K1 Visa Wait Times - Should I Just Get Married? - YouTube

[5]
Hi, everyone. Welcome. I'm Attorney Megan Pastrana. We've had a lot of individuals who are feeling聽聽
[14]
very very stressed out about the fian茅 visa聽processing times. If any of you are currently going聽聽
[19]
through the fianc茅 visa process, I'm sure you can聽absolutely relate that the processing times are聽聽
[25]
a year or more right now just to receive a decision on that first step.
[32]
I know that that is long and I know that's聽 disheartening but I want to caution聽聽
[37]
all of you about taking extreme measures out聽of desperation. There have been a lot of聽聽
[45]
individuals who have said this fianc茅 visa wait聽time is just ridiculous. I'm thinking, I聽
[53]
should just get married and that would be faster聽or they're saying, "I wish I would have gotten聽聽
[58]
married. That would have been faster." The first聽thing I want to caution you on is that you're聽聽
[64]
already in line for your fianc茅 visa. That fiance聽visa requires that you aren't married so if you聽聽
[71]
decide to get married, you're basically having to聽start a process over for the spouse visa because聽聽
[77]
you'll no longer be eligible for the fianc茅 visa. I聽have sadly seen individuals who have done this, who聽聽
[85]
have later come to our office and said, "I got married. Can this be faster now?" And that聽聽
[90]
just breaks my heart because you're putting yourself at the beginning of a line.
[95]
You're starting over. Be very very careful. Do聽not just jump into getting married if you already聽聽
[101]
have a fianc茅 visa pending. Please get legal advice聽first because I would hate to see that. I'd hate聽聽
[107]
you have to come to my office and say, "I'm聽married now, what happens?" And then, have to tell聽聽
[112]
you now we have to file a spouse visa and you're聽going to be put in a line again. Be very careful.
[117]
Understand that yes, the wait times are long but be聽careful of taking quick action out of desperation.
[125]
The other thing that I want to give advice to聽all of you about is it really comes more聽聽
[131]
from a place of, I am not a licensed therapist but I'm a human being and I'm an聽聽
[135]
individual who has gone through the immigration聽process and that feeling of desperation, that聽聽
[141]
feeling of just all of the variables that聽you can't control in the immigration process,
[147]
I completely understand. I've been there. I feel聽that. I know it's so stressful to not be able to聽聽
[152]
control certain aspects of the immigration聽process like wait times but it's really not聽聽
[159]
healthy to look at your case and say, I see all these people who filed a spouse visa,
[165]
I should have done that. That would have been聽faster and feeling like you made a mistake.
[170]
Please know that if you filed a fianc茅 visa and聽just because it seems like spouse visa cases聽聽
[176]
might be going faster. That's comparing apples to oranges and immigration聽聽
[182]
wait times are so different by case聽type, by person. There's just so many聽聽
[188]
variables that it's oftentimes hard聽to say that one option is better or faster.
[193]
Instead of looking at it as I should have, I wish, I would have, a common phrase that I聽聽
[200]
like to say is to not to quit shooting all聽over yourself. It's just this idea that聽聽
[208]
be grateful that you have an application聽filed. I know the wait times aren't fun聽聽
[213]
but don't beat yourself up for picking a path. Just celebrate the fact that you did聽聽
[218]
pick a path you have an application filed and聽you're one day closer to a decision. Don't beat聽聽
[223]
yourself up for the path that you picked. Your聽application's filed, you're one day closer to being聽聽
[228]
together even if the wait times are long. That's聽just more of a little more advice from聽聽
[234]
somebody who's gone through the process. Just a more healthy mindset, a healthier聽聽
[238]
way to look at your case and聽wait times and where you're at in the process.聽聽
[244]
I really hope that that helps give you聽 peace of mind and an understanding of where聽聽
[248]
you're at at your case and that the聽decision you made to file was a good decision.
