Channel: Real Estate COMMAND

[0]
do you want to know what happens to聽 your bank of America money when you die聽聽
[3]
then you're in the right place.
[12]
since i've been in my 50s i paid a lot聽 more attention to estate planning issues聽聽
[17]
i plan on living for many more years but i'm聽 also a realist we will all one day die we can聽聽
[23]
either try to take control of how we die or we聽 can leave it up to others i've also seen and聽聽
[28]
heard about other people about how they dealt with聽 money issues after someone dies and i can tell you聽聽
[34]
it isn't a pretty sight nor is it a pretty story聽 when there is no plan in place the people left聽聽
[40]
behind are left with stress confusion and general聽 chaos that chaos causes a lot of infighting and聽聽
[47]
unnecessary friction and this is why the issue聽 of estate planning is important to me and why聽聽
[53]
it might also be important to you so this is a聽 general rule whether you know it or not everyone聽聽
[58]
has an estate plan for most people you have one of聽 two estate plans you have an estate plan in which聽聽
[66]
you created and had an active role in or you're聽 going to let the state you live and decide how聽聽
[71]
they disperse your money and assets either way聽 everyone has an estate plan it's all your choice聽聽
[78]
i know what you're thinking you're thinking聽 that i'm going to preach about having a will聽聽
[82]
but believe it or not i'm not going to talk about聽 the will except that i think it's a good idea聽聽
[87]
and that this video is not the time and place聽 to discuss wills however i am going to discuss聽聽
[93]
something way more simpler as it relates to聽 your bank of america money and that simple idea聽聽
[100]
is having a pod form a pod form stands for payable聽 on death form it's available to customers at most聽聽
[109]
financial institutions however most people don't聽 know about it until they ask about it normally i聽聽
[116]
would give a short explanation of how pod forms聽 work and the concept of beneficiaries but in the聽聽
[122]
case of bank of america they have conveniently聽 created a web page which covers a lot of what聽聽
[128]
i'm going to discuss so what i'm going to do is聽 pull up the bank of america beneficiaries page聽聽
[134]
and review it with you this bank of america faq聽 page is dedicated to the topic of beneficiaries聽聽
[141]
and pods this page is available to anyone on聽 the internet you don't have to have a bank of聽聽
[147]
america account to read this page so starting out聽 when you get to the bank of america page you're聽聽
[153]
going to have a list of questions however if you聽 click your mouse on the arrow heads you will see聽聽
[159]
that the questions will expand into answers of the聽 individual questions the first question is what is聽聽
[166]
a payable on death beneficiary a pod beneficiary聽 is an individual group of individuals non-profit聽聽
[174]
company organization or trust other than the聽 owner or co-owner designated by the owners of the聽聽
[181]
account to receive the balance of funds when the聽 last owner on the account passes away essentially聽聽
[188]
a pod beneficiary is someone that you would聽 appoint to get your money after you die i say聽聽
[194]
that in the context that you're the only owner of聽 that bank account however it is entirely possible聽聽
[201]
that you can share an account with someone聽 else in the event that you die the remaining聽聽
[207]
owner of that account would assume control聽 of your money the next question shown here聽聽
[212]
is who can be a pod beneficiary for most of us聽 a pod beneficiary is going to be someone we know聽聽
[219]
it's going to be a spouse significant other聽 a family member a relative or even a friend聽聽
[226]
the next question is what information do i need聽 to add a pod beneficiary what bank of america聽聽
[233]
wants is a first and last name a date of birth the聽 country of citizenship a social security number聽聽
[241]
and a complete address the information that bank聽 of america is asking for is common to the other聽聽
[248]
financial institutions that i've seen the next聽 question is can i have multiple beneficiaries and聽聽
[255]
the answer is yes there is no limit to the number聽 of pod beneficiaries allowed on an account each聽聽
[262]
pod will receive an equal share of the assets in聽 an account at the time of the passing of the last聽聽
[268]
owner on the account bank of america provides the聽 example is that if you list four pod beneficiaries聽聽
[276]
each individual will receive 25% of the funds聽 the next question bank of america lists here聽聽
[282]
is what accounts can have pod beneficiaries and聽 the answer is that it's going to apply to almost聽聽
[289]
any account that you would normally have at a bank聽 it would include a checking savings cd account聽聽
[296]
ira account and an investment account and the聽 last question listed here is how do i change my聽聽
[302]
pod beneficiaries or add a new one how i'm going聽 to answer this is that i'm going to actually show聽聽
[308]
you the screenshots of how to do this later on in聽 this video so as a quick review a pod beneficiary聽聽
[315]
is pretty much anyone you would want to appoint聽 to receive your money after you die so whether聽聽
[321]
you have a checking account savings account聽 investment account or retirement account you聽聽
[327]
assign beneficiaries to each and every account now聽 i'm going to do a quick sidebar on apportionments聽聽
[334]
an apportionment is the dividing up of the聽 monies in an account bank of america states that聽聽
[341]
by default they're just going to equally divide聽 whatever money that is left into the account and聽聽
[348]
disperse it to the beneficiaries however you聽 should know that many financial institutions聽聽
[354]
do allow for customized apportionments聽 for example you may want to apportion 50%聽聽
[361]
of the money in that account to one person聽 then you may want to apportion 30 percent聽聽
[366]
of the money in that account to a second聽 person and then apportion 20% of the money聽聽
[371]
in that account to a third person when you聽 add up the 50 percent, 30 percent, and 20%聽聽
[377]
it totals 100 percent and they are unequal聽 shares in the case of bank of america going聽聽
[384]
through their online form you're not going聽 to be able to do customized apportionments聽聽
[390]
and that's something you should be aware of and聽 this is a second sidebar keep in mind i'm not an聽聽
[396]
estate lawyer i'm only bringing this up so that聽 you can look into the matter further in the case聽聽
[402]
of a spouse and you live in a community property聽 state it may not be possible for you to leave out聽聽
[409]
monies for your spouse they may be automatically聽 entitled to 50 of the monies of that account聽聽
[417]
even if you leave their names off now there聽 doesn't have to be anything nefarious about this聽聽
[423]
different people think about their monies and聽 their accounts in different ways a person may聽聽
[428]
want to assign one account where all the monies聽 go to the spouse and they may have yet another聽聽
[434]
account where they would want all the money to go聽 to the children and because of this simple example聽聽
[440]
if you do plan on leaving out a spouse and you聽 live in a community property state this is an聽聽
[447]
issue you may want to check into for any other聽 situations without a spouse your chosen or default聽聽
[455]
apportionments should stand but let's get back to聽 bank of america and how they deal with pods and聽聽
[461]
beneficiaries i have to say i really really like聽 how bank of america handles pods and beneficiaries聽聽
[470]
and the reason why i like it so much is that聽 you don't have to deal with a paper form with聽聽
[476]
bank of america and if you have online banking聽 you can do it all from the comfort of your home聽聽
[483]
and you don't have to deal with scanning and聽 signing a form more recently with bbnt now聽聽
[490]
converted to truest bank i had to go into a branch聽 and wait for someone to change my form it was not聽聽
[499]
a fun process and it was a time-consuming process聽 they wanted me to physically come in and check my聽聽
[506]
id before i could do anything now i understand聽 why bbnt and truest bank wanted me to come in聽聽
[513]
but i have to tell you i really much prefer bank聽 of america's online system so what i'm going to do聽聽
[520]
now is do a quick run through the bank of america聽 online system on how to set up a pod and assign聽聽
[528]
beneficiaries the first thing we're going to聽 assume is that you're a bank of america customer聽聽
[534]
and you have online banking activated first we're聽 going to go to the home page and on the left side聽聽
[540]
you will see where you have to type in your online聽 id and password in order to sign in once you sign聽聽
[547]
in you will see a list of accounts that you have聽 with bank of america to preserve the privacy of聽聽
[553]
the account holder i redacted a lot of information聽 on this screen so in this example with this聽聽
[560]
list of accounts i click on the first checking聽 account but i could just as well have clicked any聽聽
[567]
other account you're going to see that it's very聽 familiar regardless of which account you click on聽聽
[573]
once you click into the account screen what you're聽 looking for is the information and services tab聽聽
[579]
once you click into the information and services聽 tab you're going to scroll down into the account聽聽
[585]
features section under account features聽 you should see a listing for beneficiaries聽聽
[592]
you click manage to go into the next screen once聽 you click the manage link it should take you to聽聽
[598]
your beneficiaries screen you should see a list聽 of accounts in which you can add a beneficiary聽聽
[605]
update a beneficiary or remove a beneficiary the聽 nice thing about this is that you don't have to聽聽
[611]
deal with paper forms you can do it right there聽 from the convenience of your home so what i'm聽聽
[616]
going to do now is assume that you have your聽 list of bank of america accounts but you have聽聽
[622]
not added a beneficiary so once you click on add聽 a beneficiary this is a screen you're going to see聽聽
[629]
for most people you're going to assign a聽 beneficiary to an individual it's pretty聽聽
[634]
straightforward if you look at the screen you'll聽 see the first name middle name which is optional聽聽
[640]
last name you put in the date of birth there's聽 a button to add a street address you select the聽聽
[646]
country of citizenship and you put in the social聽 security number before you save the beneficiary聽聽
[652]
information to that particular account you should聽 read the notice please make a note or print聽聽
[658]
what you've entered about each beneficiary聽 for your records in order to protect this聽聽
[663]
sensitive information we will only display your聽 beneficiaries names when you review or make聽聽
[669]
updates your pod beneficiary must be complete and聽 accurate to be legally binding by clicking save i聽聽
[677]
authorize for myself and other account holders聽 that this information is correct and that i聽聽
[682]
agree to the beneficiary addendum notice now most聽 people will probably save the information without聽聽
[689]
reading the beneficiary addendum notice but in聽 the interest of being complete i am displaying聽聽
[695]
the beneficiary addendum notice it's actually聽 a pretty short read it says that i acknowledge聽聽
[701]
and understand that by establishing a pod account聽 under the provisions of the applicable state law聽聽
[708]
number one during my lifetime i may withdraw the聽 money in the account number two i may change the聽聽
[715]
beneficiaries at any time and number three upon聽 my death the money remaining in the account聽聽
[721]
will belong to the then surviving beneficiaries in聽 equal shares and will not be inherited by my heirs聽聽
[730]
or controlled by my will i think this beneficiary聽 addendum notice is very good because it reinforces聽聽
[737]
the fact that you can control what happens to the聽 money after your death without the need for a will聽聽
[743]
in fact the statement says that the pod聽 will override any will that you might have聽聽
[750]
now one thing i like about pods is that you聽 can change your mind at any time and when聽聽
[755]
you do change your mind it doesn't cost you money聽 unlike a will if you have to make changes to will聽聽
[761]
it's a little bit more complicated but changing聽 a beneficiary adding a beneficiary or removing聽聽
[768]
a beneficiary can be done very easily especially聽 if you're with bank of america so when you enter聽聽
[775]
the update your beneficiary screen you will see聽 it's nearly identical to the ad beneficiary screen聽聽
[782]
the statement of what you agreed to when you聽 added a beneficiary is still applicable when聽聽
[788]
you change the beneficiary it's the same exact聽 verbiage with the same beneficiary addendum notice聽聽
[795]
so what do you think about pods beneficiaries and聽 bank of america i'd like to know what you think聽聽
