Hi there. I'm Paulette Balin and I'm a principal聽
here at Balin Law I am happy to share with you聽聽
[8]
the fact that Social Security has just increased聽
the SGA level for 2020 to $1,260 [$1,350 for 2022, $1,310 in 2021] dollars it had聽聽
[18]
been $1,220 dollars [in 2019] and now we have an聽
increase of 40 dollars and what does that mean聽聽
[24]
that means that if you make less than one thousand聽
two hundred and sixty dollars you can pursue your聽聽
[31]
Social Security disability claim if you gross聽
that much or more you don't even pass go in the聽聽
[40]
Social Security world because Social Security聽
will not process your application they will say聽聽
[46]
you are above SGA and you do not have a viable聽
disability claim so how do we work with that聽聽
[54]
$1,260 dollars [$1,310 in 2022] let's say you make three thousand聽dollars a month that's gross now we can subtract聽聽
[64]
from that impairment related work expenses we can聽
income average if it's over a 12-month period and聽聽
[74]
you've got some months that your income is higher聽
in some months lower we can excuse some earnings聽聽
[82]
as subsidized work activity let's say you're聽
working for a relative or a friend and you're聽聽
[88]
being paid at a much higher amount than the true聽
value of your services there are some things that聽聽
[97]
we can do to correct the gross amount to come up聽
under that threshold amount of 聽
[107]
$1,260 dollars [$1,310 in 2022] and when we do that聽
then your disability case is in full play.
[115]
The other number that came out is the new amount for聽
a trial work period. So if you're off work for 12聽聽
[121]
months or have otherwise excused the work activity聽
to less than SGA, you can make $910 [$970 in 2022, $940 in 2021] dollars a month聽聽
[131]
or more and have it be considered what's called a聽
trial work period and you're allowed to have nine聽聽
[138]
trial work periods in a five-year rolling period聽
and the reason that the trial work period is聽聽
[146]
important is frequently it can take two to three聽
years if you've got to go through a full hearing聽聽
[153]
before a judge to have your disability claim heard聽
and as long as you've been off work for at least聽聽
[160]
twelve months from the time you've filed your聽
application or have had it otherwise excused as聽聽
[167]
an unsuccessful work attempt for example then you聽
can give your hand a go at a trial work period and聽聽
[174]
it won't come back to penalize you. I do want to聽
also share with you that the new SSI amount has聽聽
[183]
come out and that is $783 [$841 in 2022, $794 in 2021] dollars a month you聽can make an SSI if your income is low enough聽聽
[191]
and if you have no countable resources you can聽
have a stream of income of SSI which stands for聽聽
[198]
Supplemental Security income and that is very聽
powerful for many people. But again, you have聽聽
[208]
to have low enough countable resources and low聽
enough income and in terms of countable resources聽聽
[215]
a single person still can only have $2,000 and a married couple can only have $3,000.
[221]
But again, that's a countable聽resource and your home doesn't count against you聽聽
[227]
and one vehicle doesn't count against you. So it's聽
really, it can get very complicated. So I invite you聽聽
