but this is a notice of a class action

settlement and there's actually a very

good chance that this is on the level

and

it's possible that you stand to make

some money off of it or

at least get something of value but

you'd be forgiven if you thought that
[19]
this was complete nonsense because i
[21]
mean
[22]
just look at it look lawyers are good at
[24]
writing things down they are not great
[26]
at graphic design

but the biggest question is what do you
[29]
do when you get a notice like this how
[30]
do you know if it's real
[32]
well as it happens your favorite bird
[34]
lawyer has actually litigated and
[35]
settled countless numbers of class
[37]
action settlements worth hundreds of
[39]
millions of dollars
[40]
so let's talk about the good the bad and
[42]
the extremely ugly
[44]
about class action lawsuits and most
[45]
importantly what you should do if you
[47]
get a notice of class action settlement
[49]
so join me as i spill some legal tea

epic games lawsuit apparently at some

point i played either fortnight or

rocket league and i might be entitled to

some money or some benefits as a result

of this settlement it makes sense

because i will never get that time that
[76]
i spent on fortnight back
[77]
so i would really really like to be
[79]
compensated for that and the things that
[80]
we're going to talk about today will
[82]
relate to this particular
[83]
class action lawsuit but it should apply
[85]
to just about any class action notice
[87]
that you receive
[88]
so let's first talk about what is a
[90]
class action suit because this is one of
[92]
the most misunderstood things in all of
[94]
law
[94]
generally when you have a lawsuit you
[96]
personally sue somebody else because the
[98]
dollar amounts in question are worth
[100]
getting compensation for what you think
[102]
you were wronged over
[103]
but a class action is the opposite of
[105]
that it's where a lot of people were
[107]
probably harmed in very very small ways
[109]
that
[110]
it would never make sense for them to
[111]
individually file suit but instead if
[113]
you wrap
[114]
all of them together the class of people
[116]
all of those people who are in the same
[118]
situation
[119]
can get compensation from a company or
[121]
another individual
[123]
and when you group them all together it
[124]
makes it worthwhile to file suit
[126]
part of it is a punitive reason we don't
[128]
want companies to engage
[130]
in misbehavior that they'd never
[132]
otherwise be punished for
[133]
because simply the individuals would
[135]
never think to hire their own personal
[137]
attorney
[138]
so every state and the federal system
[141]
has laws on the books to allow people to
[142]
file a class action
[143]
and a class action gets this reputation
[145]
that's sort of like rico if you
[146]
file a class action then it's a super
[149]
super serious lawsuit and
[150]
a class action can deal with large
[153]
dollar amounts especially because you're
[154]
aggregating a whole bunch of claims
[156]
but just because it's a class action
[158]
doesn't mean that it's
[159]
necessarily a super scary or super nasty
[162]
lawsuit
[163]
sometimes class actions settle for
[164]
hundreds of millions of dollars
[166]
sometimes they go to trial and sometimes
[167]
they're simply dismissed
[169]
and no one gets anything but the most
[171]
important thing to remember about a
[172]
class action is that it requires a class
[174]
a group of people who suffered a similar
[176]
injury that
[177]
all of their injuries and all the things
[179]
that happened to them are very very
[181]
similar because a court is not going to
[183]
engage in a class action
[184]
if it has to individually look at every
[187]
single person
[188]
if the calculation that goes into the
[190]
damages for each individual person is
[191]
different
[192]
it's probably not likely to give rise to
[194]
a class action the class has to be
[196]
very similar the damages that they
[198]
suffered have to be very similar and it
[200]
has to be easy for the court to
[201]
ascertain
[202]
all of these things together because
[204]
they're dealing with potentially
[206]
hundreds
[206]
thousands and sometimes even millions of
[208]
people so imagine if you will a person
[210]
runs into a crowd and just starts
[212]
punching people now
[213]
it could be that that person has punched
[215]
a hundred people in that crowd and you
[217]
might think that could give rise to a
[218]
class action but probably not
[220]
because maybe one person was punched in
[222]
the stomach one person was punched
[224]
in the face one person suffered a
[227]
broken bone and one person was barely
[229]
damaged at all
[230]
because all of those injuries are so
[232]
fact specific
[234]
that's not the kind of thing that gives
[235]
rise to a class action well on the other
[237]
hand let's look at something that could
[238]
be easily adjudicated as a class action
[240]
let's imagine that there's a big cell
[242]
phone provider
[243]
and let's say that they improperly put a
[245]
one
[246]
dollar fee on your bill that shouldn't
[248]
be there and let's say they bill that
[250]
out to a million customers
[252]
well it's really easy to ascertain those
[253]
people you just look at the spreadsheet
[255]
of what people were charged what fees
[257]
and the damages are all the same it's
[258]
just that one extra fee that shouldn't
[260]
be there that's exactly the kind of fact
[262]
situation that's likely to give rise to
[264]
a valuable and valid class action
[266]
lawsuit so now let's turn to this
[268]
fortnight and rocket league lawsuit and
[270]
use that as an example of what happens
[272]
when a class action has filed and here
[274]
because this court case has already
[275]
gotten to the settlement stage
[277]
all the documents are helpfully
[279]
displayed right on the court settlement
[280]
website
[281]
and yes this website is legitimate it's
[283]
not meant to look good it's just meant
[285]
to be legally sufficient
[286]
so what the plaintiffs originally
[288]
alleged is that the makers of fortnite
[290]
and rocket league
[291]
engaged in some unfair business
[293]
practices and in particular if you dig
[295]
into the complaint what you'll see is
[297]
the plaintiff alleged that a lot of
[299]
minors
[299]
entered into transactions on these video
[302]
games and weren't allowed to back
[304]
out of these transactions because they
[306]
were minors and it also alleges some
[308]
other unfair business practices
[310]
as well as some claims related to random
[312]
loot crates and people spending a
[313]
thousand
[314]
virtual dollars on loot crate related
[316]
things we'll never know if that was in
[318]
fact true or not because one of the
[319]
benefits of settlement is that you don't
[321]
have to go through the expense of
[322]
discovery
[323]
and the whole trial to get to the truth
[325]
of the matter asserted you can just
[327]
settle and say that you're not admitting
[328]
anything or you're not admitting faults
[330]
if you're the defendant
[331]
and here the party's engaged in
[332]
litigation but eventually came to the
[334]
conclusion
[334]
that it was in everyone's best interest
[336]
to settle the claims instead of
[338]
spending money on the litigation now
[340]
when you come to that conclusion
[342]
it's not as easy as just signing on the
[344]
dotted line in fact
[346]
both the plaintiffs and the defendants
[348]
have to go to the court to get the court
[350]
to sign off
[350]
on the settlement itself it has to be
[352]
court approved the court has to make
[354]
sure that
[354]
the class of people are actually being
[356]
fairly compensated and that everything
[358]
else is
[358]
on the level now in addition to that you
[360]
have to determine certain things like
[362]
what is the class
[363]
and here based on the notice it says
[365]
that you're a member of the settlement
[367]
classif at any time between july 1 2015
[369]
and february 25th 2021
[371]
you had a fortnight or rocket league
[373]
account that you used to play either
[374]
game on any device in any mode and a
[377]
exchanged in-game virtual currency for
[379]
any in-game benefit
[380]
or b made a purchase of virtual currency
[382]
or other in-game benefit for use within
[384]
fortnite or rocket league so if you fit
[386]
that description you're entitled to some
[388]
relief
[389]
from the court and if you look at the
[390]
settlement agreement the lawyers
[392]
estimate that there are approximately 12
[394]
million people who have accounts who
[396]
played the games and
[397]
fit that description across both
[399]
fortnite and rocket league
[400]
and now we get to the part that everyone
[402]
is waiting for what could you possibly
[404]
get out of this settlement
[406]
well here the defendants have agreed to
[407]
spend up to 26.5 million dollars
[411]
but that's unfortunately not what the
[413]
class is going to get and here's where
[415]
things get a little bit ugly and where
[417]
i'm afraid we're going to have to spill
[418]
a little bit of legal tea
[422]
because the thing is the plaintiff's
[423]
lawyers are not only negotiating on
[425]
behalf
[426]
of the class of people who are injured
[428]
but they're also negotiating on behalf
[430]
of themselves because they're going to
[431]
get a cut of this payout
[433]
sometimes that payout might be ten
[435]
percent of the class payout sometimes it
[437]
might be fifty or sixty percent of the
[438]
class payout but the good news is that
[440]
the court is supervising all of this and
[442]
they're trying to make sure that the
[444]
lawyers aren't taking too too much from
[446]
the class settlement look
[447]
the lawyers have to get paid if it
[448]
weren't for them these suits would never
[450]
be filed but there's a fine line between
[452]
being compensated fairly for your time
[454]
and also just getting a huge windfall
[456]
but in addition to the plaintiff's
[458]
lawyers there's also the class
[459]
representative
[460]
to be able to file a class action you
[462]
have to have an individual who
[463]
represents
[464]
the rest of the class fairly and that
[467]
person or individuals
[469]
also need to be compensated generally
[471]
they're not paid all that much
[473]
maybe five to ten thousand dollars at
[475]
most and sure that's a lot of money but
[477]
your average class
[478]
representative is going to put in a lot
[479]
of work they're probably going to need
[480]
to be deposed they'll have to
[481]
talk to the lawyers and i wouldn't wish
[483]
that on anyone so
[484]
in the grand scheme of things the payout
[486]
for the class representative is usually
[488]
not a huge amount
[489]
as represented by the total payout so
[491]
how much will the class actually get
[495]
well that depends on how many people
[497]
actually take up the settlement because
[499]
it's a bit of a moving target the more
[501]
people that sign up for the class action
[503]
the less each individual gets and
[505]
believe me the fact that i'm making a
[506]
video about this
[507]
is going to give the lawyers who are in
[509]
charge of this settlement both on the
[511]
defense and the plaintiff side
[513]
a complete heart attack because now i've
[515]
publicized this
[516]
suit and the uptick on the number of
[519]
people who are going to
[520]
ask for a class payment is probably
[522]
going to go through the roof so
[524]
sorry guys so what will any individual
[526]
class member get as a result
[528]
if they participate in this class action
[530]
well you have to look at the settlement
[531]
agreement but they might be able to get
[533]
a maximum of fifty dollars
[535]
depends on what kind of damages you
[537]
suffered or you have the option to
[539]
receive payment in virtual dollars v
[541]
bucks on fortnite or rocket league
[544]
up to a maximum of thirteen thousand
[545]
five hundred which they estimate to be
[547]
worth about a hundred dollars if you
[549]
have to purchase them in game now of
[551]
course the virtual dollars are not
[552]
actually worth a hundred dollars to the
[554]
game manufacturers despite the fact that
[555]
that's how much it might cost you if you
[557]
wanted to buy them
[558]
so they would much rather you take your
[561]
settlement payment in the form of the
[562]
virtual dollars instead of an actual
[563]
cash payment so people who are members
[565]
of this putative class have a couple of
[567]
options they can
[568]
go to this website they can sign up and
[570]
they can say that they actively want the
[571]
additional benefit of either the cash
[574]
or the virtual dollars as part of a
[576]
payment for this
[577]
class action lawsuit people of course
[579]
can do nothing as well
[580]
that's what most people do they look at
[582]
these emails and these notices and they
[584]
think that this is a complete scam
[585]
they don't want to provide their
[587]
personal information and they just
[588]
simply do nothing
[589]
and this particular settlement provides
[591]
that if they don't do anything they will
[592]
at least get a thousand virtual dollars
[594]
theoretically also you could write in to
[596]
the settlement administrator and you
[598]
could say that you don't want to
[599]
participate in this
[600]
settlement agreement and you can exclude
[602]
yourself from the class the main benefit
[604]
there is that
[605]
regardless of what happens in the class
[606]
you might be able to file suit on
[608]
your own behalf but you'd never want to
[610]
do that because the dollar amounts are
[612]
way way too small and additionally you
[614]
can also attend the hearing
[615]
on this settlement agreement because
[617]
right now we're in the preliminary
[618]
approval stage the court has looked at
[620]
this settlement
[621]
both the plaintiffs and the defendants
[623]
are advocating that the court should
[624]
approve this settlement
[626]
but they need more information they need
[627]
to know how many people are going to
[629]
sign up for the class
[630]
they need to know how many people object
[632]
how many people don't want to be
[633]
included
[633]
in this class because if there are too
[635]
many people who reject the settlements
[637]
then the court might have to tell the
[638]
parties to go back to the drawing board
[640]
and here's one of the craziest things
[642]
sometimes if too many people sign up for
[645]
the benefits of the settlement agreement
[647]
it kind of blows up the whole deal we
[649]
saw this in the equifax class action
[651]
where
[651]
they offered up to 150 per person whose
[655]
privacy rights were violated when
[656]
equifax completely screwed the pooch in
[658]
terms of user privacy
[660]
and then so many people signed up to get
[662]
the 150 dollars it broke the bank and
[665]
the parties had to go back to the
[666]
drawing board again and theoretically
[668]
since
[669]

this is the same process that everyone
[676]
goes through in class action settlements

it starts with notifying the potential
[680]
class usually through email but maybe
[682]
it's through the telephone
[684]
using these janky notices that look like

a scam
[687]
then you have to go to these websites
[688]
that look like they came out of geo
[690]
cities in
[691]
1994 and you then have to provide your
[694]
personal information to sign up for the
[696]
class on the hopes
[697]
that you'll get some sort of payout from
[699]
the settlement agreement and of course
[701]
then you have to wait for the court to
[702]
approve the final settlements
[704]
and then maybe a year or two later you
[707]
might actually get a
[708]
check in the mail or some virtual
[710]
dollars deposited
[712]
into your virtual bank account it takes

a very very long time
