and caesar this is a question that you

know we get a lot not just from people
[22]
that call us but from people that we
[24]
see on the you know people we come into
[26]
contact all the time when they say hey
[27]
what do you do and you say i'm a
[28]
disability insurance attorney and they
[29]
go oh i have that
[31]
is it hard to get approved and what's
[33]
your
[34]
what i mean so many things must be going
[36]
through your mind when you hear that
[37]
yeah i mean it's it's a general question
[40]
it's
[41]
it's relative right so if you're someone
[45]
with
[46]
you know stage four cancer god forbid
[49]
then and and you follow disability claim
[51]
because you're
[53]
terminally ill and you can't function
[56]
and you can't go to you can't go to your
[58]
doctor's appointments you have to get
[59]
transported there or something then
[61]
clearly it's not going to be difficult
[63]
for that person to be approved but for
[65]
the average person
[67]
for
[68]
someone who's going to be potentially
[72]
you know having the nuances of their
[74]
occupational duties
[76]
and the details of their specific
[79]
limitations and they have doctors that
[82]
maybe they're not sure is going are
[85]
going to support their disability claim
[86]
or not sure what they should say

for them to you know

be approved for their disability claim

that person may encounter some

challenges sure

and um

in in terms of when we say get approved

what are other factors in terms of the
[102]
type of policy that a person has that
[103]
could make it more or less difficult to

get approved

well i i just think

when you're you're thinking in different
[111]
types of
[112]
policies one of the things that
[114]
is is really critical is the definition
[118]
of disability right what if if you have
[121]
a disability policy that ensures you for
[124]
disability in your own occupation
[127]
versus a disability standard of being
[130]
able to work in any game full occupation
[132]
then
[133]
just by the definition of disability
[136]
you're going to have a much harder time
[139]
getting approved from disability from
[141]
any gainful occupation than you would
[142]
from disability in your own occupation
[144]
right possibly and i also think one of
[147]
the big things in terms of the type of
[148]
policy you have is whether you have a
[150]
policy that's governed by erisa which is
[152]
usually an employer-provided policy or
[154]
if you're the type of individual that
[156]
bought a policy on your own
[158]
from a disability
[160]
insurance company through the use of an
[161]
agent and you know that's a complete
[164]
situation where you get what you pay for
[166]
because the disability private policies
[168]
usually 10 times the cost per dollar for
[171]
every dollar coverage versus the
[172]
employer provided one
[174]
because the policy definitions are and
[177]
the language is so different and
[179]
one's governed by erisa the employer
[181]
provided one and the other one isn't
[182]
which gives you rights to jury trials
[184]
right innately just by being having
[188]
being an employee benefit policy one
[190]
governed by erisa
[192]
there's going to be huge advantages to
[194]
the insurance company so just by their
[196]
very nature they're going to be much
[197]
it's going to be much more challenging
[199]
to be approved on an employee benefit
[200]
erisa disability claim than it would be
[202]
on an individual disability policy and
[204]
you know and then the other thing about
[206]
is it hard to get disability benefits
[207]
approved is well
[210]
have you seen a doctor
[212]
what's the status of your medical
[213]
treatment touch just briefly why is
[215]
medical treatment so important in a
[217]
disability claim well just from the very
[220]
onset they're disability insurance
[222]
companies and it's because it's a legal
[224]
standard in many places that if a doctor
[227]
does not if you have not seen a doctor
[229]
in and around the time that you stop
[230]
working and what i mean by in and around
[232]
the time within
[233]
a week or two of stopping work and that
[235]
doctor is not saying you need to stop
[237]
working you can no longer continue to
[239]
function uh you know in your occupation
[243]
then
[244]
you're like you know that the insurance
[246]
company could very well challenge your
[248]
claim and say you're not entitled to
[250]
benefits so just from from the very
[253]
onset without that support there without
[255]
having
[257]
seen that doctor within that time frame
[260]
you may not get approved just for that
[261]
reason and then
[263]
you know going forward it's not just
[265]
about establishing that moment that you
[268]
stop working it's about establishing
[270]
every month thereafter because every
[272]
month you have a duty to continue
[274]
proving your disability and to ensure
[276]
that your doctors continue supporting it
[278]
because at any point that that fails to
[280]
happen the insurance company is going to
[281]
deny your claim but does the claimant
[283]
have to keep going to the doctor
[285]
continuously absolutely there's
[287]
appropriate care provisions in these
[288]
disability policies
[290]
now
[291]
sometimes you'll see language that says
[294]
if we deem or if we find and we is the
[297]
insurance company that uh ongoing
[300]
treatment is no longer of a benefit to
[301]
you or you no longer need to continue
[304]
seeing your doctor then we won't require
[306]
it but i often explain to clients and
[308]
into people that it's a trap okay
[311]
because what's happening even though
[313]
perhaps it's being established you don't
[314]
have to you know how long have to see
[316]
your doctor we're not going to require
[318]
as many frequent visits to your doctor
[320]
what you're doing is actually you're
[322]
working against your own claim you're
[323]
working against yourself because the
[325]
documentation is not going to be there
[327]
the recorded history of your complaints
[329]
of your symptoms of your ongoing
[331]
problems of your ongoing limitations is
[333]
not going to be there and you're just
[335]
setting yourself up to be denied so i
[337]
always counsel people continue seeing
[339]
your doctor even if you don't have if
[341]
the insurance company is only asking for
[342]
an update every six months every you
[344]
know every year continue seeing them by
[346]
month every two months or every three
[348]
months at don't let more time than that
[351]
pass by so cesar i think the simple
[354]
answer to can is it difficult to get
[356]
disability benefits paid is to you got
[358]
to be prepared
[360]
and you got to make sure that you have
[362]
appropriate doctor support that you have
[365]
the backing of employers or co-workers
[367]
to have a difficulty i mean you got to
[368]
have a real issue that prevents you from
[371]
being able to either do the duties of
[373]
your occupation if that's what the
[374]
definition of disability is which is
[376]
usually what it is the first two years
[377]
of any policy
[379]
and then possibly unable to do the
[381]
duties of any gainful occupation but it
[383]
is not going to be like the process when
[385]
you bought your policy and you just went
[386]
ahead and applied for coverage and they
[388]
go okay send us your tax returns you're
[390]
approved it's a whole other animal
[393]
