Welcome to the Workers' Compensation Division聽 training about the designation and responsibility
[7]
of a paying agent. During this training we're聽 going to talk about how the Workers Compensation
[12]
Division designates a paying agent and what聽 the designated agent's responsibilities are.
[17]
We will also talk about how to request聽 a designation from the director.
[21]
This training will take about 15 minutes. This聽 is a great training for insurance companies
[26]
and their claims adjusters聽 who process claims in Oregon.

When two or more employers or their聽 insurers find that there is an
[36]
issue about which employer or insurer聽 is responsible for a compensable claim,
[41]
the parties must request a temporary designation聽 of paying agent as required under Oregon Revised
[46]
Statute, chapter 656, section 307. The temporary聽 designation expedites benefits to injured
[54]
workers while waiting for a hearing聽 with the Workers' Compensation Board.
[58]
This designation is necessary only for compensable聽 claims with issues about responsibility.
[65]
The Workers' Compensation Division's Benefit聽 Consultation Unit (or BCU) will process the request
[71]
and issue an order designating a temporary paying聽 agent. The temporary paying agent is responsible
[76]
for processing the claim and paying for benefits聽 until relieved by an administrative law judge.

The BCU makes its decision based聽 on Oregon Administrative Rule,
[86]
chapter 436, division 60, rule 180. Typically, the聽 designated paying agent is the insurer with the
[94]
lowest cost of disability or the earliest聽 claim filed for the compensable condition.
[102]
The designated insurer must process the claim聽 through claim closure as if it's an accepted claim.
[108]
The temporary designation can be lifted by an聽 administrative law judge through hearing, mediation,
[114]
or settlement. When an employer and its insurer聽 request that the director designate a paying agent,
[120]
it is not an admission that the insurer聽 is responsible for the compensable injury;
[125]
it is solely an assertion that the injury is聽 compensable against a subject Oregon employer.
[132]
Any time an insurer decides that a claim is聽 compensable but is the responsibility of
[136]
another subject Oregon employer, the insurer must聽 request a designation of paying agent from the
[142]
Workers' Compensation Division. An insurer's聽 legal representative can make the request
[147]
on its behalf. WCD often receives requests for聽 designation from the injured worker's attorney.
[154]
When these requests come in, we will notify the聽 affected insurers of the request and inform them
[160]
of their next steps to request designation so聽 WCD can determine the temporary paying agent.

The affected insurers should work together to聽 try to determine which party is responsible.
[171]
Working among themselves gives the insurers聽 an opportunity to decide which is responsible
[176]
without involving WCD or the director. When a聽 responsibility issue is discovered, whether it's
[183]
from the director's notice, notice from another聽 insurer, or from an internal responsibility denial,
[189]
the first step is to notify all other聽 affected insurers of the responsibility issue.
[195]
It's important that once each party is notified,聽 the affected insurers expedite processing
[200]
by immediately investigating the claim聽 to decide if the claim is compensable
[205]
and determine their responsibility. Once it's聽 decided that the responsibility for an otherwise
[211]
compensable injury cannot be determined, the聽 affected insurers should request a designation
[216]
of paying agent from the director. We will come聽 back to how to make that request in a few moments.
[224]
Now we'll discuss some examples to help聽 better understand the four situations
[228]
in which the paying agent may be unknown and a聽 designation should be requested from the director.
[234]
There are four responsibility issues that will聽 result in the director ordering a temporary
[239]
paying agent. These include: determining the true聽 employer, considering which insurer is responsible,
[247]
figuring out which of a series of employers is聽 responsible, and deciding who should pay in case
[254]
of joint employment. The first situation is an聽 issue about which employer is the true employer
[260]
of an injured worker. In this example, John is聽 injured while employed by a construction company
[265]
that is working on a sportswear manufacturer's聽 campus. The construction company and sportswear
[271]
manufacturer each disagree on who the聽 true employer is for the injured worker.
[276]
Each believe the other is responsible. Because聽 there is a disagreement on which employer is
[282]
the true employer for the worker, the insurers聽 should request a designation of paying agent.
[288]
In this example, the employer has聽 had multiple insurers over the years.
[293]
Which insurer is responsible for the compensation?聽 Joe has worked at Bravo Saw Mill for 30 years.
[300]
He recently filed a claim for hearing聽 loss, which is an occupational disease.
[304]
In the course of those 30 years, Bravo Saw Mill has聽 had three insurers. Insurer A covered them for the first 10
[311]
years. Insurer B covered them for the next eight聽 years. They're currently covered by insurer C.
[317]
In this instance, there's no question that聽 the occupational disease is related to work.
[322]
However, each insurer believes the claim is not聽 its responsibility. Because the insurers couldn't
[328]
agree among themselves, they should request聽 a designation of paying agent from the BCU.
[334]
For the third responsibility issue, let's talk聽 about Becky. She has worked in accounting for
[339]
16 years, and is suffering from carpal tunnel聽 syndrome due to keyboarding. Becky has worked
[344]
for three different employers over the 16 years聽 she's been typing. Each job may have contributed to
[350]
the occupational disease, but the insurers are not聽 able to determine which employer is responsible.
[357]
This is an example of a claim in which聽 two or more employers or their insurers
[362]
could not make the determination a responsibility.聽 In this instance, all affected insurers should
[368]
request designation from the director. The聽 fourth responsibility issue is determining
[374]
which of two or more employers is responsible聽 when there is joint employment. Business owner
[380]
Will gets all of his employees through a聽 worker leasing company. The contract states
[384]
that the worker leasing company will provide聽 workers' compensation insurance for their workers.
[390]
Will hires an employee named Tim, but not through聽 the worker leasing company. Tim gets injured and
[396]
the worker leasing company denies responsibility.聽 The worker leasing company says that the business
[401]
owner, Will, is responsible for the claim since聽 the new employee was not hired through them.
[406]
Will disagrees and thinks the worker聽 leasing company should be responsible
[410]
since it's responsible for the rest of聽 his staff. This is a complicated situation,
[415]
and because an agreement could not be made between聽 Will and the worker leasing company's insurer,
[421]
a request for designation of paying agents聽 should be sent to WCD. Now that we understand
[427]
some of the scenarios that would prompt an聽 insurer to make a request for designation,
[432]
we can talk more about the request requirements.聽 When an insurer is requesting designation from WCD,
[439]
the insurer must send the request in writing聽 to the division, the worker, and the worker's
[444]
attorney, if they have one. The written request聽 must list all of the compensable conditions,
[449]
and state that the claim is otherwise compensable聽 and that responsibility is the only issue. The
[455]
request should also list all of the claims for the聽 worker related to the dispute: including employer
[460]
and insurer information, the date of injury,聽 and claim number. Finally the request should
[466]
confirm that relevant medical documents have been聽 sent to the other insurance companies involved
[471]
and that the worker is aware of the designation聽 request. Oregon Administrative Rule, chapter 436,
[478]
division 60, rule 180, section 6 describes what聽 is required in a request for designation of a
[485]
paying agent. If any information is missing it聽 can slow down the designation process for BCU.
[494]
The director won't designate if compensability has聽 not been determined on any of the involved claims.
[500]
For example, if one of the involved insurers or聽 employers state that the claim is not compensable
[506]
or issue a compensability denial, the聽 director cannot designate a paying agent.
[512]
If an involved insurer opposes designation聽 because it has not received a claim,
[517]
the director won't be able聽 to designate a paying agent.
[521]
As an example, insurer A requests a designation聽 of a paying agent from WCD and copies the other
[527]
insurers involved (insurer B and insurer C.)聽 Insurer C has not yet received a claim from the
[533]
worker, so it cannot determine responsibility聽 or compensability. Insurer C can respond to
[539]
WCD,copying all other parties, stating that it聽 opposes the designation. Because insurer C has
[547]
not received a claim or determined responsibility聽 and compensability, the director won't designate.
[554]
If the 60-day appeal period of a responsibility聽 denial expired and no request for hearing has
[560]
been received by the board OR no request for聽 designation has been received by the director,
[565]
the director cannot designate a paying agent. For聽 example, Lisa received a responsibility denial, and
[572]
has only 60 days from the date of the denial to聽 appeal it with the Workers' Compensation Board.
[577]
It has been 65 days and the Workers' Compensation聽 Board has not received an appeal. Her appeal time
[583]
frame has expired, which means the denial is final聽 and the director cannot designate a paying agent.
[590]
Earlier in the training we mentioned that WCD regularly gets requests for designation from the
[596]
worker's attorney. When WCD receives requests from聽 the worker or the worker's attorney instead of the
[602]
insurer, the director will send a letter to all of聽 the affected insurers. Once the insurer receives
[608]
the notice, it must immediately process the request聽 to determine compensability and responsibility,
[614]
and request designation of paying agent only if聽 the insurers cannot determine responsibility on
[620]
its own. Oregon Administrative Rule, chapter聽 436, division 60, rule 180, section 6 requires
[628]
the insurer to make the request for designation聽 of a temporary paying agent. Once WCD receives a
[636]
request for a temporary designation of a paying聽 agent, the director will immediately investigate
[641]
the request and determine if the designation聽 is appropriate. The director may then send a
[646]
letter demanding the affected insurers respond聽 within 21 days with more information if WCD needs
[652]
clarification on the intent of the denials or聽 wage information to help identify the lowest costs.
[659]
A response to this request for information is聽 required under Oregon Administrative Rule, chapter
[664]
436 division 60 rule 200. Failure to reply within聽 21 days with all required information may result
[673]
in sanctions or civil penalties. When designating聽 the paying agent, the director will first determine
[679]
which insurer has the lowest compensation聽 for the temporary total disability rate.
[685]
If the rates of temporary total disability are the聽 same, the director will then look next at the rate
[690]
of permanent disability. For occupational disease聽 claims, the rates of temporary total disability
[697]
and permanent disability should all be equal. When聽 rates of disability are equal, the director will
[703]
designate the insurer with the earliest claim聽 as the temporary paying agent. Remember, this is
[709]
a temporary designation. The goal of this process聽 is to expedite benefits to the injured worker
[715]
while waiting for the determination of聽 responsibility of the compensable injury.
[722]
The designated insurer must process聽 the claim through claim closure
[726]
or until relieved by an administrative law聽 judge, mediation, or arbitration. This means
[732]
the designated insurer must take all of the聽 same steps that it would for an accepted claim,
[737]
including issuing a notice of聽 acceptance and form 1502 to the director.
[744]
If, after designation, any of the insurer's聽 determined compensability may be an issue
[750]
at hearing, or if there's a change in acceptance聽 of a claim, the insurer must notify the director.
[757]
When the director receives聽 notification, BCU will order
[761]
termination of any further benefits due from聽 the original order designating a paying agent.
[766]
Once a designation has been made or terminated,聽 BCU is no longer part of the process.
[773]
All parties will wait for the Workers' Compensation Board to make a determination.
