In this video, I'd like to discuss with聽you the impact of divorce on your green card.聽聽

to keep your lawful status and continue聽your life here in the United States.

In this video, I will delve into what聽
happens if you are going through a divorce
[28]
or if you already divorced. How that impacts聽your green card. We know that can be
[33]
very scary and it's a question we receive聽
a lot. So we want to make sure you have
[39]
accurate information about what happens in the聽next steps. Before, I dive into all of that
[44]
information, I'd like to introduce myself and our聽firm. I'm Attorney Megan Pastrana from

Let's talk about what happens in the event聽
of a divorce. What happens to your green card?

We know that you've worked聽very hard to get your green card and that it can
[96]
be really scary if that happens. If you are聽going through a divorce or if you get divorced.
[102]
What will happen to your green card?
[107]
First off, we know relationships are hard and it's聽extremely difficult to go through a divorce.
[115]
Having that cloud of what's going to happen聽with your immigration status over your head聽聽
[121]
is really scary and so we want to make sure聽you have information about what that means.
[126]
To give you a little background, for individuals who have something
[131]
called a two-year conditional green card, those聽individuals have to file another application
[139]
90 days before the two-year anniversary聽
of that card. For individuals
[145]
who have married a United States citizen or聽a lawful permanent resident or if you've gone
[151]
through the fianc茅 visa process. If your marriage聽was less than two years old when you received
[157]
your green card, then your green card is a green聽card of two years. It's a conditional green card
[164]
and immigration expects, it's required,聽
that you check in with immigration
[169]
90 days before the two-year expiration聽
or the two-year anniversary of your card
[175]
and you have to file a removal of conditions聽application showing immigration that you and
[180]
your spouse still are in a relationship and still plan to have a future together.
[188]
That removal of conditions application is聽
something that is jointly filed with you and
[193]
your spouse. But if you get a divorce, there is a聽way that you can file that application on your own.
[205]
While typically, the application is filed聽by both spouses, there are some exceptions
[209]
that allow you to file that application on聽
your own, without your spouse.
[215]
Some of those exceptions include: death of your spouse, divorce
[226]
or if there was聽abuse in the relationship or if you would suffer
[230]
extreme hardship. If you were to聽lose your green card, extreme hardship is
[236]
another basis. I just want you to be aware聽
of the other possibilities of being
[242]
able to file the application on your own. But聽this video is going to focus specifically on
[248]
the context of if you're going through a聽
divorce or if you've already divorced.
[254]
If you have a two-year green card and if you are in the聽process of a divorce or if you've already divorced
[261]
and you're close to that two-year mark, you'll聽want to make sure you begin the process
[268]
of collecting information and documents so聽you can file the application on your own
[275]
for removal of conditions. Typically, you聽
have to wait to file your removal of conditions
[282]
in the 90-day window before the聽
two-year anniversary of your green card.
[291]
The rule is if you file the application with your spouse together, a聽joint removal conditions filing, you cannot聽聽
[297]
file it any earlier than 90 days before that聽
two-year anniversary. They have a 90-day window.
[304]
But if you're going through a divorce or if you've already divorced, you actually can聽聽
[310]
file that removal of conditions application on your聽own immediately when the divorce occurs.
[317]
If it happens before that 90-day window, you can still聽file that application for removal of conditions聽聽
[323]
on your own right away. That's one聽of the main things that we definitely want to
[328]
make sure you're aware of. If a divorce occurs or聽if you're going through the process of divorce
[333]
you should actually also begin the process聽for removal of conditions on your green card
[339]
on your own. What does it mean聽to file your removal conditions application on聽聽
[346]
your own? That means that聽you're filing it without your
[351]
spouse. You don't need your spouse to sign聽anything and that your
[358]
spouse doesn't have to participate in the process聽because you're either going through a divorce
[362]
you're separated or you're already divorced.
What immigration wants to see is that聽聽
[369]
you are divorced. So, you would have to submit聽the divorce decree to show that the divorce
[374]
has been finalized. Also, immigration wants聽to see that you entered the relationship in good
[381]
faith. Which means you entered the relationship, you聽entered the marriage because you were in love and聽聽
[387]
you had intended to have a future together but聽unfortunately, the relationship
[392]
ended. To prove that, immigration聽
would want to see relationship evidence聽聽
[398]
of the two of you living together. Leases, maybe聽you have a home you purchased together, joint bills,聽
[406]
photos together. They still want to see聽
relationship evidence from the time that you聽聽
[412]
were together along with the divorce decree and聽you'll also have to provide a statement
[418]
about your relationship and how you entered聽the relationship with the intention of
[425]
having a future together and that you聽
entered the relationship for reasons of love
[429]
and unfortunately, the relationship聽
didn't work out and explain what happened.
[436]
We all聽know relationships are hard and there can be聽
[439]
a lot of difficulties. There might be financial reasons聽
[444]
that it didn't work out. There can be so many reasons why marriages聽聽
[449]
unfortunately end and immigration just wants聽to see in your statement exactly what happened.
[455]
They can see that you had a good faith聽entering the marriage but unfortunately, it ended.
[463]
The last thing that we want you聽to be aware of with removal of conditions is聽聽
[468]
once you submit that application with all聽
of that evidence with your statement with the聽聽
[473]
divorce decree, you'll have an interview with an聽immigration officer and that will be with just you
[480]
and the immigration officer will ask you questions about your relationship, about the evidence that聽聽
[485]
you submitted and about your statement and about聽why the relationship didn't work out. We know
[490]
that this process it can be extremely stressful. But we know you've also worked very hard
[496]
to get your green card and it's very important聽
for you to keep it. So we wanted to make sure聽聽
[501]
you have all of the facts and know that you'll be聽able to go through this process alone. We know so聽聽
[507]
many people panic and think, "I'm going to聽lose my green card because I am going through a
[513]
divorce or I have divorced". That's not true. You get to have this opportunity to keep聽聽
[520]
your green card by filing this application on聽your own.
