before this crisis we entered into

leases a lot of us thought we could pay

the leases and have no problem but some
[33]
of us have lost our jobs and we're
[36]
running out of money and we don't know
[38]
what to do we don't know how to make
[40]
that next lease payment and so we've got
[42]
to get out of the lease the right way
[44]
but we want to be fair also to the
[47]
landlord I'm like you I got in a
[48]
situation where I couldn't afford my
[50]
lease payments and I needed to get out
[52]
of the lease so I took a three step
[54]
process that I created and I was able to
[57]
work with the landlord to get out of my
[59]
lease and not have to make those
[61]
payments in this video I'm going to show
[62]
you that three-step process so maybe you
[65]
could follow these steps and get out of
[67]
your own lease so that you can kind of
[69]
reconsider your financial situation

maybe cut costs step number one is to
[73]
read your lease if you do not have a
[76]
copy of your lease you should email your
[79]
landlord and ask for a copy when you get
[81]
it you should look at the terms of the
[84]
lease specifically you should look at a
[86]
term called breach of contract early
[88]
termination generally what this Clause
[91]
says is that if you want to leave the
[93]
lease you want to break the lease and
[95]
you want to leave your home early then
[97]
you're gonna owe all the rent you would
[100]
have had to pay to the landlord even
[102]
though you're leaving early also these
[104]
provisions usually require that you pay
[107]
any costs that the landlord is going to
[109]
have to expend to release that property
[113]
these clauses also usually contain a
[115]
provision which says that the landlord
[118]
can keep your security deposit to guard
[121]
against those costs he's going to have
[122]
when he releases the premises I had a
[125]
similar provision in my lease you know I
[127]
didn't want to pay these costs the
[129]
remaining rent and the cost that the
[131]
landlord was gonna expend
[132]
maybe agency Commission's or advertising

I didn't want to pay those things but I
[137]
knew from reading my lease that I was
[139]
legally obligated to pay these to the
[141]
landlord so I approached the situation
[143]
with modesty I understood that the
[146]
landlord did not have to make a separate
[148]
deal with me and that at once I
[150]
understood that that set me up for a
[152]
good negotiation the only way to get out
[155]
of a lease that's been signed and
[157]
delivered and dated is to be able to
[159]
enter into a separate agreement with the
[162]
landlord and one of your key issues when
[164]
you're dealing with this is to figure
[165]
out what your landlords interest is what
[168]
value can you offer your landlord to get
[172]
him to convince him to do a different
[175]
agreement than the leash you already
[176]
agreed upon so you have to be humble
[178]
when you're considering breaking a lease
[180]
leaving it early you know the landlord
[182]
is already entitled to certain payments
[184]
for you so you should be thankful that

he or she is even willing to consider an

alternative arrangement so step number

two is to figure out what value you can

offer the landlord to entice him to let

you out of the lease early in my case I

knew that the landlord's main concern is

he wanted the quiet tenant who paid his

rent on time so I went back to the lease

I went to the provision that talked

about assignment and subletting you

probably have a similar provision in

your lease it basically says that the
[215]
tenant cannot release the premises

without the landlord's consent however

most of these clauses also contemplate
[224]
that the tenant can release the premises
[227]
so long as the landlord approves so I
[230]
decided to take advantage of this clause

I found a friend who needed a place to
[235]
stay I said listen do you like my place
[236]
he liked my place and I said how much
[239]
rent can you afford he gave me a number
[242]
and that number was approximately three
[244]
hundred dollars less than the amount of
[245]
rent that I was paying for the current
[248]
lease I said listen
[249]
if you could just pay that amount that
[251]
you can afford would you like to live in
[253]
my place for the remaining term he said
[255]
yes and so I came up with an arrangement
[257]
where I would pay the difference between
[260]
the lease payment and what he could
[262]
afford and we're gonna try to work a
[264]
deal with the landlord so now
[266]
I had the second piece of the puzzle to
[268]
try to get out of this lease early
[270]
complete and now I was ready to move on
[272]
to step number three step number three
[275]
is to enter into a lease amendment with
[278]
the landlord so this is the situation I
[281]
have the existing lease I have a new
[283]
tenant who likes the premises who can't
[285]
afford the total lease payment but can
[287]
afford a lot of it and so now we have a
[290]
situation where we want to enter into an
[291]
agreement with the landlord that would
[293]
allow me to pay the difference between
[295]
the rent paid or the rent owed and the
[297]
amount that the new tenant could afford
[299]
and get that in writing so that I can
[302]
get out of the lease and not have this a
[304]
huge expense so what we decided to do
[306]
was put together a lease amendment and a
[309]
lease amendment is basically just a
[311]
written change to an existing lease
[313]
agreement once I took down the details
[315]
of the arrangement with the new tenant
[317]
in the lease amendment I was ready to
[320]
approach the landlord and I did I went
[322]
to him and I explained the hardship that
[324]
I was facing for this particular lease
[326]
and I also said I took it upon myself to
[329]
find a new quiet tenant who would timely
[332]
pay the rental payments and the landlord
[334]
was taken aback but he liked the
[337]
initiative that I displayed by getting
[339]
that new tenant all we had to do was do
[342]
a credit report on the new tenant to
[344]
make sure that he had the financial
[345]
wherewithal to make the payments and
[347]
then we were ready to go and I wasn't
[350]
empty-handed when I approached the
[351]
landlord I came with my own written
[354]
lease amendment which dictated the
[356]
details of a deal
[357]
you know the landlord was happy about it
[359]
because he didn't have to draft his own
[361]
lease amendment I had it all down on
[362]
paper ready for him he reviewed it and
[365]
he okayed it and eventually he signed it
[367]
so when the landlord signed the lease
[369]
amendment I felt great
[371]
I had just traded a huge lease expense
[373]
for a much smaller one I had helped a
[375]
friend move into a new place that he
[377]
really liked for an affordable price and
[379]
now I was free to go out and find
[382]
another place that was much less
[384]
expensive and this was all because of
[386]
this lease amendment I spent a lot of
[388]
time drafting this lease amendment so it
[390]
could apply to a number of different
[391]
situations you could use it if you
[393]
wanted to get out of a home lease or out
[395]
of an apartment lease or also a
[397]
commercial building lease if
[399]
