hi i'm jimmy sexton founder and ceo of esquire聽 group and today we're going to be talking about聽聽
[5]
dynasty wealth structures so lately i've been聽 working with a new client with with a lot of new聽聽
[11]
clients who are going through the well-structuring聽 process for the first time and it kind of made聽聽
[16]
me aware of a trend that i thought would be聽 important to address in this video and that is the聽聽
[23]
trend of taking a very short term view of wealth聽 structuring but before we get into the short-term聽聽
[29]
view of wealth structure i want to give a little聽 summary of what wealth structuring is for those of聽聽
[34]
you that don't know so well structuring is the art聽 of designing and implementing structures to hold聽聽
[42]
and manage your worldwide wealth so you can grow聽 it protect it and pass it on to your heirs in a聽聽
[48]
tax advantaged manner according to your wishes聽 now well structuring brings together several聽聽
[55]
different areas of planning the聽 first of which is estate planning聽聽
[63]
now estate planning is pretty self-explanatory聽 it's basically arranging your affairs so that your聽聽
[70]
wealth gets passed on to your heirs in accordance聽 with your wishes the next thing it encompasses is聽聽
[78]
succession planning and a lot of people confuse聽 succession planning and estate planning and use聽聽
[86]
them interchangeably but they're actually very聽 different so while estate planning looks at who's聽聽
[91]
going to receive your wealth succession planning聽 looks at who's going to control your wealth聽聽
[96]
so who's going to manage your wealth once you're聽 unable to or you don't want to anymore the next聽聽
[105]
thing that it encompasses is wealth protection聽 a wealth structure should be able to protect聽聽
[111]
your assets from lawsuits creditors and even聽 divorces even in the absence of a prenup if it's聽聽
[118]
if it's set up properly it also encompasses tax聽 planning so your wealth structure should give you聽聽
[126]
significant tax benefits if it's done right and聽 finally it should provide you with some financial聽聽
[134]
privacy in my view financial privacy聽 is a basic human right and everybody's聽聽
[140]
entitled to it you know unlike what all these聽 transparency advocates claim everybody has a聽聽
[147]
right to privacy it's nobody else's business聽 which you do with your with your wealth and聽聽
[154]
privacy is actually a very key component of wealth聽 protection because they can't take what they can't聽聽
[162]
find so now that we've gone over what wealth聽 structuring is let's talk about dynasty wealth聽聽
[170]
structuring in this problem of a lot of people聽 having a very short-term view so a very typical聽聽
[177]
sort of new client or or a current client that聽 wants to get into wealth structuring says to聽聽
[182]
me is hey i want to put my wealth in a structure聽 that's going to protect it and give me access to聽聽
[188]
it during my lifetime then i wanted to take care聽 of my spouse and that i wanted to go to my kids聽聽
[194]
well that's great right i mean it's very聽 generous that your kids are going to get聽聽
[197]
all this and i'm sure they're going to be stoked聽 when they get a bunch of wealth but you're also聽聽
[202]
putting them in the same position that you were in聽 prior to doing the wealth structuring right so you聽聽
[211]
owned all of your wealth and then you put it into聽 some sort of a wealth structure which is generally聽聽
[216]
a trust or a foundation to provide you with estate聽 planning succession planning wealth protection聽聽
[222]
tax planning and privacy well once you die and the聽 wealth then gets distributed out of this trust or聽聽
[231]
foundation to your heirs they're the same boat you聽 were because they now personally own this wealth聽聽
[239]
and now they need to do their own wealth聽 structuring right so they got to do their聽聽
[243]
own estate planning their own succession planning聽 their own tax planning their own wealth protection聽聽
[248]
their own privacy they have to go through聽 what you went through and invest the time聽聽
[254]
and money to do it properly and this is why i聽 prefer dynasty wealth structures a dynasty wealth聽聽
[261]
structure is essentially a wealth structure聽 that lasts a really long time for generations聽聽
[267]
and the key component of a dynasty聽 wealth structure is that the assets stay聽聽
[276]
in the wealth structure essentially forever so聽 the the because the assets never get transferred聽聽
[285]
to your heirs you get a lot of benefits from聽 this so let me give you an example so assume聽聽
[291]
for a second we set up a well structure for you聽 making yourself your spouse your kids and all聽聽
[298]
your bloodline family descendants beneficiaries聽 now what that means is by making your bloodline聽聽
[306]
family descendants beneficiaries is that anybody聽 descending from your bloodline is automatically聽聽
[311]
going to be a beneficiary of the structure so that聽 means your kids are going to be beneficiaries of聽聽
[316]
this structure their kids their kids and so聽 on for as long as the bloodline goes or as聽聽
[321]
long as the structure is going to exist which聽 can like i said exist for many many generations聽聽
[327]
and then let's all so that's taking care of the聽 estate planning aspect of it right so now let's聽聽
[331]
say we also incorporated a very comprehensive聽 succession plan into this structure by doing so聽聽
[341]
this succession plan is going to聽 outline the process and procedure聽聽
[345]
for managers to be replaced and how the聽 succession of managers should take place聽聽
[352]
so now we have a sustainable structure right聽 we have the beneficiaries outlined that are聽聽
[358]
you know generations of your bloodline and we also聽 have how the management is going to work long term聽聽
[367]
outlined through the succession planning that we聽 did so now what we what we have is we wind up with聽聽
[374]
this wealth structure that owns all the wealth聽 and then you have your kids as beneficiaries
[387]
their kids but the wealth always stays in the聽 wealth structure so rather than the wealth聽聽
[395]
structure distributing the assets directly to聽 the beneficiaries your heirs and then terminating聽聽
[401]
the wealth stays inside of the wealth structure聽 and then makes distributions as needed聽聽
[409]
or up to up to the board depending on how the聽 things set up to the beneficiaries right so聽聽
[418]
assuming that this wealth structure is being聽 managed well and the income is in excess of
[427]
the original wealth that you put in it what will聽 happen is the assets will essentially always聽聽
[433]
stay in the wealth structure and income聽 will be distributed to the beneficiaries聽聽
[439]
and this happens for generations right聽 when your kids die for example then聽聽
[445]
their kids are the beneficiaries and when they聽 have kids then they're the beneficiaries so聽聽
[451]
you just keep having generations and generations聽 getting benefits but the assets are still in here聽聽
[458]
and this comes with a ton of benefits聽 and i'm going to go over them right聽聽
[462]
now so first of all estate planner right聽 you've taken care of the estate planning聽聽
[470]
inside this structure for generations because聽 the wealth will always be owned by this wealth聽聽
[477]
structure your the beneficiaries your heirs are聽 never going to have to worry about doing estate聽聽
[484]
planning for the wealth that is in the structure聽 because you'll have taken care of that for them聽聽
[489]
likewise succession planning because we聽 will have built a sustainable succession聽聽
[497]
plan into the structure it's going to be clear聽 how the management is going to succeed from聽聽
[504]
board to board from manager to manager and聽 so these heirs for all these generations are聽聽
[511]
not necessarily going to have to worry about how聽 they're going to select new managers because we're聽聽
[516]
already going to have laid that out how it happens聽 finally and this is a huge one you're gonna get聽聽
[523]
wealth protection right now your heirs are gonna聽 because they don't own the wealth nobody can take聽聽
[530]
it away from them right that means if they get聽 sued if they get divorced even without a prenup聽聽
[538]
they're not no the people aren't going to聽 be able to get at the wealth because it's聽聽
[541]
not technically their wealth now if the wealth聽 structure made let's say a distribution to them聽聽
[546]
they might be able to get the hands on that聽 distribution because that distribution has聽聽
[550]
become that person's wealth but the bulk of the聽 wealth is going to be self in the wealth structure聽聽
[556]
that is immense right i mean think聽 about the very common conversation that聽聽
[564]
children and wealthy families have to聽 have with potential spouses about prenups聽聽
[568]
it's very uncomfortable right oh you know聽 trust me you know it's very unromantic聽聽
[573]
but if the wealth is in the well聽 structure greatly reduces the need聽聽
[578]
to have a prenup i mean in a lot of cases you聽 don't even need them because the person doesn't聽聽
[581]
have anything everything is owned by the wealth聽 structure so this is a huge huge benefit right聽聽
[588]
finally you're gonna have a tax plan they're聽 built in there right so probably if you had聽聽
[593]
a good advisor uh the wealth structure聽 would have been set up in a jurisdiction聽聽
[598]
that has this tax advantage and so a lot of聽 times you can set up a wealth structure in a聽聽
[604]
tax-advantaged jurisdiction where the wealth聽 is allowed to grow within that structure聽聽
[611]
relatively tax-free or at least at a very聽 much at a very reduced tax rate so that means聽聽
[617]
because there's tax benefits on the income inside聽 the wealth structure the wealth is growing faster聽聽
[625]
because it's not being diluted by taxes now this聽 also gives the heirs a lot of freedom in moving聽聽
[634]
around right because if they personally own this聽 wealth what happens if they move to a country聽聽
[642]
that has estate taxes or wealth taxes or high聽 income taxes right so one the wealth structure聽聽
[649]
when it makes distributions to a beneficiary聽 the beneficiary is probably going to have to聽聽
[653]
pay income tax on that distribution depending聽 on the jurisdiction that they live in聽聽
[661]
but the wealth structure very聽 well could be distributing聽聽
[665]
less income than those assets are generating聽 if if it's generating significant income and if聽聽
[672]
the beneficiary owned those assets outright they聽 would be liable for income tax on all the income聽聽
[680]
that those assets are generating rather than聽 just the portion they received which is likely聽聽
[684]
the portion that they need additionally if they聽 owned those assets individually and they lived in聽聽
[691]
a country that had a wealth tax on individuals聽 they would have to pay that wealth tax but if聽聽
[696]
they don't own the wealth they wouldn't have to聽 pay that wealth tax additionally and this is one聽聽
[701]
of the biggest threats to wealthy families is聽 estate taxes i mean in some countries estate聽聽
[707]
taxes are like 50 that means every time that聽 wealth passes from generation to generation聽聽
[713]
it's being reduced by 50 percent in taxes because聽 it's in the wealth structure it's not passing from聽聽
[720]
generation to generation right it's always聽 staying in here and only the distributions聽聽
[725]
are being distributed to the years which they're聽 paying taxes on but the wealth is still here聽聽
[731]
it's not transferring to anybody generation聽 after generation the wealth is still owned by聽聽
[737]
the wealth structure so there's significant聽 savings on estate taxes and finally privacy if聽聽
[744]
this was set up right and you're a privacy-minded聽 individual then the structure would have been set聽聽
[749]
up in a way to provide financial privacy聽 not only for yourself during your lifetime聽聽
[754]
but also for your heirs and again that's聽 a very key component of asset protection聽聽
[758]
that they can't take what they can't find so this聽 is fruits for these benefits that i really prefer聽聽
[768]
dynasty wealth structures over these sort of short聽 term well structures that eventually distribute聽聽
[774]
everything to the kids and a lot of clients say聽 to me well you know i don't really want to control聽聽
[780]
the assets beyond the grave for generations and聽 generations and i can understand that right i聽聽
[785]
mean you want your kids or or your other heirs聽 to be able to enjoy your wealth but putting聽聽
[791]
it in a dynasty well structure doesn't have to聽 be about you exerting control over this wealth聽聽
[798]
for generations and generations and generations聽 the reason for putting it in in a dynasty well聽聽
[802]
structure are the ones that i've outlined is the聽 estate planning benefits the succession planning聽聽
[806]
benefits the wealth protection benefits the tax聽 planning benefits and the privacy benefits and聽聽
[813]
i think your heirs will greatly appreciate that聽 sort of let's say being unburdened by these things聽聽
[821]
and so my recommendation is if you're considering聽 doing some well structuring take a very serious聽聽
[827]
look at putting a multi-generational聽 dynasty wealth structure in place聽聽
