Channel: Judge Judy

[0]
is this?
[1]
>> Matthew Lopez.
[2]
He is my witness.
[3]
He is now my roommate.
[4]
>> Judge Judy: He's your witness
[5]
to what?
[6]
>> Well, to an entire month
[8]
in the apartment.
[8]
>> Judge Judy: A what?
[10]
Speak up.
[11]
>> He watched me
[13]
in a fire damage,
[14]
helped with the damage and then
[17]
also helped move me out.
[18]
>> Judge Judy: Mm-hmm.
[19]
What kind of premises
[20]
did you rent to the plaintiff?
[22]
>> It's a small studio apartment
[24]
that was attached to an extra
[26]
building on our church property
[28]
that we had remodeled
[29]
just for her and her daughter.
[30]
>> Judge Judy: How long did you
[31]
know her?
[31]
>> At least 6-plus years.
[32]
>> Judge Judy: And when you say
[33]
you remodeled a studio
[36]
on church property,
[37]
what do you have to do
[38]
with the church property?
[38]
>> Our church,
[39]
we have 70 acres of land.
[41]
So we had an extra building
[42]
that we used as a garage,
[44]
also for our use, a man cave.
[46]
And so there was a section
[48]
that we converted into a very
[49]
nice studio apartment,
[51]
that I had planned
[52]
to make that arrangement later.
[53]
We were hoping
[54]
to get a groundskeeper.
[55]
It came up when Lisa was needing
[56]
a place to stay that --
[57]
>> Judge Judy: How did you know
[58]
she was needing a place to stay?
[60]
>> She was living
[60]
with her parents,
[61]
and she was complaining weekly
[63]
to us about the conditions
[64]
and the treatment that she was
[65]
getting from her stepdad.
[66]
>> Judge Judy: Did you know
[67]
what she as doing for a living?
[68]
>> Working at Family Dollar.
[69]
>> Judge Judy: Do you know
[70]
what she was doing there?
[71]
>> She started out
[72]
as a cashier clerk.
[73]
And, since in the last year
[75]
or so, she was promoted
[76]
to assistant manager.
[77]
>> Judge Judy: When did she move
[78]
into this studio
[79]
that you renovated for her?
[80]
>> She would have moved in
[81]
in February of 2015.
[83]
>> Judge Judy: And were you
[84]
charging her rent?
[85]
>> Yes.
[85]
>> Judge Judy: How much?
[86]
>> $500 a month.
[87]
>> Judge Judy: Was she able to
[88]
pay her rent?
[89]
>> No, she could not make
[90]
the monthly payments.
[90]
So the arrangement
[91]
we had came to that,
[92]
when she got her tax check,
[94]
she had $5,000 for 2015.
[96]
So she gave the entire $5,000
[98]
and prepaid her rent
[99]
for the first
[100]
10 months of the year,
[101]
which allowed us to do the work
[103]
to make the apartment livable.
[105]
So she gave the $5,000.
[106]
We fixed it up.
[107]
She moved in.
[108]
She had no rent for 10 months.
[111]
And then, at the next year,
[112]
February of 2016,
[113]
when she got her tax,
[114]
she was to catch up
[115]
while she was behind
[117]
and pay as much in advance
[118]
as she could for the next year.
[119]
>> Judge Judy: So when
[120]
did she give you the tax check?
[121]
>> As soon as she got --
[122]
>> Judge Judy: Month and year.
[123]
>> February of 2015 and then
[125]
again in February of 2016.
[126]
And she paid in cash,
[127]
Your Honor.
[127]
>> Judge Judy: She paid what in
[128]
cash?
[129]
>> Her rent.
[129]
When she gave the $5,000,
[131]
she gave $5,000 in cash.
[132]
>> Judge Judy: [ Laughs ]
[136]
And she did all of this
[138]
because she didn't have money.
[140]
She had herself
[141]
and her daughter,
[141]
so she didn't have money
[142]
to pay you rent.
[143]
So she waited
[144]
to get her tax check,
[145]
and she got her tax check,
[147]
and she went to some
[148]
sort of a bank
[149]
and got cash to give to you.
[153]
>> To the church.
[154]
>> Judge Judy: It gets better.
[157]
This person who had no cash
[160]
took out renters insurance,
[162]
had no money to pay her rent,
[163]
paid renters insurance.
[165]
And, lo and behold, there was
[167]
some sort of fiery smoke
[172]
that damaged
[173]
a whole bunch of your property.
[176]
And I want you to tell me
[178]
when this fiery smoke was.
[180]
>> Well, I report --
[181]
>> Judge Judy: Just a second.
[182]
>> Oh, go ahead.
[183]
>> Judge Judy: Month and year.
[186]
>> It was reported to
[187]
insurance December 15th of 2016.
[191]
>> Judge Judy: Is when there was
[193]
a fire.
[194]
That's when your $5,000 rent ran
[196]
out that you had prepaid
[198]
the February before.
[199]
So then you were up
[201]
to January, right?
[202]
And then you would have
[203]
to have paid
[203]
another $5,000, right?
[205]
Because she wasn't
[206]
paying any rent.
[207]
She was just giving you
[208]
every February $5,000 in cash
[211]
when she got her tax refund.
[212]
Is that right?
[213]
>> Correct.
[214]
>> Judge Judy: Now,
[214]
what I would like to see is,
[216]
when you first took out
[219]
and paid for renters insurance,
[221]
month and year.
[223]
Don't look confused.
[225]
It's a very simple question.
[226]
I want to see when you took out
[228]
the rent-insurance policy.
[231]
Because somebody has renters
[233]
insurance,
[233]
and you've lived there
[234]
for a couple of years,
[235]
you would've taken the renters
[237]
insurance out
[237]
for several years, right?
