<b> Civil Money Penalty (also known as a CMP) -- What is</b>

<b> a No-Tobacco-Sale Order (also known as an NTSO),</b>

<b> and -- What is a Complaint.</b>

<b> Included in this discussion will be: -- a</b>

<b> description of what is in a Complaint, -- a</b>
[186]
<b> description of the documents that accompany</b>
[189]
<b> the Complaint, -- and an explanation of what</b>
[191]
<b> happens after you receive a Complaint.</b>

<b> A Civil Money Penalty, or CMP, is simply a monetary</b>
[197]
<b> sum assessed for violations of the law.</b>
[201]
<b> The Federal Food, Drug, and Cosmetic Act (known as</b>
[204]
<b> the FD&amp;C Act) gives FDA the authority to assess a</b>
[208]
<b> CMP for violations of certain requirements of</b>
[210]
<b> the Act.The monetary sum assessed is based on a</b>
[214]
<b> published penalty schedule, and the amount</b>
[216]
<b> varies depending upon how many violations of the</b>
[219]
<b> tobacco regulations occur during a specified period.</b>
[222]
<b> Because FDA's Center for Tobacco Products counts</b>
[224]
<b> violations of the regulations when</b>
[226]
<b> determining the CMP amount, an inspection</b>
[229]
<b> could result in more than one violation.</b>
[232]
<b> If a retailer is found to have violated certain</b>
[234]
<b> requirements of the FD&amp;C Act as listed in the</b>
[237]
<b> Complaint, they may be liable for the amount of</b>
[240]
<b> the CMP sought.</b>
[242]
<b> A No-Tobacco-Sale Order, or NTSO, is an order</b>
[246]
<b> prohibiting the sale of tobacco products at a</b>
[248]
<b> retail establishment.</b>
[251]
<b> A retailer who has repeated violations of the</b>
[253]
<b> tobacco regulations may be subject to an NTSO order.</b>
[257]
<b> Repeated violations are defined as five violations</b>
[260]
<b> of certain tobacco regulations within a</b>
[262]
<b> thirty-six month period that constitute a repeated</b>
[265]
<b> violation.</b>
[267]
<b> The maximum NTSO period that CTP intends to seek</b>
[271]
<b> are 30 days for the first NTSO, 6 months for the</b>
[274]
<b> second NTSO, and an indefinite period for the</b>
[277]
<b> third or subsequent NTSO.</b>
[281]
<b> FDA has compiled a glossary of common terms</b>
[283]
<b> that you will encounter when dealing with CMPs and</b>
[286]
<b> NTSOs.</b>

<b> Now we'll discuss what a CMP or an NTSO Complaint</b>
[309]
<b> is, what you'll receive with your Complaint, and</b>
[311]
<b> what happens after the Complaint is delivered to</b>
[313]
<b> you.</b>

<b> Retailers receive CMP or NTSO Complaints when the</b>
[318]
<b> FDA's Center for Tobacco Products has evidence that</b>
[321]
<b> indicates an establishment violated the Tobacco</b>
[323]
<b> Control Act.</b>
[325]
<b> The FDA's Center for Tobacco Products initiates</b>
[328]
<b> a CMP or NTSO action by serving a Complaint upon</b>
[331]
<b> the retailer or its representative.</b>
[333]
<b> Serving the Complaint simply means that the</b>
[335]
<b> Complaint has been delivered to you.</b>
[337]
<b> In most cases, you will receive your Complaint at</b>
[339]
<b> your retail establishment through a mailing service,</b>
[341]
<b> such as UPS or the US Postal Service.</b>
[346]
<b> Now let's turn our attention to the Complaint</b>
[348]
<b> itself.</b>
[349]
<b> A Complaint is the legal document that identifies</b>
[352]
<b> the statutory or regulatory violations that</b>
[354]
<b> are the basis for seeking a CMP or NTSO.</b>
[358]
<b> In other words, the Complaint tells you the</b>
[360]
<b> information that FDA's Center for Tobacco</b>
[362]
<b> Products is using to seek the CMP or the NTSO.</b>
[366]
<b> The Complaint also identifies the amount of</b>
[368]
<b> the CMP or the duration of the NTSO that FDA's Center</b>
[372]
<b> for Tobacco Products is seeking.</b>
[376]
<b> The Complaint has several sections that provide</b>
[379]
<b> important specific information.</b>
[381]
<b> The first section is called the Introduction.</b>
[383]
<b> The Introduction identifies the parties to</b>
[386]
<b> the Complaint.</b>
[388]
<b> In a CMP or an NTSO action, the parties are</b>
[391]
<b> the FDA's Center for Tobacco Products and the</b>
[394]
<b> retailer.</b>
[395]
<b> The Introduction also sets forth the amount of the</b>
[398]
<b> CMP sought or the duration of the NTSO sought.</b>
[403]
<b> The next section of the Complaint is called the</b>
[405]
<b> Legal Authority section.</b>
[407]
<b> The Legal Authority section sets forth the</b>
[409]
<b> laws governing the sale and distribution of</b>
[412]
<b> tobacco products and the authority for a CMP and/or</b>
[417]
<b> NTSO.</b>
[418]
<b> This is the first page of a sample CMP Complaint.</b>
[422]
<b> On the far-right side it is titled: &quot;Administrative</b>
[425]
<b> Complaint for Civil Money Penalty.&quot; An NTSO</b>
[428]
<b> Complaint looks just like a CMP Complaint, except it</b>
[431]
<b> is titled: &quot;Administrative Complaint for</b>
[434]
<b> No-Tobacco-Sale Order.&quot; As you can see, the heading</b>
[438]
<b> or the caption, identifies you, the retailer, as the</b>
[441]
<b> Respondent for this Complaint.</b>
[443]
<b> Throughout the CMP or NTSO process, you will be</b>
[447]
<b> referred to as the Respondent and the Center</b>
[449]
<b> for Tobacco Products at FDA will be referred to as</b>
[452]
<b> the Complainant.</b>
[454]
<b> The caption also lists the docket numbers for the</b>
[456]
<b> Complaint.</b>
[457]
<b> We will discuss docket numbers in more detail</b>
[459]
<b> later in this presentation.</b>

<b> The first page of the Complaint contains the</b>
[464]
<b> Introduction section and begins the Legal Authority</b>
[467]
<b> section.</b>
[470]
<b> The Current Allegations section of the Complaint,</b>
[472]
<b> among other things, provides the most recent</b>
[474]
<b> facts and circumstances forming the basis for the</b>
[477]
<b> action.</b>

<b> It sets forth the name and address of your</b>
[481]
<b> establishment.</b>
[484]
<b> In CMP Complaints, this section also provides the</b>
[487]
<b> brand names of the tobacco products that were</b>
[489]
<b> involved in the violation, the dates and times of the</b>
[492]
<b> most recent violations, and the specific laws that</b>
[495]
<b> you allegedly violated.</b>
[499]
<b> The Previous Case History section provides</b>
[501]
<b> information about the retailer's previous CMP</b>
[503]
<b> and NTSO history, including the dates and</b>
[507]
<b> specific regulatory violations alleged in</b>
[509]
<b> previous Complaints, and the outcome of those</b>
[512]
<b> actions.</b>
[514]
<b> If this is your first CMP, there will not be a</b>
[516]
<b> Previous Case History section.</b>
[520]
<b> The Complaint will also have a section titled</b>
[522]
<b> Responding to the Complaint.</b>
[524]
<b> This section provides you with specific information</b>
[526]
<b> on how and when to respond to the Complaint.</b>
[531]
<b> If you choose to contest the matter, you must take</b>
[533]
<b> action within 30 days of receiving the Complaint by</b>
[536]
<b> filing an Answer or successfully requesting an</b>
[539]
<b> extension.</b>
[541]
<b> If you take no action, you could be issued a default</b>
[544]
<b> judgment.</b>
[545]
<b> Answers, extensions, and default judgments will be</b>
[549]

<b> The Complaint also informs you that you have the</b>

<b> right, but are not required, to obtain an</b>

<b> attorney to represent you in this case.</b>

<b> One of them is the cover letter.</b>

<b> The cover letter is addressed to your retail</b>

<b> establishment.</b>

<b> The subject line of the cover letter will state</b>

<b> whether a CMP or NTSO Complaint is included, and</b>

<b> will include your establishment name and</b>
[582]
<b> street address, case docket numbers, and the</b>
[585]
<b> retailer case number.</b>

<b> Docket numbers and the retailer case number are</b>
[589]
<b> used to identify your case and are used in filing</b>
[592]
<b> documents, when paying CMPs online, during the</b>
[595]
<b> settlement process, and during the hearing</b>
[598]
<b> process.</b>

<b> Once the Complaint has been delivered to you, the</b>

<b> FDA's Center for Tobacco Products files the</b>
[702]
<b> Complaint with the US Department of Health and</b>
[704]
<b> Human Services, Departmental Appeals</b>
[706]
<b> Board, also known as the DAB.</b>
[708]
<b> &quot;Filing&quot; means submitting a copy of the Complaint to</b>
[712]
<b> the DAB.</b>
[714]
<b> The filing of a Complaint for a CMP or an NTSO</b>
[717]
<b> officially opens an administrative enforcement</b>
[720]
<b> action.</b>
[721]
<b> The DAB employs several Administrative Law Judges</b>
[725]
<b> (also known as ALJs) in its Civil Remedies</b>
[728]
<b> Division, or CRD.</b>
[730]
<b> The CRD ALJs provide impartial, independent</b>
[734]
<b> review of administrative actions such as CMP and</b>
[737]
<b> NTSO cases.</b>
[739]
<b> The ALJs are qualified under the Federal</b>
[742]
<b> Administrative Procedure Act to conduct hearings on</b>
[745]
<b> the record.</b>
