in this video we're talking about

prosecution and specifically prosecutors

offices and how they are structured to

prosecute cases so there are really two
[9]
main differences between certain
[11]
agencies and how they actually operate
[13]
their systems they can prosecute what's
[16]
called horizontally or they can
[18]
prosecute vertically and we're gonna
[20]
explain what each one of those are and
[22]
why they're important to know so some
[24]
agencies will do what's called
[26]
horizontal prosecution and what this
[29]
means is that the way that they
[31]
prosecute cases is tiered so they've
[34]
there's different levels and prosecutors
[36]
are assigned at different levels to do
[38]
different tasks so let's say for example
[40]
somebody's charged with a felony you'll
[42]
have different stages you'll have what's
[43]
called pre charging then you'll have
[47]
what's called early disposition court
[50]
and then you'll have what's called trial
[52]
levels you have a trial group and this
[55]
isn't this is in felony court so you
[56]
have one set of attorneys who make the
[59]
decisions here all of the pre charging
[62]
decisions are done at this level then if
[64]
once they decide to actually file
[66]
charges then it will go up to the next
[68]
level and then you'll have what's called
[70]
early disposition court so it's called
[72]
the EDC in Maricopa County and this is
[76]
where you have another set of
[77]
prosecutors who are totally different
[79]
than this bottom set of prosecutors who
[81]
are making decisions as to how to
[84]
resolve a case at this level then if
[87]
they say the case is not resolved at
[90]
this level it will move up to another
[92]
level this is called trial group and
[95]
this gets a whole new set of prosecutors
[98]
so now the case is really going through
[100]
a bunch of different levels of people
[101]
and they're doing different things this
[104]
can happen in Superior Court it can
[106]
happen in city courts it can happen in a
[109]
number of different agencies but
[111]
generally this is how they're
[113]
structuring things so the downside to
[114]
that is that the person who may be
[116]
handling the trial has no decision as to
[120]
whether to charge the case or no
[122]
decision as to whether to resolve the
[123]
case in early disposition court they
[126]
kind of just get the case as it moves up
[128]
the chain that's different from what's
[130]
called vertical prosecution so in
[132]
vertical prosecution
[133]
all of these decisions are made like
[136]
this so basically one prosecutor is
[140]
handling the case from beginning to end
[144]
so they'll have the case throughout the
[146]
entire charging phase through the entire
[149]
early disposition phase through the
[151]
entirety of all of the pretrial
[153]
conferences through the settlement
[155]
conferences through the oral arguments
[157]
at any evidentiary hearings they're
[159]
gonna be married to that case throughout
[160]
the entirety of the case and so if they
[162]
take it to try if the case goes to trial
[164]
they're gonna be handling it this is
[166]
different from other from the horizontal
[168]
prosecution where sometimes some people
[171]
doing trials like in certain
[173]
jurisdictions they may not have ever
[174]
even seen the case at all they just the
[177]
case works its way through the system
[178]
and then it lands on their desk because
[180]
they're the trial attorney and then they
[183]
get the file and they go in and they do
[184]
the trial the downside to that is that
[186]
they may not know anything they may not
[188]
know what happened in terms of your
[190]
negotiations throughout the entire
[192]
pretrial process whether the case should
[194]
have even been charged whether it should
[196]
have gone through grand jury indictment
[198]
it runs its way all the way up through
[199]
and then horizontally and then they get
[202]
it read in their desk and they go do the
[203]
trial
[204]
so that's horizontal which is different
[205]
than vertical as a vertical meaning they
[207]
have the case the entire time and
[208]
there's pros and cons to these things so
[210]
sometimes in a vertical prosecution the
[213]
defense likes that better and the reason
[215]
why is because we were working with the
[216]
same person the entire time
[218]
you know which is good because now we
[220]
can have a long series of developing a
[222]
relationship with them there's a lot
[224]
more negotiation that can happen we can
[226]
actually really present our case without
[229]
fear of having them just say that's not
[231]
my problem like might happen here and
[234]
they just kick it up to the next level
[235]
they say well I have to worry about that
[236]
case I'd never have to take that case to
[238]
trial I don't really care if you have a
[240]
good issue or not it's not my problem
[243]
it's gonna be bumped up to somebody else
[245]
that's that's the downside of horizontal
[248]
prosecution everybody's just kicking the
[250]
can down the road they don't even want
[252]
to have a good conversation with you
[253]
because it's ultimately not going to be
[256]
them who's doing the trial it's
[257]
different in vertical so in vertical
[260]
you're not dealing with somebody who has
[261]
a very unique kind of a vested interest
[264]
in resolving the case or else it's going
[266]
to trial
[267]
the downside of that is that if you get
[269]
an unreasonable prosecutor in a vertical
[272]
type of a situation they may be
[275]
unreasonable throughout the entirety of
[276]
the case there may just be somebody who
[279]
just refuses to negotiate at all or they
[282]
have some sort of belief that this
[284]
particular case deserves the maximum and
[286]
they're not going to negotiate at all in
[288]
which case it's very difficult to see
[290]
any movement on that person whereas here
[293]
in horizontal prosecution you may be
[294]
seeing somebody who is unreasonable at
[297]
this level but you kick it up to the
[299]
next level and you get a much more
[301]
reasonable person so you have that
[302]
option you have that that kind of gamble
[305]
that you might have that that may
[306]
actually provide you some significant
[307]
benefits whereas on a vertical case you
[310]
don't have that chance and you can't
[312]
just hop between prosecutors and say I
[314]
want a new prosecutor that does that's
[316]
not how that works so these are the two
[318]
different ways that we see prosecuting
[321]
agencies structure themselves in Arizona
[325]
in Maricopa County we see both of these
[327]
we also see some changes happening right
[330]
now so there are some shifts from a
[332]
horizontal into a prosecutor into a
[334]
vertical type of prosecution and so
[336]
we're always monitoring that we're
[338]
always developing strategies the way
[340]
that we operate our team here is we have
[342]
different attorneys that are assigned to
[343]
different courts we all will basically
[346]
do what it called staffing meetings
[347]
where we all sit together and discuss
[348]
strategies on all of our cases but at
[351]
the same time we want to know what
[353]
agencies are doing what so that we can
[355]
develop the best strategies get to know
[357]
the people who are in these different
[358]
systems so that we can negotiate and
[361]
resolve your case in the best way and
[363]
the most favorable way possible for you
[364]
