Hello my name is Michelle Bolitho and聽 I'm a project manager working as part of聽聽

the team implementing the new work health聽 and safety laws here in Western Australia.

Getting to this point has been a very long road聽 going back to 2008, when the various Australian聽聽
[15]
states agreed to have harmonised work health聽 and safety legislation across the country. WA can聽聽
[21]
now see the light at the end of the tunnel. This聽 presentation will provide a high level overview聽聽
[27]
of the implementation process that the Department聽 of Mines, Industry Regulation and Safety has put in聽聽
[32]
place to ensure duty holders can prepare and are聽 well supported as the new work health and safety聽聽
[38]
regime comes into effect in Western Australia.聽 After its approval by the WA Parliament, the聽聽
[44]
work health and safety act was assented to by the聽 Governor in November last year. The new laws are聽聽
[50]
focused on improving the safety of all workplaces聽 in WA and to drive down the number of incidents聽聽
[55]
and fatalities. While the national harmonised or聽 model work health and safety laws were adopted聽聽
[62]
they include a number of amendments to suit the聽 particular work environment in Western Australia.聽聽
[67]
The new work health and safety laws will聽 ensure that more clarity is provided for modern聽聽
[71]
employment relationships such as subcontractors聽 and casual employees, alongside the more聽聽
[77]
traditional employer employee relationship. The聽 new laws also introduce a number of new aspects,聽聽
[84]
including the term person conducting a business聽 undertaking, or PCBU, the offence of industrial聽聽
[91]
manslaughter, the banning of insurance cover for聽 work health and safety penalties and enforceable聽聽
[97]
undertakings as an alternative form penalty. All聽 of these new concepts are covered in a lot of聽聽
[103]
detail in the support process and materials the聽 department will be running over coming months.聽

The new Act is not industry specific but, after an extensive consultation process,聽聽
[115]
it was decided that the Act will be supported聽 by three separate sets of industry regulations,聽聽
[121]
which I will discuss shortly. It's important聽 to note that while the Act has passed, it聽
[127]
has not yet come into full effect due to the聽 supporting regulations having to be developed聽.

The full suite of WHS laws will come into effect聽 in January 2022. As I mentioned above, three聽聽
[140]
separate sets of regulations have been written to聽 support the WHS Act. The regulations set out the聽聽
[146]
procedural and administrative requirements to give聽 effect to the act, for example in the licensing of聽聽
[152]
specific activities and record-keeping obligations.聽 The regulations cover general workplaces,聽聽
[159]
mining operations, and petroleum and geothermal聽 energy operations or as it's commonly called PAGEO.聽聽

There are some areas of difference for mining聽 operations, mainly in the areas of approvals,聽聽
[172]
notifications and statutory positions, and the risk聽 management approach in the mine safety management聽聽
[178]
system has been retained. The safety case approach聽 has also been retained in the PAGEO sector.聽聽

The Work Health and Safety regulations will become聽 operational as soon as possible, in order to meet聽聽
[190]
the Government's commitment for the Work Health聽 and Safety laws to be in effect in January 2022.聽聽

A comprehensive education and information strategy聽 has been developed given that this is the detail聽聽
[201]
that duty holders need to understand to ensure聽 they are fully informed of their obligations聽聽
[206]
and responsibilities. It's important to note聽 also that transitional arrangements are being聽聽
[212]
put into place to provide sufficient time for聽 duty holders to adapt their safe systems of work聽聽
[217]
to meet the new requirements. As previously聽 mentioned, DMIRS has implemented a comprehensive聽聽
[222]
implementation strategy both internally, as聽 this is new territory for our own people,聽聽
[227]
and externally for all workplaces in the聽 state. Support and information in multiple聽聽
[232]
formats is available, and this material is聽 also being provided in different languages聽聽
[237]
and in a culturally sensitive manner across聽 WA, including in regional and remote areas.聽聽

The strategy is focused across the areas of聽 stakeholder liaison, people, information systems聽聽
[251]
and business controls and I'll briefly touch on聽 each of these. In terms of stakeholder liaison,聽聽
[257]
DMIRS has been working closely with a number聽 of bodies to ensure they have the information聽聽
[261]
and support they require to support and educate聽 their constituents and to support workplaces聽聽
[267]
through the necessary changes they may need聽 to make in how they conduct their business.聽聽

The current tripartite bodies for workplace safety,聽 namely the Commission for Occupational Safety and聽聽
[277]
Health and the Mining Industry Advisory Committee,聽 have been re-established under the new laws聽聽
[283]
as the Work Health and Safety Commission and聽 the Mining and Petroleum Advisory Committee.聽聽

The WA Government has also committed significant聽 grant funding to peak employer and employee聽聽
[294]
bodies to provide education and to assist聽 with the transition to the new laws. There's聽聽
[300]
been comprehensive training, staff consultation聽 and ongoing communications - our inspectors have聽聽
[306]
to be properly informed and resourced to聽 implement and action the new requirements.聽聽

A large amount of work is being done to ensure the聽 online business systems are configured to support聽聽
[315]
the new Work Health and Safety laws. This includes聽 IT system upgrades to SRS and WISE to support new聽聽
[322]
compliance and enforcement processes. New policies聽 and communication strategies have also been聽聽
[329]
developed to ensure any new or additional聽 vocational or other training requirements聽聽
[334]
for licenses under the new WHS laws are in place,聽 as well as other areas such as notifications,聽聽
[340]
obtaining approvals, registration of聽 plant and any reporting obligations聽聽
[345]
are facilitated by the technology. In terms of聽 business controls, the need to ensure consistent聽聽
[351]
and transparent policies, processes and procedures聽 to support the implementation of the new WHS laws聽聽
[358]
was recognised in the government structure聽 set up to manage this large project.聽聽

A very senior level steering and governance聽 committee, chaired by the WorkSafe WA Commissioner,聽聽
[369]
has overseen the implementation of the new laws聽聽
[372]
and supported by six working groups has ensured聽 a comprehensive and coordinated approach.聽聽

Processes and protocols to facilitate approvals聽 and reporting, as well as data transparency and聽聽
[385]
the capacity to audit what actions have聽 occurred, have also been implemented. So聽聽
[391]
to sum up, ensuring that external stakeholders聽 and duty holders aware of their obligations in聽聽
[396]
the new regulatory environment, and that they have聽 access to information and guidance to support them聽聽
[402]
to make informed decisions, has been a fundamental聽 principle throughout the process of implementing聽聽
[407]
the new WHS regime in Western Australia. Remember,聽 there is still time until the laws, including the聽聽
[414]
three different sets of regulations, come into聽 full effect in January 2022 and there is plenty聽聽
[420]
of support and information available. A number聽 of transitional arrangements have also been聽聽
[426]
put into place, so duty holders do have time to聽 ensure they are compliant with their obligations.
