let's cover everything about Michigan wills from聽 A to Z let's get right at it so what constitutes聽聽

a valid will in the state of Michigan we look to聽 Michigan's probate code the estates and protected聽聽

to exist of course we have to comply with a聽 specific statute mcl 700 point to 502 which聽聽

written about this particular aspect of Michigan聽 law within the case law there are wills that are聽聽

written on all sorts of non-traditional media聽 for example we're used to seeing a will typed聽聽

out on a computer and then side but what about聽 wills that are signed on pieces of paper backs聽聽

of envelopes within a diary or even a Bible or聽 you've probably heard of the famous cases where聽聽

wills were signed where miners were trapped in a聽 mine and didn't think they'd escape so they draft聽聽

their last will and testament on the walls all of聽 these can constitute writings in fact in Michigan聽聽

there was a recent case in which a writing聽 was found to be valid on a mobile device a聽聽

cell phone and it was a type of suicide note now聽 we don't suggest that you even consider drafting聽聽

a will on a cell phone or doing it orally or聽 in any other way other than with a competent聽聽

estate planning lawyer because those are fraught聽 with problems and could ultimately deem that聽聽

will to be inadmissible another requirement is聽 that the will must be signed by the settler or聽聽

the person the testator the individual that is聽 creating the will of an intent to do so now of聽聽

course with every great rule there are exceptions聽 there are times that the individual can't sign the聽聽

will because of physical disability or otherwise聽 Michigan law provides for an alternative method to聽聽

allow for that individual who is intending to聽 sign the will for something to do so at their聽聽

direction now again this rule can be fraught with聽 problems if it's not done directly correctly with聽聽

this information that I'm providing you lastly聽 it must be witnessed by at least two persons聽聽

within a reasonable time of the witnessing of聽 that will now again with every great rule there聽聽

are exceptions and that witnessing requirement is聽 there are exceptions to it in the what we call a聽聽

holographic well let's take a closer look with聽 a holographic will it doesn't meet the precise聽聽

elements that were defined in the previous聽 explanation under the statute a holographic聽聽

will in Michigan looks a little bit different聽 from a traditional will it can be valid as a聽聽

holographic will whether or not witness this聽 is a critical distinction from the elements聽聽

that were explained earlier we often see this in聽 suicide notes the document is written out it is聽聽

dated it is signed and it's in the testator's own聽 handwriting now Michigan's statute specifically聽聽

requires certain elements for that document to聽 be deemed a holographic well it doesn't need聽聽

to be witnessed it needs to be dated it needs to聽 be in the testator that's the person drafting it聽聽

in their own handwriting or at least the material聽 portions in their own handwriting sometimes we see聽聽

documents that blend both traditional elements of聽 the creation of a pre-printed will like something聽聽

you may have gotten off the internet and a purely聽 handwritten will a holographic will so there can聽聽

be a combination of these two particular aspects聽 holographic and the traditional elements a will聽聽

that may occur together but with a holographic聽 will the requirements of the witnessing are聽聽

lost as long as it has the intent it's in the聽 testator's own handwriting it's signed and dated

to make matters even more confusing there are聽 times that a document on its face may appear聽聽

to be valid but when a lawyer or the court聽 looks at the testamentary document it may聽聽

have a technical defect that would otherwise make聽 that writing inadmissible as a will or a trust or聽聽

a testamentary document Michigan adopted the聽 substantial compliance theory and what that in聽聽

essence means is that if the proponent of the will聽 can show by clear and convincing evidence that the聽聽

document was intended by the decedent to be a聽 writing intended fro as a will or a trust the聽聽

court can find it to be admissible let's use some聽 examples of situations where a technical defect聽聽

may have ruled it inadmissible but because of聽 the substantial compliance theory it would or聽聽

may be an admissible document one of the classic聽 situations is when the document itself was signed聽聽

in the wrong spot the individual signs it where聽 the witness saw is supposed to sign and the聽聽

witness sign where the testator or settler was聽 supposed to sign now I was under the substantial聽聽

compliance theory it clearly was intended to聽 be a will but technically it may have failed聽聽

because it wasn't signed in the appropriate spot聽 under the substantial compliance theory that will聽聽

should be admissible if again the proponent can聽 show by clear convincing evidence that it was聽聽

the decedent's intent another example what聽 about a holographic document like a suicide聽聽

note in which there is no date but the individual聽 references the time of year maybe they mentioned聽聽

it's Christmas Day but they don't date it聽 now technically it's not David but under the聽聽

substantial compliance Theory the court could聽 find by clear and convincing evidence that the聽聽

decedent intended for that document to be a will聽 so these are some example of how the substantial聽聽

compliance theory can work it can be used to admit聽 a will it can be used for a complete revocation聽聽

of the will so for example maybe they revoked the聽 will but didn't follow the technical requirements聽聽

under the statute to do so but clearly showed聽 an intent to do so the court can find as well聽聽

as an alteration of the will and a revival of a聽 formally revoked will again the details of these聽聽
[447]
particular aspects are beyond this presentation聽 but what's important to understand is that the聽聽
[454]
document itself has to be looked at holistically聽 with often extrinsic or other evidence to support聽聽

whether the document would be admissible we'll聽 really the lesson here is to have a good skilled聽聽

well as nominating a guardian and/or conservator聽 or your minor children a little known fact is you聽聽

actually don't even have to create a will to be聽 able to nominate a guardian for your children in聽聽

intent one of the ways to destroy or revoke a will聽 is by actually tearing it up or throwing it away聽聽

so if you simply have a copy and not be original聽 the court takes the presumption that that document聽聽

was intended to have been destroyed or lost and聽 then when you resurrect or bring forth that old聽聽

document you have to overcome that presumption聽 too so to show it as the decedent's intent when聽聽

you go to the probate court it expects that you're聽 going to present what we call the wet ink original聽聽

that's the document that actually contained the聽 ink signature of the person that signed the will聽聽

now in the old days it was easy to differentiate聽 between the wet ink original and the copy a聽聽

wedding looked like wet ink and a copy looked like聽 a copy nowadays with the quality of copy machines聽聽

color copy machines as well as digital signatures聽 often it's very hard to discern whether something聽聽

was a wedding original or a copy so it's important聽 to be able to differentiate with that document in聽聽

hand what you're presenting to the probate聽 court and what statute you're advancing to聽聽

seek admission to the probate court for that will聽 to be held as valid so I've got a will I get to聽聽
