who are compensated in that way they

other people who work for the trump

organization who benefited from this

allegedly illegal tax evasion scheme

similarly the indictment says there were
[40]
other trump organization
[42]
executives who worked for the company
[45]
but they were regularly paid in ways
[46]
that were designed to
[49]
disguise their payment from tax
[51]
authorities they were regularly paid in
[53]
ways to make it look like they weren't
[55]
getting compensated
[56]
as trump organization employees they
[58]
were getting paid as
[60]
consultants or something it has
[62]
important tax consequences both for the
[64]
company
[64]
and for the executive getting paid that
[66]
way that's all spelled out in the
[68]
indictment it's spelled out in the
[69]
indictment as a
[70]
further part of the scheme to defraud
[74]
no other executives behind besides alan
[76]
weisselberg is described as the
[78]
beneficiaries of that fraud but it is
[80]
explicitly spelled out
[81]
that he wasn't the only one who
[83]
benefited from that kind of a scheme
[85]
i will also tell you that is exactly the
[88]
kind of scheme
[90]
described by new york times reporters in
[93]
september
[94]
in their pulitzer prize-winning expose
[96]
of trump's financial adventures
[98]
they specifically described a scheme
[100]
like that a scheme like the one outlined
[102]
in today's indictment
[103]
as it related to ivanka trump the
[106]
president's daughter
[107]
the times described in detail financial
[110]
records they discovered that showed
[111]
ivanka trump being paid
[113]
both as an employee of the trump
[114]
organization and as
[116]
a consultant to the trump organization
[118]
in a way that seemed
[119]
custom designed to try to evade taxes
[122]
both for the company
[124]
and for her that is the executive scheme
[128]
described at the end of the indictment
[130]
prosecutors say that weisselberg
[131]
benefited from such a scheme
[133]
and that other executives did too they
[135]
are not named in this indictment
[137]
but that is the ivanka scheme described
[140]
last fall
[140]
in the new york times
[144]
and like i said apparently there's more
[146]
to come from this investigation
[148]
we've got much more on that in a second

one of the things that caught my eye
[151]
is your reporting from last fall
[154]
about a scheme that you'd
[157]
uncovered basically by comparing
[159]
different financial documents
[161]
um which showed that the president's
[162]
daughter ivanka trump was paid as a
[165]
consultant
[166]
in a way that seemed designed to avoid
[168]
paying taxes on some of her
[170]
income a way that would have been
[171]
advantageous both to her and also to the
[173]
trump organization
[174]
i wondered if you saw any reflections of
[177]
that scheme that you described
[178]
particularly in those later parts of the
[180]
indictment where they described ongoing
[183]
schemes involving multiple executives
[186]
around the way their their compensation
[188]
was was described to authorities
[192]
you know it sure did feel of a piece to
[194]
me what we saw
[195]
um when we were doing our work with the
[197]
payments um
[199]
some of which um went to ivanka trump
[201]
you know you're seeing money that's
[202]
coming out and being allocated
[204]
um you know alan weiselberg had some of
[206]
that through through a certain payment
[208]
and with ivanka trump what we saw and
[211]
others are involved
[212]
as well there was 26 million dollars
[214]
that we
[215]
found in consulting fees that were being
[218]
paid from entities that donald trump
[220]
controls
[221]
outward we couldn't see who they were
[224]
who they were going to
[225]
but we saw them going out and it was
[227]
like wow when we saw it we were like
[229]
where were these going
[230]
and then what we found as we went along
[232]
was we were comparing the taxes
[235]
to other documents we had public
[237]
documents and other documents
[239]
we saw some of it actually went to a
[241]
company that is controlled by um
[244]
ivanka trump as an officer up and then
[246]
paid out to ivanka trump
[248]
and why that was a red flag is because
[250]
she's got
[251]
she's an officer of the trump
[253]
organization and has
[255]
she's paid more than two million dollars
[257]
and she's also getting consulting fees
[259]
and that's sort of something that right
[261]
away should be you know the irs would be
[263]
looking at it and saying hey they're
[264]
only supposed to
[265]
these sort of payments should be
[267]
ordinary and necessary
[268]
and the you have to question why
[270]
somebody who's making two million
[271]
dollars at the trump organization
[273]
is also getting consulting fees so
[276]
you're sort of like what's going on
[277]
and what you know we in our reporting
[281]
suspected and we reported about was that
[283]
this was an attempt by donald trump
[284]
to reduce his taxable income and to
[287]
transfer money to his kids
[288]
that may also have had the effect of
[290]
reducing
[291]
um or of him avoiding the gift tax to
[295]
them so it's a way to transfer wealth
[297]
potentially from one generation to
[298]
another
[299]
we didn't have access to other people's
[301]
um
[302]
tax information to see if potentially
[304]
eric trump was getting some of these
[305]
payments
[306]
if donald trump jr was getting some of
[307]
these payments but they are also a
[309]
member
[310]
uh and are part of that company that was
[312]
getting the money that went to ivanka
[315]
and and briefly to that point the kinds
[317]
of documents that would show that if
[319]
that's the case
[320]
is your understanding uh from what we
[322]
can see publicly about this court case
[324]
that those are the kinds of documents
[325]
that the prosecutors have
[327]
i think i can't imagine that they don't
[329]
have them by now and the uh
[331]
the new york attorney general had gone
[333]
after the information from the company
[335]
that received those payments called ttt
[338]
um you know for trump trump trump
[340]
so um they've got those records
[343]
and i don't know how much further
[345]
they've gotten if they've gotten um
[347]
tax returns of other members of the
[348]
trump family but that's a real just
[350]
follow the money case we were like wow
[352]
when we saw it and we you know started
[354]
to work through it we dead ended in the
[355]
tax returns
[356]
but then because ivanka trump had gone
[358]
to the administration she had financial
[360]
filings
[361]
and we were able to uh to match them up
[363]
i gotta i know i have
[364]
worked with two uh two great reporters
[366]
on it russ putner and mike mcintyre and
[368]
it was a great
[368]
great effort um took us a long time to
[371]
put all that together but
[373]
it's there and it's one of the things
[374]
that the manhattan va is looking at
[378]
i mean one of the i think the important
[381]
threads to pull from that pulitzer
[383]
prize-winning reporting at the new york
[384]
times based on trump
[386]
uh financial records um is that
[389]
among others it appears that ivanka
[392]
trump benefited from the type
[394]
of scheme that's described at the end of
[395]
the indictment today
[397]
that trump executives were compensated
[400]
in ways that were deliberately designed
[401]
to help them evade taxes and to help the
[403]
business evade taxes on their behalf
[406]
alan weisselberg is being charged
[408]
for benefiting from that scheme the
[410]
indictment says
[411]
other executives also benefited from
[413]
that scheme and now we've got solid
[415]
reporting that the investigation
[416]
continues
[417]
that raises the prospect that further
[419]
charges could be brought against
[420]
his children yeah it does
[424]
and i again i think they should be quite
[426]
uh
[427]
anxious right now donald on the other
[430]
hand
[430]
will expect the same kind and level of
[433]
loyalty from them
[434]
as he expects from alan um you know as
[437]
far as donald's concerned
[439]
they have what they have because of him
[441]
and they should be willing
[443]
to take whatever hit they're going to
[445]
take
[446]
um he doesn't understand i guess how
[448]
these things work
[450]
prosecutors won't stop at my cousins
[453]
they will be going
[454]
for the bigger fish which would be
[456]
donald who's been running this
[458]
organization
[459]
for over 30 years now so
[462]
i think he would be surprised to learn
[465]
that i don't believe
[466]
my cousins would exert that kind of
[469]
exercise that kind of loyalty towards
[470]
him because
[471]
his relationship with them and their
[473]
relationship with him is entirely
[475]
transactional
[476]
so um unconditional i should say

so they're not going to risk anything
[481]
for him just as he wouldn't risk
[483]
anything for them
[484]
so it could get really really
[486]
interesting as these things unfold

because there are so many more documents
[491]
that
[492]
new york prosecutors have at their
[494]
disposal
[495]
so you have more confidence that alan
[497]
weisselberg would
[499]
wouldn't cooperate than you do that the
[501]
president's
[502]
former president's children wouldn't
[504]
cooperate
[506]
yeah i think um as far as i understand
[509]
it and you know i'm not a lawyer but
[510]
uh it seems that as as serious as these
[514]
charges are they may
[515]
not end up with uh jail time
[519]
or any significant amount of jail time
[522]
and
[522]
the downside of
[526]
um cooperating with prosecutors for
[529]
allen weisselberg might be larger than
[530]
the downside of going to jail
[532]
uh if it's for a short enough period of
[534]
time so

again it's going to be very interesting
[538]
to see just
[539]
um the case that can be made and
[542]
the sentencing if it comes to that
[546]
because i think that will factor in for
[548]
sure but

i'm much less sanguine about
