
[215]
and i was a beneficiary to the trust but

i didn't have a copy of it and i didn't
[219]
know of anybody who had a copy of it i
[221]
would try and contact their attorney
[224]
if you knew that information and their
[226]
attorney may be able to tell you
[228]
who the trustee is
[230]
um and if not they might be able to give
[233]
you a little bit of information about
[234]
how to
[236]
get a trustee appointed
[239]
but at that point the attorney isn't
[241]
your attorney so they don't really have
[243]
to do anything for you in fact they
[245]
still have to protect the rights of
[246]
their client regardless of whether their
[247]
client is alive or
[249]
not um so really there isn't a an easy

place to check for a trust sometimes

when people create trust if they don't
[257]
have successor trustees listed who have
[260]
copies

nobody knows and nothing happens with
[264]
their property after they've passed away
[266]

recommend that if you're creating a

trust that you give a copy to your
[278]
personal representative and you alert
[279]
your beneficiaries letting them know

that you have a trust and who has a copy

of it you do not have to give them a
[284]
copy right away

or at all during your lifetime if you do
[288]
not want to unless they are a trustee
[291]
