a very common question that we get

regarding criminal cases is what happens
[3]
if I missed my court date and I have a
[5]
warrant it's a very common thing that
[8]
happens we're all extremely busy
[9]
everybody has a lot going on sometimes
[11]
you'll get a traffic ticket or you'll
[13]
get a court date and you'll just miss it
[15]
you'll just forget about it you're busy
[17]
with your family you're busy with your
[18]
job whatever it is you happen to miss
[21]
your court date now the court has issued
[23]
a warrant for your arrest and they've
[25]
suspended your license so what can you
[27]
do well some people will ask us well
[29]
what if I just continue to ignore it you
[31]
can do that you can continue to ignore
[33]
it

nothing's gonna happen to your case
[35]
there's no expiration date for a warrant
[37]
a warrant just puts the case on hold
[40]
it's saying this case has been charged
[42]
it's going to be pending but there is no
[44]
statute of limitations or anything like
[46]
that on it it's basically saying we're
[48]
gonna put this case on hold until this
[50]
individual makes contact with the court
[52]
or that person is arrested and brought
[54]
in front of the judge so it stops the
[57]
case everything is done sews up we've
[59]
had people come to us with warrants from
[60]
20 years ago the case still exists just
[63]
because it's been 20 years doesn't mean
[65]
that the case gets thrown out now 20
[67]
years later that officer may not be
[69]
around the anybody who was involved in
[72]
the case at all may not be around or
[74]
they may move jobs or retired or passed
[76]
away who knows but it the case is still
[80]
there the court is still going to wait
[81]
for that individual to make contact with
[83]
the court so the case can continue to
[85]
progress the other big issue is that
[87]
when you have a warrant its suspend your
[89]
license and Arizona is a state that
[92]
notifies all of the other states so I
[94]
can't tell you what other states are
[96]
going to do with that but Arizona as
[98]
soon as the Arizona motor vehicle
[100]
department knows that you have a warrant
[101]
the court notifies the MVD as soon as
[104]
the MVD notices that they're gonna send
[106]
that information around to throughout
[108]
the rest of the country so if you're
[110]
driving in Texas or California or some
[112]
of these other states they may or may
[113]
not have an issue with that it depends
[115]
on the charge it depends on specifically
[118]
what they want to do with it but some
[119]
some of them they won't have an issue
[121]
with it and you should be free to drive
[122]
until you have to go to renew your
[124]
license then when you do that then
[126]
they're gonna have an issue they're
[127]
gonna say you have to clear up that
[128]
warrant out of Arizona some other states
[130]
it's immediate we've spoken with people
[133]
from other
[133]
places like Colorado Oregon or Seattle
[135]
or Washington and they're the the
[137]
license suspension is essentially
[139]
immediate it just kind of depends on how
[141]
the MVDs and how the states are
[142]
communicating with one another but
[144]
obviously that's a big problem if you
[146]
miss your court date you want to ignore
[147]
it at some point you're gonna have a
[148]
licensing issue when you're out of state
[151]
there's what's called an interstate
[152]
compact the states communicate with one
[154]
another and so you're not gonna be able
[156]
to just leave Arizona and get around it
[158]
forever the the way that you quash a
[161]
warrant is the way that you deal with
[162]
the warrants by quashing a warrant it's
[164]
called a quash with the queue
[165]
some people say squash which is not
[167]
that's a delicious vegetable but what
[169]
we're talking about here is quashing a
[171]
warrant you want to take that warrant
[173]
and quash it you want to revert the case
[175]
back to it has it as it would have been
[177]
if you had not missed your court date so
[180]
we want to take it back and say this is
[182]
what happened
[183]
we're sorry that the court date was
[185]
missed it was an oversight there was a
[187]
medical or a family emergency something
[190]
happened where that court date was
[192]
missed but now we're reaching back out
[195]
we want to rectify the situation we want
[197]
to reestablish contact with the court
[199]
generally in a criminal case it depends
[203]
on the charge as to whether or not the
[204]
court is going to automatically quash
[206]
that warrant or if they're going to
[207]
require something of you so many judges
[211]
and depending on the length of the time
[212]
make the length of time that the warrant
[214]
has been active some judges may want you
[216]
to come back and personally appear in
[218]
court or they may want you to post a
[221]
bond so they may say okay since you live
[223]
out of state and you have missed your
[224]
court date we want you to post a two
[226]
thousand dollar bond or a five thousand
[228]
dollar bond for a for a smaller
[229]
misdemeanor case if this is a felony in
[232]
order to basically get that warrant
[235]
quashed on a major felony case you're
[236]
gonna have to come back you're gonna
[237]
have to post a bond you're gonna have to
[239]
post a lot of money to secure your
[240]
appearance or if it's a something that's
[242]
that's very basic like you just the the
[245]
summons the notice of your felony case
[247]
was sent to the wrong address you can
[249]
just quash that warrant pretty quickly
[250]
and just reset it for your initial
[252]
appearance this happens all the time
[254]
will they'll mail a summons to
[255]
somebody's wrong address so there's a
[257]
lot of different variables as to how
[258]
judges will treat a warrant case and so
[262]
you should definitely consult with an
[263]
attorney if you decide you have a
[265]
warrant and you want to see what's going
[266]
to happen in it
[267]
but generally it's gonna require one of
[268]
a couple things one you personally
[270]
appear to you post a bond or three you
[273]
have a very good cause or you have an
[275]
attorney to explain that cause on your
[276]
behalf in our experience judges like to
[279]
see that you have a lawyer on it they
[281]
generally know who we are they know that
[283]
we are reputable they know that we're
[284]
local they know that they've dealt with
[285]
us before and so as soon as they see
[287]
that we're representing you they quash
[289]
the warrant they may not even require
[290]
you to post a bond depending on the
[292]
nature of the charge so the solution to
[294]
having a warrant you need to file a
[297]
motion to quash the warrant if they're
[299]
suspending your license which they will
[301]
be you want to ask them to lift the
[302]
suspension on your license as well
[303]
called a motion to quash quash with the
[306]
cue not squash with an S quash the
[309]
warrant and ask the judge to revert the
[311]
case back to as it would have been had
[314]
you not missed that court date so ask
[316]
asking to reset an arraignment for you
[318]
or vacate the arraignment and schedule
[320]
it for a pretrial conference the next
[322]
court date or status conference in a
[324]
felony case it really depends on what is
[327]
the the charge that you've been charged
[330]
with and and what you want to ask the
[331]
judge to do but you have to quash the
[333]
warrant in order for the case to be
[334]
reopened so I hope you found that

from the time that you bring us on board

to help we can generally have a warrant

a motion to quash filed that same day

but sometimes it is it can take ten days
[354]
for the government to respond to that
[356]
motion sometimes it takes a while
[357]
depending on the judge to actually quash
[360]
the warrant and read it some small
[361]
jurisdictions move slowly and it just
[365]
sits on the judge's desk for a little
[366]
bit that's about as good as we can do we
[368]
can expedite the motion we've got a lot
[370]
of good contacts with judicial
[372]
assistance and bailiffs and other people
[374]
who work in the courts to say hey we
[376]
need you to nudge that Judge a little
[377]
bit and get them to make a ruling on our
[379]
motion to quash because this person's
[381]
coming back into the country and they
[382]
can't get in or this person needs to
[384]
drive to work and they got to get this
[385]
warrant quash so they can get their
[386]
license back there's ways that we get it
[388]
done quickly but if you have a question
