today we're going to talk about the car

dealer stole my down payment

so the question is why would a car
[11]
dealer steal somebody's down payment
[13]
do they hate their customers maybe more
[16]
likely they're just greedy
[18]
and the fact is they think they can
[19]
simply get away with stealing the down
[21]
payment
[22]
so i've sued many car dealerships here
[25]
in maryland
[27]
and they are capable of anything one of
[30]
the
[32]
most significant problems that
[35]
my clients run into here in maryland is
[38]
that dealers
[39]
will steal a down payment and they'll
[41]
also sell trade-ins
[43]
when financing is not approved and then
[45]
they leave the customer holding the bag
[47]
and they say we're not going to give
[48]
your down payment back or we've already
[50]
sold your trade-in you're not going to
[51]
get it back
[52]
and customers have no idea what to do
[55]
it's such a terrible situation it's
[56]
completely illegal it's totally unfair
[59]
yet many dealers do this now
[62]
in maryland there's something called a
[64]
spot delivery and
[66]
what a spot delivery simply means is a
[68]
car was delivered to a customer
[70]
by a dealer delivery meaning the
[72]
customer took possession
[74]
the car was delivered in a sense on the
[76]
spot
[77]
and financing has not yet been finally
[80]
approved
[80]
so why is that important well if
[82]
financing is not
[84]
finally approved that means of course it
[86]
may fall through and if financing falls
[88]
through
[89]
that means that the customer is not
[91]
going to be able to finance that car
[92]
with the bank
[94]
and what the dealer is probably going to
[95]
do is you're going to call up the
[96]
customer and say hey bring the car back
[98]
the deal fell apart you know we need our
[101]
car back and
[102]
that's it now in maryland when
[105]
a dealer finds out that financing has
[109]
not been approved
[110]
they have four days from the time of
[113]
delivery
[114]
to notify the customer in writing that
[116]
financing has not been approved
[118]
a notice is also required to be given to
[120]
customers
[121]
at the time of delivery uh if financing
[124]
has not been finally approved at the
[125]
time of delivery
[127]
laying out the customers rights it's
[129]
generally called a spot delivery notice
[131]
and what the notice sets forth is the
[134]
customer's right
[135]
to be notified within four days whether
[138]
or not
[138]
financing has been approved or if it has
[140]
not been approved um
[143]
and if not the customer has the right as
[145]
soon as they return that vehicle to the
[147]
dealer
[147]
they're entitled to immediately and
[149]
that's in law
[150]
immediately get back their down payment
[153]
and their trade and they get back
[154]
100 of the down payment now
[158]
dealers uh almost never provide written
[160]
notice within four days
[162]
customers usually find out two three
[164]
four weeks sometimes it could even be
[166]
months
[166]
uh they find out that financing has not
[168]
been approved now why is that a problem
[170]
that's a problem because in really in
[173]
the scope of a week if somebody turns a
[175]
trade-in in
[177]
they still have their tags and of course
[180]
well at least in maryland if you don't
[182]
turn in your license plate
[184]
um you're going to start getting fined
[186]
if the car is no longer insured
[188]
so people trade their car in they think
[190]
financing is done they turn their plates
[192]
into the mba
[193]
and then when they get a call from the
[195]
dealer saying hey come get your trade
[197]
they say well i've already turned in my
[199]
tags i thought everything was done you
[200]
told me financing was approved
[202]
and the dealer says true to form
[204]
whatever i don't care just come get your
[206]
car
[206]
or you know we're going to have it towed
[207]
somewhere else they don't care now
[210]
regarding down payments when financing
[212]
is not approved what dealers will often
[214]
say
[214]
is they'll call the customer and say
[216]
okay financing has not been approved
[218]
bring our car back
[219]
and the customer will say okay here's
[221]
your car now give me my trade and give
[223]
me my down payment and the dealer often
[225]
says
[225]
regarding the down payment look you
[227]
drove our car for free
[228]
for two three four weeks you put 100
[230]
miles on it
[232]
um we have to reinspect it we have to
[235]
do some touch-up work whatever none of
[237]
it matters the required to give 100 of
[239]
the down payment back but they will
[240]
start to come up with
[242]
excuses uh as to why the customer is not
[245]
going to get their down payment back
[246]
immediately
[247]
for example i have a current case
[249]
against a car dealer here
[251]
in the baltimore area where somebody put
[253]
five thousand dollars down
[255]
they got called about three weeks later
[257]
to come back
[258]
and instead of getting their five
[260]
thousand back immediately
[262]
about three weeks later they got a check
[264]
for 135 dollars
[266]
and the check actually itemized what the
[269]
deductions for
[270]
which doesn't matter because they're all
[271]
illegal deductions all the down payment
[273]
has to be refunded immediately
[276]
after the customer brings the vehicle
[277]
back when financing is not approved
[280]
now that
[283]
is what happens often but even worse
[286]
well
[286]
equally bad is when the dealer actually
[290]
sells somebody's trade-in before
[292]
financing isn't approved
[294]
and you would think to yourself what
[297]
kind of wretched organization would do
[299]
such a thing
[300]
and i would say drive down a busy street
[302]
and look to your left and right
[303]
and that's probably who's going to be
[304]
doing these things the new dealers do
[306]
them the used dealers do it
[308]
uh they all do it just happens it's just
[310]
a fact of life that dealers sometimes
[312]
sell the car before financing is
[314]
approved
[314]
now this leaves the customer in a
[317]
terrible spot
[318]
they have a car that they don't have
[319]
financing for the dealer wants it back
[322]
the trade-in is gone um and they don't
[325]
know what to do and often that's when
[326]
they call
[327]
a dealer lawyer or a dealer fraud lawyer
[329]
like myself to say can you help me
[331]
and the answer is yes we can help um
[333]
depending on where your trade is
[336]
has it really been sold is it just
[337]
waiting at auction to be sold
[339]
um sometimes dealers will buy it back
[343]
from a customer who they sold it to in
[344]
order to give it back
[346]
and sometimes it shakes out where the
[349]
the customer may be compensated
[352]
the retail value of the trade that was
[354]
illegally sold that's happened a number
[356]
of times
[357]
but that's certainly a violation of
[359]
actual maryland law
[360]
and then there's other other causes of
[362]
action
[364]
such as fraud if a dealer tells somebody
[366]
that finance refinancing really is
[368]
approved but it's not
[369]
and uh violations of the consumer
[371]
protection act uh for providing
[373]
misleading information which is
[375]
generally something along the lines of
[377]
yes the deal's final you don't need to
[378]
worry about it everything's done
[380]
this is your new car go and enjoy it but
[382]
really it's not because financing hasn't
[383]
been approved
[384]
so that's a brief discussion on the
[386]
perils of
[388]
spot deliveries in maryland when
[389]
somebody thinks
[391]
you know consumers sometimes also don't
[393]
really understand
[394]
what does it mean if financing doesn't
[396]
get approved it's not really explained
[398]
that that means you got to give it back
[401]
we're not going to sell your trade
[403]
you should get all your money back a lot
[404]
of people just say where do i need to
[406]
sign
[406]
i just want to drive i just want to ride
[408]
you know tell me what i need to sign
[410]
and then have to kind of deal with these
[411]
consequences as a surprise when these
[413]
things come up
[414]
