and today's topic is 'What Is A Pour Over Will?'

Now I see this question come up frequently聽 at my office and you may have heard the term聽聽

either reading in the estate planning聽 literature or meeting with your attorney聽聽

where they mention a Pour Over Will and聽 many people have heard of a last will聽聽

and testament or a will but they聽 will ask me what is a Pour Over Will.

Well Pour Over Will is just a term of art, we聽 lawyers use to describe a certain type of will聽聽

used with a trust plan, generally, with a聽 revocable living trust, we'll talk about having a聽聽

pour over will alongside the trust. So if you form聽 the trust here, we want all your assets to flow聽聽

through the trust and avoid probate but the聽 will is designed to be just in case something聽聽

got forgotten over here, let's say this painting聽 behind me, was super valuable and it got left out聽聽

of my trust somehow. I inherited it after I formed聽 my trust and I didn't assign it to the trust.聽聽

That painting, the will would pour over聽 into my trust or let's use another example,聽聽

inherited real estate. You formed your trust 10聽 years ago and then shortly a little time ago,聽聽

one of your relatives passed away who you聽 didn't even know and they left you a one-fifth聽聽

interest in a cabin. Now, you could immediately聽 deed your interest in the cabin into your trust聽聽

and avoid probate on that asset but let's say聽 you fell sick and forgot to do this or what are聽聽

unable to do this, well then the pour over will is聽 a shorter will that says, any asset I own at death聽聽

that is not already placed in my trust, I place it聽 into my trust upon my death. So we design it as a聽聽

backup plan to make sure every asset goes through聽 the trust. I always tell my clients we don't want聽聽

to use this pour over will because it would still聽 require, in most cases, if the assets over $50,000聽聽

to go through a formal probate court process or聽 an informal or formal probate court process but聽聽

if there is an asset out there we still have聽 the will saying what should happen to it聽聽

and generally, the will, will be聽 shorter and say, my trust will govern聽聽

the disposition of my assets meaning whatever you聽 laid out in the trust, who gets the assets, that's聽聽

who you want to get it in the will. So we don't聽 repeat all that information in the pour over will.

So today, as an illustration, I have a聽 glass here and my badger water bottle聽聽

and this is the idea, the pour over will聽 would pour over those assets into the trust.聽聽

So if you think of the glass as the trust,聽 that we want to hold all the assets,聽聽

that's what the pour over will is doing, is just聽 pouring them over after death into the trust.

So really, when I think of a Pour Over聽 Will, I think of a glass pouring into聽聽

or a pitcher pouring into a glass which is the聽 trust which then governs what happens to the聽聽

assets. So that's where the word Pour Over got聽 started, using it and lawyers have adopted it聽聽

as a way to describe what the shorter will聽 is designed to do alongside the trust.

Now again, it's not my goal when I work with聽 clients to use the Pour Over Will because the聽聽

whole point of setting up a trust plan is to聽 avoid probate on the assets and save the time,聽聽

money and expense of probate聽 court after your death and make聽聽

it easier administration for your heirs.聽 However again, we have the will there,聽聽
[262]
a shorter will alongside the trust and聽 that is how the pour over will function.

So this is a term I see confusion about. I聽 wanted to create a video today, going through聽聽
