world of real estate and today we're

here with Ben Rico

Ben welcome thanks Justin Ben is one of

the awesome agents on our team and he is
[18]
a resident of the Arizona lost he sells
[20]
a bunch of condos there and he is
[22]
Secretary of the HOA and so today we're
[26]
taking an inside look at homeowners
[28]
associations and Ben is our local expert
[31]
and so he's gonna share some of his
[32]
inside knowledge with us Ben first of
[34]
all I mean what is an HOA if you hear
[37]
HOA or homeowners association like what
[39]
does that actually mean
[39]
yeah HOA it basically stands for
[41]
homeowners association and if you buy a
[44]
condo or a townhouse or any kind of
[46]
building that has any common elements
[48]
you are automatically a member of the
[50]
HOA cool so I think a lot of people
[52]
think that the HOA is the group of
[54]
people who maybe tell folks what they
[56]
can and can't have on their porch put in
[59]
actuality anyone who buys into that
[61]
community is on the HOA and so what that
[63]
means is you own the home or you own the
[66]
condominium but you also have a
[68]
percentage stake in what's known as the
[70]
common elements of the romani that's so
[72]
common elements could be a pool it could
[74]
be a gym it could be any of the exterior
[76]
and as a member of that HOA you have a
[79]
responsibility for maintaining those
[81]
common elements in your experience would
[83]
you say that people have generally a
[85]
positive or negative perception of the
[87]
HOA are people like yes this is good or
[89]
they are telling me I can't put plants
[91]
on my own my balcony yeah I think I
[93]
think the perception of the HOA is that
[95]
kind of busybody resident who runs
[97]
around with a clipboard and it's telling
[99]
people they they can't have certain
[101]
things on their patio or but in
[104]
actuality what an HOA does is they
[105]
really just help maintain those those
[108]
common elements but yeah overall the
[111]
perception is that there are people who
[113]
are trying to tell you what to do so how
[115]
did you get on the HOA board are you the
[117]
busy like you normally walk around with
[119]
a clipboard you're like yeah this
[120]
gonna be really great how did you how
[122]
did you get on the HMA personally yeah
[123]
it's kind of interesting I'm the kind of
[124]
person who doesn't like it when people
[126]
tell me what to do and I like to stay
[128]
out of people's business as much as I
[129]
can but it got to the point where when I
[132]
moved into the Arizona lofts I didn't
[135]
really have any interest in it yeah and
[138]
then it got to the point where I noticed
[139]
our property management company wasn't
[141]
doing some things so one day they told
[145]
us that they were going to remove some
[147]
bikes that looked to be abandoned they
[150]
sent it out by an email and I was
[152]
thinking to myself okay I need to label
[154]
my bike to let him know that it's my
[156]
bike and it's not abandoned and they
[160]
didn't put any signs up they didn't do
[162]
any notice other than one email and then
[164]
usually it takes these guys and wants to
[166]
change a light bulb but the day that
[168]
they said that they were gonna start
[170]
removing bikes they were out there with
[171]
bolt cutters early in the morning and so
[173]
many residents got their bikes taken oh
[175]
my goodness yeah and I love bikes you
[177]
know my legs and when I saw this happen
[180]
I was just I was so upset that I went to
[182]
a board meeting and I never been to an
[184]
HOA board meeting but what are those
[186]
meetings like yeah so it depends on the
[188]
community right so some board meetings
[190]
you know they start out with some
[192]
announcements they make sure that they
[193]
take care of all the business and then
[195]
they just kind of open up the floor when
[197]
we when when I went to my first board
[200]
meeting it wasn't like that it was chaos
[202]
he just opened up the floor right away
[203]
and it was an area of grievances
[205]
so it's on your community honestly so I
[208]
walk in I was like wow there's you know
[209]
there's a problem with the property
[211]
management company they're taking
[212]
people's bikes I'd say there seems to be
[214]
a problem with organization on the board
[215]
and so I volunteered to search for a new
[218]
property management company that I got
[220]
on a committee and we started looking
[221]
for a new management company and the
[223]
more I learned about the how the process
[225]
worked the more I saw that maybe some
[226]
changes need to happen on the board
[228]
there are a lot of people that they they
[229]
just they were burnt out yeah and so is
[232]
this thing that has got to be something
[233]
this is completely volunteer right not
[234]
getting paid she did it slightly
[236]
volunteer and I don't blame them for
[237]
kind of being tired of it because in the
[239]
past a lot of people didn't want to be
[241]
on the board and so they had
[243]
taking on this burden for themselves for
[245]
a long time and and they were ready for
[248]
kind of a changing of the guard and so
[250]
the other people with me on that
[251]
committee we ended up joining the board
[254]
I didn't really want to join the board
[255]
but there for her there weren't a whole
[258]
lot of people that were chomping at the
[260]
bit to do it so since I kind of already
[261]
had an inside look into how it worked
[264]
that's what got me on there and yeah we
[267]
started we made changes we changed the
[269]
property management company we got new
[270]
landscapers we got new custodial staff
[273]
so what's been your perception now that
[275]
you know that you've done it have you
[276]
enjoyed it is it a lot of work if
[278]
somebody is in a HOA and they're
[280]
thinking about hey maybe I do wanna get
[282]
involved maybe I did what kind of like
[283]
first hand info could you share with
[285]
them I think if you have a good team
[286]
it's not that much extra work so you
[288]
need to have some other people with you
[290]
who are really energetic and wanting to
[293]
make this community better so if you see
[295]
some problems with your community I
[296]
always say you know you can't complain
[298]
if you don't get involved especially
[300]
with Asian you can but it's not helpful
[302]
Lydia people can but yeah this is that
[303]
helpful yeah so if you want to get
[305]
involved go to go to when hom you go
[307]
check out what's going on in the
[308]
community you learn about your board
[309]
members learn about how decisions are
[312]
being made and if there's a way that you
[315]
think you can contribute then do it and
[316]
it doesn't take that much extra time I
[318]
spend a couple hours a week you know
[320]
looking at some bids that have come in
[322]
responding to emails and just kind of
[325]
making sure everything's organized but
[326]
otherwise it's not a huge time
[328]
commitment especially if you have other
[329]
people you know that you can lean on so
[331]
if I heard you right I mean the very
[332]
first thing to do is if you want to make
[333]
a change or get involved is to actually
[335]
go to the meetings and start to do
[339]
things and be present is that step
[341]
number one real that's correct yeah
[342]
usually HOA board meetings happen once a
[344]
month and the board members really they
[346]
want people to come and be involved and
[348]
that they want people to form committees
[349]
because they're volunteers they don't
[351]
this is not their full-time job I think
[354]
a lot of one big misconception with HOAs
[356]
is that they are the property management
[358]
company and that's important yeah yeah
[360]
distinction to make is the HOA will hire
[363]
a prop
[364]
management company to execute a lot of
[366]
the decisions that they've made now but
[368]
the board itself is resident volunteers
[371]
and so what does what are the main
[373]
functions of the property management
[374]
company so you hire the property
[375]
management company then what are the
[376]
main things they do right so they'll
[379]
take care of any maintenance that needs
[382]
to happen so the board members aren't
[383]
out there doing the one you're not
[385]
you're not getting a call at midnight
[387]
hey my toilet stops up will you come fix
[389]
this I don't know I don't do that yeah
[391]
that's that's part which the property
[392]
may be company doesn't do that either
[393]
actually but yeah right so yeah they we
[397]
have fountains they you know hire at the
[399]
fountain breaks then you hire somebody
[400]
to fix that we have gates at the gate
[402]
breaks they hire somebody to fix that
[404]
and so what we do is we like to think of
[406]
ourselves as managing the property
[408]
management company yeah and just making
[410]
sure they're doing their job and that's
[412]
where I think a lot of it show is kind
[413]
of you know fall short occasionally is
[416]
there not keeping track of what the
[417]
property management company is doing so
[419]
that's always a good question to ask
[420]
when you're thinking about joining an
[421]
HOA community is who's your property
[423]
management company what kind of
[425]
oversight you have over them and you
[428]
know what's your relationship how many
[430]
contact hours does the property manager
[432]
have on the property because a lot of
[434]
times maybe this property manager
[436]
manages eight other properties and you
[439]
might not be the highest priority so
[440]
there's a difference between full-time
[442]
managers part-time managers and things
[443]
like that that's a perfect segue because
[445]
the next question that I was gonna ask
[446]
is for people out there who are
[449]
considering buying a property that has
[452]
an HOA what sort of due diligence do you
[455]
advise our clients to do up front when
[458]
they're considering buying in a property
[461]
that has an HOA yeah there's some really
[463]
particular questions you want to ask as
[465]
a buyer and as a buyer's agent whenever
[467]
you're considering you know purchasing a
[470]
home in an HOA first of all you want to
[471]
get a good feel of their budget right so
[474]
you can ask a copy of their ask you can
[475]
ask for a copy of their budget there
[477]
they should give it to you and you want
[479]
to really look at one particular thing
[481]
which is there
[482]
Reserves reserves it's basically a rainy
[485]
day fund if something goes wrong that
[487]
wasn't expected they can pull money out
[489]
of those reserves to pay for it that's
[491]
not going to affect the overall budget
[492]
of the community if you're seeing that
[495]
the reserves are being pulled from
[497]
frequently or that it's at a dangerously
[499]
low amount then there might be a problem
[501]
with that community it might be the case
[503]
that they're gonna do a special
[504]
assessment which is which is what yeah
[506]
special assessment is when something
[508]
can't get covered by the reserves or
[510]
it's gonna take the reserves down to low
[511]
and they just require everyone to fork
[514]
over some money and it's is there
[515]
anything you can do about that or it's
[517]
basically like hey tough luck you gotta
[519]
pay it so there's some protections for
[521]
residents the board can't just say
[523]
everybody owes $10,000 they can't do
[525]
that right so there's a limit to how
[527]
much the board can unilaterally ask
[529]
residents to pay which is usually about
[531]
$200 a unit or something like that but
[534]
if there's a need for a big thing like
[536]
the whole roof needs to get replaced
[537]
it's outside of warranty it costs
[539]
millions of dollars do the community can
[542]
vote and if the community decides that
[544]
it's in their best interest to pay this
[546]
money then they can vote for it and
[549]
everybody pays their share yeah and
[551]
sometimes the that's just what's
[553]
required it makes me think of a building
[554]
that painful years ago had a big problem
[557]
with the parking garage and there was no
[558]
choice but to fix it but it was ultra
[560]
expensive and there was a huge special
[563]
assessment which obviously impacts me if
[565]
you're living there but it also impacts
[567]
the saleability
[568]
of your unit because you know the new
[571]
buyer either you're gonna pay it or
[573]
they're going to take it on if they're
[575]
paying in installments and that can be a
[577]
big impact for somebody because it's
[580]
changing your monthly setup a lot or you
[582]
just gotta end up paying at all upfront
[584]
instead of paying it overtime right
[586]
yeah it just depends on how they set it
[588]
up but yeah that's a risk you know with
[589]
joining a community with an HOA but of
[591]
course that risk is distributed among
[593]
all the other residents you're not just
[595]
all on you as an individual so that's
[596]
you know there's benefits
[598]
there's also that risk that yeah you
[599]
might have a special assessment so
[600]
that's another good question to ask and
[603]
then usually we ask for a copy of their
[605]
bylaws you know their rules and
[606]
regulations a big thing for a lot of
[609]
people is they want to know if there's
[610]
rental restrictions
[611]
mm-hmm because some people think maybe
[614]
I'll hold on to this property for a year
[615]
I'll live there for a year but then I'll
[617]
rent it out when I guess but a lot of
[618]
communities they have a certain
[621]
restriction on how many people can be
[622]
renters and so you always want to ask
[624]
that question as well when you're
[625]
looking at H OS yeah these are great
[626]
questions and so we'd well maybe on some
[628]
of the issues or challenges but I mean I
[631]
love that you mentioned you know the
[632]
risk is spread over everybody what are
[634]
some of what is to wrap this up what is
[636]
one of the best things about being
[638]
somewhere where there is an HOA yeah I
[640]
love it I live in a community with an
[642]
HOA I'm in Arizona lofts and when I
[644]
owned my own home the exterior the yard
[647]
the trees the roof it was all on me it
[651]
was all on my shoulders and that was a
[653]
big burden I had a 1940's bungalow and
[655]
he's still Anna and you know you just
[657]
never know when that shoes gonna drop
[658]
and so you know if you take a look at
[661]
you know what requires a special
[663]
assessment for an HOA right maybe I'll
[667]
have to pay out a little bit to cover
[669]
something but it's gonna be distributed
[670]
among other residents yeah when a tree
[673]
goes through my roof right or if I need
[676]
to dig up my front yard because my
[677]
galvanized pipes you know closed in on
[679]
itself that's on me yeah 100% it's
[683]
basically everything in a single-family
[684]
home is a special assessment right
[686]
anytime anything happens there's a
[687]
special assessment and you take 100% of
[689]
that assessment everything's a service
[691]
every trip to Lowe's is a special
[693]
assessment so yeah for me it's nice to
[697]
know that my my responsibility is being
[699]
spread out among other people and it's
[701]
also nice to know that you know we have
[703]
a very active board that's going to make
[705]
good decisions for that community
[707]
they're gonna manage our finances well
[708]
they're gonna pick the right people to
[709]
do the construction and you know at I
[712]
don't have to worry about yard work yeah
[714]
it can take a lot of things off your
[715]
plate first sure yeah take a lot of
[717]
things off your plate which is awesome
[718]
