the the agent who is the real estate
[80]
agent or sometimes called the licensee

alright the these are the same person
[88]
agent is the real estate agent or
[90]
licensee now they are the same person
[92]
and they're at the core of the center of
[95]
every real estate transaction where a
[97]
licensee is involved alright then we
[100]
talked about in the previous video
[102]
what's called the fiduciary fiduciary
[106]
duties that the agent or licensee owes
[110]
to their client there are six fiduciary
[113]
duties we discussed them in detail so
[116]
that was the first part of this series
[119]
in today's video we're going to discuss
[122]
part two which is the classifications of
[126]
agency first video was about the the
[131]
fiduciary duties and those six fiduciary
[134]
duties that the agent knows to the
[135]
client today we're going to talk about
[137]
the classifications now classification
[140]
number one the first one I want to talk
[142]
about is what's called special agency
[147]
special agency now special agency has
[152]
four key points that we have to
[154]
understand the first one is it's for one
[158]
specific action or act now think about
[164]
this I'm a real estate agent with a
[168]
license and the seller hires me to sell
[173]
their house so I'm gonna make sure that
[176]
I give them all those fiduciary duties
[179]
that I owe them but it's for one
[182]
specific act the classification when I'm
[185]
selling somebody's house is special
[187]
agency that is the type of agency that I
[190]
have with the seller all right and part
[194]
of that is one specific act meaning my
[197]
only job is the one thing is to sell the
[201]
sellers house period all right
[203]
it also requires that there is a limited
[208]
having a hard time spelling here you
[212]
need to slow down it's a limited a
[216]
limited time limited a limited purpose
[223]
and there's a limited authority now
[229]
let's look at each one of these one
[232]
specific act my job is to sell the house
[236]
that's it however I have a limited
[238]
amount of time to sell that house and
[240]
that is determined by the listing
[242]
contract and how long that listing
[244]
contract is a limited purpose again the
[247]
only job I have is to sell that property
[249]
and then limited Authority I cannot
[252]
speak on behalf of my client in any way
[255]
so give me let me give you an example
[257]
here let's say that I have a on doing an
[260]
open house on my sellers property that I
[263]
have up for sale somebody comes through
[265]
a prospective buyer walks through and
[267]
says hey Paul I'll offer why don't you
[269]
talk to your seller let's see if they'll
[271]
take $200,000 now even if I've had
[274]
previous conversations with my seller
[277]
and that seller has indicated to me that
[279]
they will take $200,000 I still can't
[284]
speak on behalf of my client and say oh
[286]
yeah my seller will take that I have to
[289]
tell the buyer great thanks for the
[291]
offer
[292]
me talk to my seller or my client and
[294]
and see what they want to do I'll be
[297]
back in touch with you
[298]
all right so special agency is for one
[301]
specific action it's for a limited time
[304]
limited purpose and limited authority
[306]
that's the first classification now
[308]
there are some subcategories of special
[312]
agency the first one is what we call
[315]
limited buyer's agency or limited tenant
[321]
agency if I'm representing a tenant now
[324]
all the same rules apply I still owe all
[328]
the fiduciary duties to my buyer or my
[330]
tenant and the type of agency that we
[333]
have between me the licensee and that
[337]
buyer is special agency so think about
[340]
it that buyer I'm limited to
[342]
representing the buyer in that real
[345]
estate transaction and it's for what one
[348]
specific action meaning I'm going to
[350]
find a buy a house for my buyer to buy
[352]
it is for a limited time right so as
[355]
soon as I find a house for my buyer to
[357]
buy or we separate our are we mutually
[361]
agree to part ways that's the limited
[364]
time limited purpose limited Authority I
[367]
can't speak on behalf of my buyer just
[369]
like I can't speak on behalf of my
[371]
seller all right the second subcategory
[375]
is limited seller agency or owner in the
[382]
case of a proper in the case where I
[384]
have a home for lease so maybe there is
[387]
an investor that's hired me to lease
[390]
their property it's limited limited
[392]
seller's agency or owner agency again I
[395]
owe all the fiduciary duties to the
[398]
seller and special agency exists and
[401]
again that one specific action is to
[403]
sell the house it's for a limited time
[404]
limited purpose limited Authority I
[407]
think you get the picture where I'm
[408]
going the next one is a little more
[410]
complicated it's called dual agency dual
[415]
agency this is where I'm going to
[418]
represent the buyer and the seller or
[422]
the tenant and the owner in the same
[424]
trans
[425]
action so let me give you an example I
[427]
have a house listed for sale and I I do
[432]
an open house a prospective buyer walks
[435]
through and says hey I want to make an
[436]
offer at that point I say listen before
[439]
you move forward I just want to let you
[440]
know I represent the seller they're my
[443]
client and the buyer says great let's
[445]
write it up anyways at that point I say
[448]
great and I can treat him as a client as
[450]
well so when I when I represent the
[453]
buyer in the seller or a tenant in an
[455]
owner in the same transaction that's
[458]
called a dual agency now not every
[462]
broker will allow dual agency so let's
[466]
say there's a broker that does not allow
[468]
dual agency how does that work well
[470]
let's go back to our example let's say
[472]
that I'm the listing agent I'm doing an
[474]
open house a prospective buyer comes
[476]
through and says and the buyer says
[479]
listen Paul I want you to write up the
[480]
offer and I say well here's the deal the
[482]
seller is my client and I represent them
[485]
I cannot represent you I cannot give you
[489]
those fiduciary duties but you can be a
[492]
customer and here's what being a
[495]
customer means I have to be fair and
[496]
honest and all those things we talked
[498]
about in in part 1 of this series all
[501]
right so that way there I'm representing
[503]
the seller and then the buyer is a
[507]
customer I owe the seller all the
[509]
fiduciary duties I owe the buyer all the
[512]
duties that that the the law requires
[516]
that I give to the buyer and again we
[518]
talked about that in that first video
[520]
all right now one thing I need you to
[523]
know here here's an asterisks dual
[525]
agency for dual agency to be authorized
[528]
or to be legal all parties in the
[530]
transaction have to agree to dual agency
[534]
in writing meaning the buyer and the
[536]
seller and both brokers or all the
[539]
brokers involved in the transaction have
[542]
to agree and simply say it just simply
[545]
means that they're all authorizing dual
[547]
agency but that authorization has to be
[550]
in writing it cannot be verbal all right
[553]
and then the last one I want to talk
[554]
about is sub agency
[557]
sub-agency isn't used too much anymore
[560]
but it still does exist and let me map
[562]
this out let's say we have one two three
[566]
main street up for sale and I am the
[570]
listing agent all right and I work for
[572]
one two three main street brokerage firm
[575]
and I put it out on the network or the
[578]
Multiple Listing Service so we have
[580]
hundreds and hundreds of buyers agents
[583]
out there from many many different
[585]
companies they all represent or they all
[588]
have buyer clients under sub agency all
[593]
of these buyers agents represent my
[597]
seller so what does that mean that means
[600]
every one of these buyers agents they
[604]
owe my seller all these fiduciary duties
[607]
those six fiduciary duties that we
[609]
talked about in in part 1 of this video
[612]
series all right agency can be very
[616]
complicated at times no doubt and it's
[618]
very difficult to learn sometimes and
[620]
that's why I kind of map it out the way
[622]
I do and if you agree with me give this
[623]
video a thumbs up but sub-agency then
[627]
all the buyer's agents out there
[629]
represent my client meaning they owe my
[632]
client the seller fiduciary duties even
[634]
though even though the listing is with a
[638]
different company these are all
[639]
different companies company one company
[641]
to company three company for four
[643]
different companies involved but they
[645]
all represent my seller now again like
[648]
dual agency there has to be in
[651]
authorization and writing for that to
[653]
exist now the question is buyer agent
[657]
number one they've been representing
[659]
their their buyer now for two weeks
[661]
showing them a ton of homes they don't
[663]
know me and they don't know my seller so
[667]
they represent obviously as a limited
[669]
buyer's agent they represent their buyer
[672]
but they also represent my seller is a
[674]
limited seller agent so that means once
[678]
the deal gets started here then it's
[681]
going to go to dual agency remember if
[683]
you represent both parties in the same
[686]
transaction it ends up being dual agency
[690]
and that would it require the informed
[693]
written consent of all the parties
[695]
involved sub-agency can be very
[697]
confusing at time but you do have to
[700]
know sub agency for the real estate
[702]
licensing exam all right the next
[705]
classification of agency I want to talk
[708]
about is what we call general agency
[714]
general agency now a couple of things we
[716]
have to know about general agency number
[719]
one is it's an ongoing relationship
[724]
ongoing and number two is the licensee
[729]
can speak on behalf or for the client
[733]
all right now under special agency
[736]
remember it was limited time limited
[738]
purpose limited Authority in one
[741]
specific act and once that one specific
[743]
action ended then their relationship is
[747]
done but under general agency that a
[749]
that agency relationship continues now
[752]
where do we see this the most common
[754]
it's in property management so and it
[757]
doesn't matter the type of real estate
[760]
that the licensee is is managing general
[764]
agency is typically what you see now let
[767]
me give you an example and why it's
[768]
important and one other thing I want to
[770]
point out here you can speak on behalf
[772]
of your client but there is limits on
[775]
what you can and can't do on behalf of
[778]
your client and here's what I mean let's
[781]
say that I I am managing a single-family
[783]
home for an owner it's a rental property
[786]
a single family rental and every time
[790]
there is a maintenance item and I need
[792]
to spend five bucks or $10 on a washer I
[795]
would literally under special agency I
[798]
would have to go get the permission of
[800]
the owner that's just not practical so
[804]
what many times what property managers
[806]
will do is they'll have a certain
[807]
threshold or a dollar amount in the
[810]
management contract that says any
[812]
maintenance up to let's say three
[814]
hundred or five hundred dollars then I
[816]
as the licensee I make those decisions
[821]
without contacting the owner
[823]
anything above a certain dollar amount
[825]
then I will have to contact the owner to
[827]
get permission to do it so from a
[830]
practical point of view it makes sense
[832]
but there are some limits on on how much
[836]
you can speak on behalf of the client
[839]
the third classification is called
[842]
Universal agency Universal agency or
[847]
sometimes known as common law common law
[852]
agency every state kind of has their own
[856]
their own verbage here now it looks a
[860]
lot like general agency on steroids
[863]
alright so it's an ongoing relationship
[865]
and the you can speak on behalf or speak
[872]
for your client and the authority is
[876]
much greater than specially our general
[879]
agency actually under Universal agency
[882]
it's a power of attorney and many times
[884]
the authority of the licensee is goes
[887]
beyond the actual real estate
[889]
transaction they can buy vehicles for
[892]
the property management company and
[894]
things like that and the other thing you
[896]
remember about both general agency and
[898]
Universal agency is if the licensee
[901]
makes a decision for the owner that
[904]
decision is binding on the owner so let
[907]
me give you an example let's say I have
[909]
a Universal agency with an investor of
[911]
mine and I see a great realist or what I
[914]
think is a great real estate deal and so
[917]
I buy that piece of property because I
[919]
have the authority to do that on behalf
[921]
of my owner the owner turns around and
[924]
sees the property and says oh no no no I
[926]
don't like this property well guess what
[928]
they're gonna buy the property because I
[931]
have the legal right to bind them under
[934]
under a Universal agency now the fourth
[938]
classification of agency I want to talk
[940]
about is called implied so this is
[944]
number four implied now implied agency
[949]
goes by a couple of different names and
[952]
I'll put them down here in the notes
[954]
here on the screen it can also be called
[957]
agency by estoppel or Austin scible
[961]
agency and again you need to know that
[963]
because you don't know how the real
[964]
estate exam is gonna phrase the
[967]
questions this simply means by
[969]
implication you represent somebody and
[973]
let me give you just a weird example of
[975]
where you might see this let's say that
[976]
I have 1 2 3 Main Street listed for sale
[980]
on I'm doing an open house a buyer
[982]
potential buyer comes through and says I
[984]
really don't like this house but I love
[985]
your neighbor's house and you say
[988]
whether it's true or not you say oh yeah
[990]
I have this house for sale so you want
[994]
to write an offer and the prospective
[996]
buyer says yes so you sit down with the
[998]
perspective buyer you write up an offer
[999]
then you take the offer to the neighbor
[1003]
and say hey I got an offer for you
[1005]
now the neighbor could say aunt done
[1008]
nope go away house is not for sale or
[1012]
are they they could say great let's take
[1013]
a look at it well there's nothing in
[1015]
writing with you and the neighbors
[1017]
saying that you represent them in the
[1019]
transaction but by implication because
[1021]
they're gone they're moving forward with
[1024]
the sale then by implication you are
[1028]
their agency are you there you're their
[1030]
agent so that's implied agency so you
[1033]
become the agent and they become your
[1036]
client now once you put everything into
[1039]
writing then it's called agency by
[1042]
ratification now in many many states
[1045]
this is not legal but I do want to point
[1048]
it out because I do here every once in a
[1050]
while students that will have that
[1052]
question or a version of that question
[1055]
on their licensing exam well that's all
[1059]
