I'm going to be talking about the second draw聽 PPP loans since the application was released,聽聽
[29]
was it earlier last week, or I'm sorry, later聽 last week. And I'm just going to go through some聽聽
[34]
specifics that might help clear up some things聽 about this second draw loan alright. So, let's聽聽
[39]
start with some of the basic things here. So what聽 can be calculated as "payroll costs" or how is聽聽
[45]
payroll cost calculated? So basically you can use聽 average monthly payroll from either 2019 or 2020聽聽
[53]
in order to figure out how much of a loan you can聽 get. So, you know, if you're familiar with the聽聽
[57]
PPP, you would just take your average payroll for聽 the year, you would exclude any employees that had聽聽
[63]
payroll greater than $100,000. So you would just聽 exclude the portion over $100,000 so, payroll up聽聽
[69]
to a $100,000 per employee, you're good there.聽 And that includes you as the owner okay. So,聽聽
[75]
you take that number, you divide it by 12 which聽 is your, which gives you your average monthly聽聽
[80]
payroll costs, then you multiply that number by聽 2.5 and that should give you your loan amount.聽聽

Now if, the new thing here in PPP second聽 draw is if you are a restaurant or hotel聽聽
[92]
or you know, how they classify that is if your聽 NAICS code is 72, then you actually will get聽聽
[100]
3.5 times your average monthly payroll costs. So聽 you get a larger loan there. So, the first draw聽聽
[106]
PPP used your 2019 figures. If you are applying聽 now for the PPP, you can use either 2020 or聽聽
[113]
2019 figures. And if you are applying for the聽 second draw PPP, if you continue to use your 2019聽聽
[119]
numbers, your lender likely won't request anymore聽 documentation okay. So it just simplifies things a聽聽
[124]
little bit. If you are self-employed, independent聽 contractor, or what have you and you file your聽聽
[130]
taxes on a Schedule C, then you are still using聽 Line 31 of your Schedule C for either 2019 or 2020聽聽
[136]
to figure out your average monthly payroll costs.聽 And of course, if you have employees as well, you聽聽
[142]
would include the total costs of eligible聽 payroll for those employees. And lastly,聽聽
[148]
if you are an owner of a partnership then how you聽 calculate the eligible payroll costs is looking at聽聽
[155]
all the owner's K1s and looking for net earnings聽 from self-employment, that line the net earnings聽聽
[162]
from self-employment and you would use that聽 number to calculate how much of an average monthly聽聽
[168]
payroll cost your company has. So, if you don't聽 have 12 months of payroll, you would basically use聽聽
[176]
the number of months that you ran payroll okay.聽 So, let's say you ran payroll for either just聽聽
[182]
maybe November and December of 2020. Then聽 you wouldn't take that number divided by 12,聽聽
[187]
you would take that number divided by 2 since聽 you ran it for 2 months. So, if you're new, if聽聽
[192]
your business has been in existence since at least聽 February 15th 2020, and you at least ran payroll聽聽
[199]
in any number of months, you will still qualify聽 for the PPP. Okay so, since the application was聽聽
[205]
released, there was something I noticed is that聽 if you wanted to apply for the PPP second draw,聽聽
[210]
you must have already applied and received the聽 PPP first draw earlier in 2020. Now if you did聽聽
[218]
not do that, if you for some reason missed the聽 boat or decided not to apply for PPP first draw,聽聽
[223]
you can still apply for PPP first draw during聽 this time. Second draw is available for folks who聽聽
[229]
applied for first draw and used it up, maybe聽 even got it forgiven already, so now you want聽聽
[235]
to apply for the second draw. If you missed the聽 boat on first draw or if you applied right at the聽聽
[240]
end of the first draw and then your application聽 was never processed, now you can apply for PPP聽聽
[245]
first draw. And the rules for PPP first draw聽 apply because rules for the second draw are a聽聽
[251]
little bit different. So, you're applying for the聽 first draw, the first draw rules apply. And I have聽聽
[255]
videos on that in the past, just browse through聽 my channel and see what rules for first draw are.聽聽

The only difference now is that you can use 2020聽 figures for your payroll costs. One important聽聽
[268]
thing to note here is you have until March 31st聽 of 2021 to apply for either first draw or second聽聽
[274]
draw. So, don't wait until the last minute聽 if you're on the fence about this, just apply聽聽
[280]
and you know, you will likely receive the loan.聽 And then you'll just be able to get it forgiven.聽聽

But if you're on the fence, apply, you'll get聽 an offer, you can either choose to accept or聽聽
[291]
decline the offer but if you wait until the聽 last minute, your chances of getting anything聽聽
[295]
are pretty low okay. So, that brings me to the聽 25 reduction rule, the 25% reduction of revenue聽聽
[303]
rule okay. And this is just for second draw loans.聽 If your PPP loan is anything less than $150,000,聽聽
[311]
you will not be required to prove that you had a聽 reduction in revenue when you apply for the loan.聽聽
[317]
You will likely need to prove it when you apply聽 for forgiveness or if the SBA requests from you聽聽
[322]
at any point during the application process.聽 If your loan is going to be over $150,000聽聽
[328]
then you have to provide the burden of proof聽 that you did see a reduction in revenue from聽聽
[334]
any quarter in 2020 compared to that same quarter聽 in 2019. Now you can also use an annualized method聽聽
[344]
where you use the 12 months of revenue sometime in聽 2020 and compare it to revenue in 2019. For that聽聽
[351]
burden of proof, is usually done by a, you know,聽 financial statement, they might request even bank聽聽
[357]
statements, I doubt it but I'm sure they're going聽 to request financial statements from a quarter in聽聽
[362]
2020 and compare it to a quarter in 2019. Now just聽 because your loan is under $150,000 and you're not聽聽
[370]
required to prove that you had a reduction聽 in revenue doesn't mean that you should lie聽聽
[376]
just to get the loan okay. If your business聽 did really well in 2020 compared to 2019,聽聽
[381]
I'm sorry but you don't qualify for this聽 loan. Just because they don't ask for proof,聽聽
[384]
doesn't mean you can't get in trouble for聽 it later. You know, at the very least, you聽聽
[389]
might not get it forgiven, at the very least. The聽 worst cast scenario, is you will be charged with聽聽
[394]
fraud because that's what this is if you lie on聽 your application to get the loan, that is fraud聽聽
[400]
and you could be charged with you know to the full聽 extent and you can be sentenced to time in prison.聽聽

So if your business did really well in 2020, and聽 you had no reduction in revenue in any quarter,聽聽
[412]
and you still apply for the loan, and you accept聽 the money, then you've committed fraud. So just聽聽
[417]
don't do that. Alright so when can you apply聽 for this loan? Banks should be starting, banks聽聽
[423]
should be opening up their portal starting this聽 week to apply for a first or second draw loans.聽聽

Now if, I'll post a link to the application聽 that the Department of Treasury released聽聽

in my description below but don't print聽 out that application and fill it out聽聽
[440]
okay. Just wait for your bank to provide an聽 online portal for you to do the application.聽聽

It's going to be pretty much the exact same聽 application, most likely just electronic聽聽
[451]
okay. But just wait and see because聽 I don't want you doing double work聽聽
[455]
by printing out the application, filling聽 it out, and then just having to do it聽聽
[459]
again on some like different platform. Watch out聽 for your bank sometime this week, at the latest聽聽
[464]
hopefully next week, at the latest, but I have聽 been hearing banks are starting to roll these out聽聽
[469]
and they're planning on doing it this week.聽 And there's one last thing I wanted to touch聽聽
[473]
before I end here, is that the PPP loans are聽 forgivable. This is basically free money and聽聽
[479]
now that the Economic Aid Act clarifies that聽 you don't even have to exclude this money from聽聽
[487]
your taxes as a deductible expense, it's even聽 better. So you can get the loan, get it paid back聽聽
[493]
for you, and deduct it on your taxes. This is just聽 free money. So this is a forgivable loan but just聽聽
[499]
remember that the loans are not automatically聽 forgiven. You have to apply for forgiveness. So,聽聽
[506]
whether you already took first round PPP draw聽 or you're planning on taking the second draw聽聽
[512]
now, just remember that your forgiveness has to be聽 applied for and it's just not automatic. So if you聽聽
[518]
haven't applied for forgiveness on the first draw聽 yet, be sure to just do that now or sometime soon聽聽
[525]
okay. Because the SBA might hold up your聽 application if you are in the process of applying聽聽
[532]
for forgiveness or if you're pending forgiveness聽 from the SBA, there's a chance the SBA might kind聽聽
[539]
