in today's video we're talking about pro

bono criminal defense lawyers a lot of
[4]
the times people will be charged with
[5]
crimes they want to hire an attorney but
[8]
they just simply cannot afford it so we
[10]
get calls from people who say hey I've
[12]
been charged with this offense I need a
[15]
pro bono lawyer is there anything you
[17]
can help me with can you represent me
[18]
for free well unfortunately our law firm
[21]
can't we just don't have the capacity to
[22]
work for free and so we are what we
[25]
consider private attorneys and we charge
[27]
a fee for our services for
[29]
representation there are most criminal
[32]
defense attorneys are going to be in
[33]
this category they're going to be
[35]
charging a fee for representation the
[38]
reason why is because pro bono attorneys
[41]
really don't exist in the criminal
[43]
defense space except for very specific
[46]
areas things like the Justice Project
[48]
where somebody's wrongfully convicted or
[50]
there are certain special niche groups
[53]
that will take cases on a no fee basis
[56]
because they get funding from other
[57]
sources they get donors and they have
[59]
big fundraising abilities and so they
[62]
are able to support the people working
[65]
on the case from those funds whereas we
[68]
as a private criminal defense attorney
[70]
we don't get any government money we
[72]
don't do any fundraising the way that we
[74]
keep our lights on in our building is by
[76]
charging people a fee for our expertise
[79]
for representing them what about the
[81]
people though who cannot afford an
[83]
attorney do they get representation are
[86]
they just totally out of luck well no
[88]
they're not the government provides
[91]
attorneys these people are called public
[92]
defenders and so if we look at it we
[95]
have a couple different categories of
[97]
types of representation that somebody
[99]
can get when they're charged with the
[100]
crime you have a category here we call
[102]
them p d--'s public defenders and you
[106]
have private attorneys now public
[110]
defenders there are a couple different
[112]
categories within public defenders so in
[114]
some cities like the City of Scottsdale
[116]
the City of Phoenix different cities
[118]
they actually will contract with private
[121]
attorneys so these are people who have
[124]
their own private practice they can be
[125]
small law firms but they will cat will
[129]
have a contract with them so that person
[131]
will have their private practice but
[133]
we'll also take a contract where they
[136]
will take some cases that are assigned
[138]
to them from the city court so if
[141]
somebody goes into court and they're
[142]
charged with DUI and they can't afford
[144]
to go hire a private attorney their case
[147]
will be assigned to somebody else so for
[150]
example the City of Scottsdale they
[152]
don't have a full public defender's
[154]
office where they employ people full
[156]
time to represent people charged with
[159]
crimes they will contract these out to
[161]
private attorneys now the private
[163]
attorney is still getting paid a fee in
[166]
order to take that case so this into the
[168]
individual who is charged with the crime
[170]
may not have to come out of pocket at
[172]
all that representation is being
[175]
provided for by the government so rather
[177]
than looking for a pro bono attorney if
[179]
you are somebody who has been charged
[181]
with a crime you're gonna want to see if
[183]
the court will appoint a public defender
[185]
now there's a bad stigma about public
[187]
defenders people will often say that
[189]
public defenders are the cheap lawyers
[192]
are not any good and whatever blah blah
[194]
blah there's a lot of kind of bad stigma
[195]
around that that's not been my
[197]
experience at all I think a lot of
[199]
people who are private attorneys who
[201]
have contracts with the with the
[204]
different cities are all very good very
[206]
capable attorneys a lot of the times
[208]
they just don't have the amount of time
[210]
or the resources to put in that a
[211]
private attorney would but that doesn't
[213]
mean that they're bad lawyers that they
[215]
don't care or anything like that there
[217]
is also another type of entity if you're
[220]
charged with a major felony if you're
[222]
charged with something that's a bit more
[223]
serious than a misdemeanor at the city
[225]
level you may be assigned a case from
[227]
the public defender's office so there is
[230]
an entity in Maricopa County and in most
[232]
counties where they will assign you a
[234]
public defender now this person's job
[236]
full-time is to accept cases and
[239]
represent people who are charged with
[241]
crimes for their salary there that's
[244]
part of their salary they don't have a
[245]
private practice so they don't have any
[247]
of this going on their full-time public
[250]
defenders and those people are also
[252]
highly qualified okay they're they're
[253]
highly qualified they've got a lot of
[255]
training they have good training
[256]
programs there and they're not bad
[259]
attorneys at all so just because you're
[261]
assigned a public defender it doesn't
[263]
mean that you're getting some subpar
[265]
attorney now sometimes like I said
[267]
they don't have the the resources or the
[269]
or the follow-up that you might find
[270]
from a private defense law firm like
[274]
ours we have a one-to-one relationship
[276]
with a lot of people we have direct
[278]
access to legal assistance and so you
[280]
get phone calls from us back within 24
[282]
business hours that's our internal
[283]
policy but you may not get that same
[286]
sort of level of customer services
[288]
you're gonna get with a public defender
[288]
but it doesn't mean that they're a bad
[290]
attorney the other question that we get
[292]
regarding free attorneys or
[294]
court-appointed attorneys is some
[296]
sometimes people will want an attorney
[298]
and they'll expect the court to assign
[301]
them an attorney even though they're not
[303]
eligible for it so just because you're
[304]
charged with a crime doesn't mean that
[306]
you are automatically guaranteed to have
[308]
an attorney assigned to you generally
[310]
the standard is you may be eligible for
[313]
an assigned public attorney or a
[315]
court-appointed attorney
[317]
if the government is seeking jail if
[320]
they're seeking jail time in your case
[322]
they may they are legally obligated now
[327]
to then appoint you an attorney if you
[329]
want one and sometimes people will come
[331]
to us and they will not be charged with
[332]
a crime that has mandatory jail to be
[334]
charged with a criminal speeding ticket
[336]
or a reckless driving ticket or maybe
[338]
they were charged with a misdemeanor
[339]
offense where they're were charged with
[341]
a disorderly conduct or a criminal
[343]
speeding or something along those lines
[344]
and in those types of situations there
[347]
is no ability to have an attorney
[350]
publicly appointed from the government
[352]
there's just no requirement that they do
[353]
that so it is something that is
[355]
important if you did want to have an
[358]
attorney appointed to you you you want
[361]
to make sure that you're charged with a
[362]
crime where the government is seeking
[363]
jail if they're not seeking jail they
[365]
have no obligation to give you an
[366]
attorney when also you're going and
[368]
asking for an attorney the government
[370]
may want to do a financial background on
[372]
you they may want to see whether or not
[374]
you can afford to go hire your private
[376]
attorney or contribute a certain amount
[378]
of funds to the public defender who is
[380]
being appointed to you so in other words
[381]
you have to pay part of the fee for the
[384]
attorney so I hope this helps a lot of

the times people will call us at me

looking for pro bono that's really not
[390]
the right language to use most private
[392]
law firms will not take cases on a pro
[394]
bono basis what they'll do is they'll
[396]
say we charge a fee they may reduce
[399]
their fee they may give you a more
[401]
reasonable fee but they still need to
[402]
get funding from somewhere so if you're
[404]
looking for a pro bono attorney what
[406]
you're really looking for is a public
[407]
defender and those are the obligations
[410]
that you have to do if you want to be
[411]
appointed one you have the government
[412]
has to be seeking jail and then you have
[414]
to do a financial affidavit you have to
[416]
make sure that you can afford to either
[418]
contribute to it or you can't afford it
[420]
at all and they'll just appoint it to
[421]
you and they'll cover the total costs so
[423]

importance of an attorney regardless of

whether it's a private attorney or a
[429]
public defender or anybody else it's

very important that you have counsel as

you go through this experience because

facing criminal charges is obviously a

very difficult situation to be in
