about um some lingos some terms

when it comes to workers compensation uh

that you will probably be

hearing if you have not heard yet good

mean it's really important that

there's a whole textbook that just has a

glossary of terms
[30]
and they're terms that most people if
[32]
they've never been in the system
[34]
and they find themselves in it are going
[36]
what does this mean
[37]
it's also important for anyone sitting
[39]
here listening
[41]
that maybe has a worker's compensation
[44]
case and maybe they're fairly new
[45]
into it maybe they're not too far into
[47]
it but eventually
[49]
someone is going to raise the term
[52]
maximum medical
[53]
improvement and it's often referred to
[55]
as mmi
[57]
and the reason it's important that every
[59]
claimant should understand
[60]
what that term means is it can affect
[63]
your financial benefits that workers
[65]
compensation pays for you
[67]
so what maximum medical improvement
[69]
means
[70]
is that the doctor in your case the
[73]
workers comp doctor has determined that
[75]
your medical condition
[77]
and your injury you have gotten to the
[80]
point where
[81]
there is no further recovery doesn't
[83]
mean that you're back to being perfect
[85]
doesn't mean you're back to pre-accident
[87]
level
[88]
it just means that the doctor from their
[90]
perspective
[91]
doesn't believe that there's anything
[93]
further that can be offered to improve
[96]
your condition now it doesn't mean that
[99]
you can't continue to get medical care
[101]
um you may still be entitled to medical
[103]
care you may still need medical
[105]
treatment whether that be injections or
[107]
medication
[108]
but the doctor's saying that that
[111]
treatment isn't going to improve you
[113]
it's just going to keep you at status
[115]
quo or maintain
[117]
your level of pain um and so
[120]
the reason it's important is because

your temporary benefits
[125]
that maybe are being paid by weekly
[127]
could stop
[128]
once the doctor renders you at mission
[131]
medical improvement or mmi
[134]
there again it goes back to important
[136]
having communication with your doctor
[138]
and also
[139]
looking at the forms that you get from
[141]
the doctor's office
[143]
if they check on that second page that
[145]
you're at maximum medical improvement
[147]
you need to know what the next step is
[148]
in your case
[150]
you need to be prepared for what could
[152]
potentially happen
[154]
again your benefits may stop you may or
[157]
may not be entitled to
[159]
other classifications of benefits after
[162]
that mmi date
[164]
there's a number of different types of
[165]
benefits that one may be entitled to
[167]
or there may be no benefits that that
[169]
person is entitled to

so the other thing is typically in
[173]
workers comp you don't have to pay
[176]
for your medical treatment you don't
[177]
have to come out of pocket until you
[179]
reach maximum medical improvement
[182]
at which point the carrier could um
[185]
require you start paying a 10 copay to
[188]
see the doctors
[189]
now there's a lot of um
[192]
a lot of variances with regards to that
[194]
and there's a lot of things to know
[195]
about that but it's important that
[197]
everyone know that it's coming
[199]
in their case at some point so here's my
[201]
question do people really try to
[203]
navigate this on their own
[205]
i mean i can't imagine um being your
[207]
everyday you know employee and having to
[209]
go through workers compensation and
[211]
trying to figure out what all this
[212]
language means on their own and what
[214]
step is next and what form
[217]
you know a lot of time most of our calls
[220]
are fairly early on
[221]
a month to two months from the date of
[223]
the accident
[225]
but you would be surprised we get calls
[227]
five six seven eight years into
[230]
an accident and treatment and they've
[232]
never had an attorney so
[234]
it's really personal preference but
[236]
again a lot
[238]
can happen and there's a lot of
[239]
navigating and a lot of things that
[242]
the carriers don't have to tell you
[243]
about um
[245]
that you know if you had legal counsel
[247]
we would be able to
[249]
to to tell you along the way what you're
[251]
able to do
[252]
