And in this segment, we're going to discuss

purchasing real estate with a land trust.

Now, for those of you
[9]
that aren't familiar with land trust,
[10]
there's two different ways you can set it up.
[11]
You can set it up with yourself as the trustee,
[15]
or you can use what is referred to as a nominee trustee.
[19]
That is someone who will serve in your place
[22]
for the purposes of maybe deeding property
[25]
into the name of the trust
[26]
or actually buying property in the name of the trust.
[28]
And the whole concept here
[30]
is that you don't want your name to be on title.
[33]
So if somebody was looking,
[34]
they wouldn't associate you back to the property.
[37]
That means essentially what we're doing
[38]
is looking for anonymity.
[39]
Now, although anonymity is your friend,
[42]
when it comes to an aggressive attorney,
[44]
it can also be a potential problem for you
[49]
when you're trying to purchase property
[51]
in the name of a trust.
[53]
Because when you go to buy a property
[54]
in the name of a trust, a land trust,
[56]
and you're using a nominee trustee,
[58]
the title companies typically require
[60]
that the trustee is the one
[62]
that signs off on all of the documentation.
[65]
Now, I know inside of a land trust,
[66]
if you watch my other videos,
[68]
that the beneficiary are the ones
[70]
that have all the control over the land trust.

So technically speaking, it is the beneficiary
[75]
who should be signing off on the trust,
[78]
but it's not the way it works.
[79]
You know, I've done countless deals with land trusts.

In fact, watch my other video on selling property

a story that I currently have on a property

I just sold in Hawaii.

But the fact of the matter is

is that when you're trying to buy property
[92]
in a land trust and you have this nominee trustee on there,
[96]
the title company is not going to read your trust.
[99]
They just make an assumption.
[100]
And this is really one of the benefits of the land trust
[102]
is that everyone assumes that it's a living trust
[105]
or some other type of trust,
[107]
and they don't quite get what it is
[108]
that they're working with.

So they're going to require the trustee to sign off.

Therefore herein lies the problem.

If you're using a nominee trustee,
[117]
and I've done this before for my clients,
[119]
in order for this to work
[121]
then it is the trustee who has to sign off
[123]
on all the paperwork.
[124]
So what I've done before,

and, you know, mobile notaries actually come
[127]
out to my office sent out by the title company
[130]
and I sat down and signed all of the documentation
[134]
on behalf of the trust.

If you're using debt it's probably not going to happen,
[138]
because most trustees will refuse
[140]
to sign off on any debt, of course.

I know I've been in that position before
[144]
and they've asked that of me.

So if you're considering
[147]
purchasing property with a land trust,
[150]
then you yourself should be the trustee.

Now, here's another option, what you could do.

And keep in mind there's an asterisk here.

You could set up your trust,
[160]
so when you set up the trust
[161]
and you're going to choose who a trustee is,
[164]
what you could do is you set up your land trust here.

Maybe instead of naming yourself
[169]
as an individual as a trustee
[170]
you choose an entity that you own and control,
[173]
like a limited liability company.
[176]
So my trustee over here
[178]
will be an LLC that I've set up.
[181]
Preferably this would be one that has anonymity.
[183]
Maybe it's a Wyoming limited liability company, Nevada.
[186]
Well, I show and use Nevada because in Nevada
[189]
to obtain anonymity you have to have a nominee there.
[192]
So I'd do it with a newly formed Wyoming
[194]
or possibly Delaware limited liability company
[198]
to run this strategy.
[199]
So the LLC is set up as the trustee of your trust.

The beneficiary, bene, is you.
[207]
So if you've set up this LLC
[209]
and you're the manager of the limited liability company,
[213]
what's going to happen when you go to signing then,
[215]
you as the manager
[219]
will sign on behalf of the LLC,
[221]
which is the trustee of the land trust.

So now title will actually be taken
[226]
in the name of this land trust right here.

And on title, if the name of your LLC,
[233]
let's say it was Big Profits, so title would be as follows:

Big Profits LLC
[242]
Trustee
[244]
of 1632 Land Trust,
[250]
dated, and of course, whatever date it was
[252]
that you set this up.
[253]
So that's how the title would be taken.

And so what occurs now
[257]
is that your name's not actually listed there.
[259]
It's the LLC that will be listed as the trustee.
[264]
And that way you're in complete control
[266]
of the entire transaction.

You don't have to use an Omni trustee like myself.

Now, what's the asterisk?
[271]
What's that little caveat?
[272]
Well, technically speaking,
[274]
and again, it's not going to matter
[275]
because again, title companies,
[277]
they miss this stuff all the time.
[279]
In order to be a trustee, you have to be,
[281]
I mean for a company to be a trustee,
[283]
it has to be licensed.
[285]
Now, your company, of course, is not licensed
[288]
and you're not going to go through that process.
[290]
So at the end of the day who's going to report you?
[292]
Well, you're not going to report yourself,
[294]
so I don't really see that as being a problem.

But it is a way,
[298]
I mean it is a potential issue you have to be aware of
[300]
that at a later date someone could raise the issue.

Let's say your trust is gettin' sued,
[304]
and they bring up the fact,
[306]
oh, you set up an entity
[308]
that's not even licensed and registered.
[309]
You don't follow the laws of your state.
[311]
I mean, it just a garbage argument
[313]
that an attorney may use to try to discredit you.
[316]
But it would allow you to complete this transaction.
[320]
I have clients that have done this
[322]
routinely with their land trust investing,
[324]
and I've seen it work firsthand.
[326]
So just keep that in mind.

If you want to buy property
[328]
in the name of a land trust and you want anonymity,
[332]
given the fact that it's going to be difficult
[334]
or you're going to have to pay someone
[335]
to be your nominee trustee,
[336]
if you want to control the entire process, do this.
[339]
Set up a Wyoming limited liability company.
[341]
Make it the trustee of your land trust.
[344]
You're the manager of that Wyoming LLC
[346]
and then you sign on it.
