need to go together because

they do the same thing it's just the

processes are a little bit different

based on the state that they're in so

hey everybody in this video we're going

to discuss what's called an

abstract now when would we use an
[40]
abstract or in the opening i discussed
[42]
title insurance or title search is
[45]
when would we use this well when
[47]
somebody buys a piece of property
[50]
and that period between contract and
[52]
closing
[54]
there are a lot of things that are done
[55]
including inspections for the whole
[57]
house that may be a septic or a well
[59]
so there's things that are going on to
[62]
ensure that the new buyer
[64]
is getting a property that is uh
[67]
you know what they expect part of that
[69]
is what we call
[70]
a title research or an abstract
[74]
where someone is going to research or do
[77]
an
[77]
inspection of the property's history to
[81]
ensure that the new buyer
[83]
isn't going to they're not going to go
[86]
to closing and buy a piece of property
[87]
that has liens against it
[89]
there's clouds on the title those type
[91]
of things and one of the methods of
[93]
ensuring that is called an
[95]
abstract now i got the definition of
[97]
abstract on your screen

an abstract is a condensed history
[101]
report called a chain of title
[104]
key real estate term you have to know to
[106]
a specific
[108]
parcel of real estate it consists of a
[110]
summary of the original land patent and
[113]
all subsequent conveyances and
[115]
encumbrances
[116]
affecting the property an abstractor
[120]
that's a person they make a
[122]
certification that the history
[124]
is complete and accurate and you can see
[127]
the key
[128]
terms there that we're going to discuss
[130]
so essentially here's what happens
[132]
depending on the state you're in
[135]
most states do what's called a title
[137]
search and then issue title
[139]
insurance a few states do what's called
[142]
an
[142]
abstract for example iowa
[145]
all right and some states can do both
[147]
but you have to know both for your real
[148]
estate exam
[150]
so essentially what's going to happen on
[151]
an abstract is when
[153]
uh that period contract to close the
[156]
buyer is going to hire someone called an
[158]
abstract door and and they're going to
[161]
research the ownership or the title of
[164]
that property
[165]
and i've seen an abstract actually it's
[168]
a book
[168]
it's a chronological book of everything
[171]
and some of it could be two inches thick
[173]
and the abstract can go all the way back
[175]
to the beginning of the land patent
[178]
in the 1800s and if you were actually
[181]
read through this abstract you would
[183]
notice that
[184]
it is as it says on your definition here
[187]
it talks about conveyances and
[190]
encumbrances it's going to have a
[191]
history at
[192]
everybody that's ever owned that
[193]
property when
[195]
property ownership has changed and every
[198]
instrument that was placed against it
[199]
like
[200]
liens for example or easements those
[203]
type of things will all be
[205]
on there and also the removal and they
[208]
also get into the marital or the
[209]
community
[210]
property part of it that's why it's so
[212]
important when we're doing title
[214]
searches and abstracts that
[216]
they know about divorces because there's
[218]
marital interests so on and so forth the
[220]
person is the abstract door
[222]
who's going to make a certification that
[223]
hey i researched this property
[226]
and i find everything to be satisfactory
[229]
or
[230]
i don't and here are the things prior to
[231]
closing that needs to be
[233]
that needs to be resolved otherwise the
[235]
buy the buyer
[237]
is going to receive title or ownership
[239]
to that property
[240]
with clouds on it now what typically
[243]
happens is the abstract exists
[245]
because the original owner who's
[247]
currently i'm sorry the owner that's
[249]
currently living there
[250]
they had the abstract brought up to date
[253]
as of the day of their closing
[255]
so let's say that this owner owned it
[256]
for 10 years they're selling it to me
[259]
i'm going to have an abstract done and
[260]
what we're going to do is called
[262]
updating
[262]
the abstract there's no need to go back
[264]
all the way in to the beginning of land
[266]
patent
[267]
because that's already been done all i
[269]
have to do is hire someone to update
[272]
this abstract or update this history
[274]
report
[275]
from the time that the owner owned it
[278]
the current owner
[279]
to closing so i'm not getting any junk
[283]
that should be the responsibility of the
[285]
current owner so
[287]
again the abstract an abstract door
[291]
will do the research and they'll list
[293]
any additional instruments recorded
[295]
against the property since the current
[297]
owner took title that's called
[298]
updating an abstract now understand this
[301]
is important
[302]
an abstract is a history report it's
[305]
deemed to be accurate but it doesn't
[307]
guarantee
[308]
good title it's not insurance however
[310]
the abstract door who does the research
[313]
he
[313]
is or she is responsible for any errors
[316]
that were made
[318]
so although there it's not guaranteed as
[320]
in with you know insurance like title
[322]
insurance
[322]
there is still a level of protection
[325]
there
[326]
and then what happens after the abstract
[328]
door deems the history report to be
[330]
accurate and they've updated the act
[332]
the the abstract they will send it over
[334]
to the lender's attorney
[335]
the attorney reviews it if the attorney
[338]
gives it a blessing
[339]
then he's he or she's going to issue
[340]
what's called a certificate
[342]
of title which means that the title
[346]
actually belongs to the current owner
[348]
and the current owner
[350]
can pass free clear marketable title
[353]
to the new buyer um
[357]
certificate of title that is another key
[359]
real estate term that you have to know
[363]
so that's the basics of an abstract of
[366]
title the abstract is something that you
[367]
do need to know for your real estate
[369]
licensing
[370]
