about COVID-19 and its impact on the property聽 and casualty insurance business with Ken. But聽聽

before we get started, Ken, why don't you tell us聽 a little bit about yourself and about Dash & Love.

Thank you. Dash & Love was聽 founded in 1930 by my grandfather.聽聽
[43]
We are a fourth-generation family business聽 that recently merged with a national insurance聽聽
[48]
brokerage firm by the name of Risk Strategies.聽 We are the 11th largest insurance brokerage聽聽
[54]
firm in the country with about 100 offices聽 throughout the nation and now in Canada.

All right, the first question we're going to have聽 is the stories you're hearing in the press about聽聽
[71]
business interruption insurance and how聽 many employers have been denied coverage聽聽
[79]
for business interruption as we result of COVID.聽聽
[82]
What do you advise your clients聽 to do that have these policies?
[87]
We are advising our clients to file claims聽 in the event that there is legislation聽聽
[93]
that is passed that will force insurance companies聽 to actually pay their business interruption claims聽聽
[99]
and/or if they do not have a virus聽 exclusion in their policy, potentially hire聽聽
[106]
coverage counsel to file claims on their聽 behalf to force the insurance companies to pay.

Ultimately, at the end of the day, if you've聽 got your claim filed and you're in line,聽聽
[117]
it doesn't guarantee that you're going to get聽 paid on your claim, but at least if there is聽聽
[121]
legislation or there is a court case that is聽 favorable in another jurisdiction, you very well聽聽
[128]
may be the recipient of that. And by having filed聽 your claim, you will not then get into a herd聽聽
[135]
of everyone else who's now going to聽 be scrambling to file their claims.

Oh, okay. Well, thank you. Also, many聽 employers are facing cash flow issues聽聽
[144]
as a result of the decreased business聽 activity as a result of COVID.聽聽
[149]
You had mentioned there's possible strategies聽 from a property and casualty perspective聽聽
[153]
that could be used to improve cash flow for聽 employers. Can you expand on some of those?
[158]
Sure. So Mark, what we've been advising聽 our clients is very simple. We have to聽聽
[163]
look at every single insurance policy聽 that they have and how the exposures聽聽
[168]
generate premium on those policies. So you may聽 be aware of workers' compensation or general聽聽
[172]
liability insurance and the likes. Well, those聽 policies are based on gross revenue in many cases聽聽
[178]
or estimated payroll. So if you furloughed聽 employees or your revenue is down because聽聽
[183]
you've been affected by the pandemic,聽 what we've been advising is to midterm聽聽
[188]
adjust your policies, advise your insurance broker聽 of what revenue reduction you've experienced,聽聽
[195]
what payroll reduction you've experienced,聽 then have a midterm endorsement issued聽聽
[200]
so you're not paying money out of pocket聽 for an exposure that you just don't have.

Okay, interesting. Yeah, that's good聽 advice. And our final question today is聽聽
[209]
what changes do you see in the聽 property and casualty business,聽聽
[213]
especially in ensuring provisions聽 and so on as a result of COVID-19?
[218]
Well, it's already changed. So unfortunately,聽 as people understand insurance companies,聽聽
[227]
they would prefer not to pay聽 losses and be as profitable聽聽
[230]
as possible. And given all the聽 litigation and lawsuits in COVID,聽聽
[236]
what we have seen is on just about every renewal聽 insurance carriers adding a communicable disease聽聽
[242]
exclusion under the liability portion of the聽 policy. So let's say you're a restaurant or聽聽
[247]
let's say you're a condominium association or聽 apartment building owner and you get sued by聽聽
[255]
someone saying that they contracted COVID eating聽 in your restaurant or living in your apartment聽聽
[260]
building. In the past, the insurance carriers聽 would not have an exclusion and would defend.聽聽
[266]
Now, because there's no safe haven or safe harbor聽 act or immunity by the government, the insurance聽聽
[272]
carriers are being forced to add these exclusions聽 on the liability side of the policy, which can聽聽
[279]
make it a huge challenge for a business who's聽 just trying to reopen and do the right thing.
