about the importance of lease signing

and all the things that go into having

an effective lease signing meeting with

your new tenants

I have Joshua here say hi Joshua how you

guys doing Joshua is our property
[17]
manager and I thought he's doing these
[19]
every day with our tenants and our new
[21]
tenants so I figured I would interview
[22]
him asking a couple questions and then
[25]
together we're gonna actually go through
[27]
line by line the things that we go
[29]
through with tenants when we're sitting
[31]
down and doing a lease signing which is
[33]
a very exciting thing in this real
[34]
estate investing gain but we thought it
[37]
was probably one of the biggest things
[39]
up landlords don't they don't really
[41]
properly prepare and then I'll properly
[43]
do so we thought this would be a great
[45]
topic to share with everyone here on
[46]
BiggerPockets and so with that I'm gonna
[49]
ask my first question so Joshua you've
[52]
done a lot of these lease signing
[53]
meetings and you know with our with our
[56]
prospective tenants and our new tenants
[57]
what do you think is the most important
[60]
thing that things that new landlords
[63]
need to do as well as existing landlords
[65]
when it comes to lease sign well I think
[67]
um it's important that the landlord
[69]
that's conducting that lease signing set
[71]
themselves up for success and a good way
[73]
to do that is to develop a system a
[75]
checklist of some sort and by doing that
[78]
it allows them to be consistent in their
[80]
approach to each lease signing that they
[81]
do and if they end up having someone do
[84]
it for them they at least have a system
[86]
in place that they can train that person
[87]
to follow up in and definitely have a
[91]
nice reputation in the air who presiding
[93]
well on it when it comes to you know the
[96]
lease process most people think it's
[98]
just a matter of signing a lease and
[100]
being done with it
[101]
what are you talking about a process why
[102]
do we need a process but actually
[104]
there's a lot more that goes into
[105]
preparing and the preparing at least
[109]
that the items that you know really that
[110]
go along with the lease and I want to
[112]
explain that
[112]
so again what we really want to get
[115]
through to you is that it's not just the
[116]
lease the lease is the most important
[118]
but there's a lot of other things that
[119]
go along in this process absolutely to
[122]
make sure you're starting off on the
[123]
right foot this is the first step to
[125]
onboarding your new tenants so it's
[127]
pretty important so with that we're
[129]
going to go through
[130]
the 16 items that we have on our
[132]
handy-dandy checklist okay and we're
[134]
going to walk walk you through each of
[136]
them I'm going to take half and then
[137]
Joshua's gonna go through half so the
[139]
first one that we want to recommend to
[142]
you is prepare three sets of keys for
[145]
your new tenants so you might be saying
[147]
why three sets number one you want to
[150]
have an extra set in your office or
[152]
wherever you keep your keys number two
[154]
obviously you're going to give a copy to
[155]
the tenants and three you want to have
[158]
an extra and the extra is when the
[160]
tenant may lose their keys or what have
[162]
you and that has happened a lot right
[164]
locking out and that happens a lot so
[166]
three steps wide it's the first thing on
[168]
the checklist or should be the first
[170]
thing on your checklist is because
[171]
you're really busy you have a tenant
[174]
coming in the next day to meet with you
[176]
to go over the lease and the least you
[178]
know documents and then they get there
[180]
and you're like oh no where are the keys
[182]
and you don't always have the keys
[184]
preparing it might seem kind of obvious
[185]
but I gotta say that's one that will
[187]
sometimes get missed if you don't have
[189]
this front and center second thing
[191]
second thing you have to have before as
[194]
you prepare your kind of lease process
[195]
number two is you want to have obviously
[197]
the lease that's pretty obvious but what
[200]
I recommend to you is when you are going
[202]
through the lease with people and I'm
[204]
sure you do this Joshua all the time
[205]
every single page when you're going
[207]
through the highlighted information with
[209]
them have an initial each page so they
[212]
shows their kind of commitment to I
[215]
heard you say that about noise or
[218]
illegal activity etc so have an initial
[220]
each page that's the second room number
[222]
three you always want to get a copy of
[224]
the driver's license every single person
[227]
that's going to be living in that unit
[228]
right so that and that could be driver's
[230]
license or anything equivalent to a
[231]
driver's license a passport would have
[234]
you number number four is the security
[237]
deposit obviously you know for New
[239]
Jersey it's one of one and a half months
[241]
rent other states and then we do some
[244]
work in Pennsylvania as well it's one
[245]
month it's a first month and at last
[247]
month first month next month Josh mine
[249]
knows more about this too but so
[252]
regardless you got to know what your
[254]
state requires and what's kind of legal
[256]
to charge is a security deposit but
[258]
really we leave our rentals in Jersey
[260]
and Pennsylvania so that's what we're
[262]
we're
[262]
so no no it's no it's required and and I
[265]
obviously implement that where we got
[268]
the big thing obviously is the first
[270]
month's rent and this might seem obvious
[272]
but we've had people we've talked to new
[274]
landlords or even existing landlords
[276]
where they give over the keys and you
[278]
know the tenant has some of the money I
[280]
would be very wary of that so that's a
[283]
requirement you need to have obviously
[284]
the first month's rent again might seem
[286]
obvious but we've heard stories that
[287]
would would not always have that as the
[290]
situation next part we have a thing
[293]
called the utility transfer agreement
[295]
what I mean by that is I'm sure you've
[297]
seen this and you you Joshua experiences
[300]
this because he ends up following up
[301]
with our tenants that haven't switched
[303]
over the utilities but when you're
[305]
renting to a tenant a person in a
[307]
multi-family not so much a single-family
[309]
home but a multi-family by the utility
[312]
is often need to get transferred right P
[314]
you know electric gas water and tenants
[317]
don't always do that as quickly as you
[319]
need them to so we actually have an
[320]
agreement and we charge them a fee if by
[324]
a certain date that they don't switch
[326]
over their utilities pretty simple but
[328]
we actually make that a pretty important
[330]
point so because we've had that where we
[333]
continue to get the bills when the
[335]
tenant is already there so you want to
[336]
protect yourself next thing and our
[339]
lovely checklist is that we have this
[342]
thing called truth and renting and it's
[344]
a basically it's a policies and
[346]
protection for the tenant in the state
[349]
of New Jersey most landlords don't give
[351]
this out they don't speak of it but it's
[353]
a it's from a legal perspective it's
[355]
really important to give this out so
[357]
tents do know their rights that is
[358]
important you want to be the landlord
[360]
that actually shares you know that with
[363]
them roasts versus making believe
[365]
there's there's none so you know they
[367]
have rights and you want to make sure
[368]
that they know them and that you're
[369]
doing what's that's right in the eyes of
[372]
the law the last one actually I'm gonna
[375]
take I was taking half of this and
[377]
Joshua is taking another half and I was
[378]
about to get into his part so I'm going
[381]
to give the floor to Joshua I just
[382]
shared about half of the important forms
[385]
and pieces of our lease signing process
[388]
and and kind of procedure and Joshua is
[390]
gonna take the next half yeah so like
[392]
you know we talk about taking care of
[394]
our tenants and send them up for success
[395]
with two for renting
[397]
same thing goes with lead-based painting
[399]
documents that we give them it's pretty
[401]
much a document that allows the tenant
[404]
to understand that we don't want them
[406]
licking the walls and different things
[407]
like that certain houses you know have
[410]
been do certain paying jobs and
[412]
different things of that nature so let
[415]
base paint document moving on from that
[418]
one though we have move out charges and
[420]
this is an important one yeah this is
[423]
very important we like to make our
[424]
tenants aware upfront of what the
[426]
charges look like if after they leave
[428]
from the place and move out when we go
[431]
back in there we're looking at this
[432]
place we're looking at the charges and
[434]
we're going to look at this sheet that
[435]
they signed that they agree to and if
[438]
there's anything that we need to make
[439]
charges out the security deposit is
[441]
going to be referenced out of the sheet
[442]
so that's a very important one
[445]
we went out from that one is smoke
[447]
detectors carbon diet carbon monoxide
[450]
detectors this sheet is just a sheet
[453]
that again just makes the tenant aware
[455]
that they share some responsibility
[456]
making sure these different parts to the
[459]
house are up to where they should be to
[462]
make sure that their family's safe but
[463]
also and liability reasons too we want
[466]
to make sure that they're on top of that
[468]
the next area is ten emergency contact
[472]
information which is very important
[474]
because what happens is if we can't get
[477]
a hold of the tenant because they've
[478]
changed a number or something like that
[480]
this allows us to get over there you
[484]
know family member but also in the event
[486]
of emergency the sheet is an emergency
[487]
contact sheet so any event of mercy we
[490]
need someone to contact it this sheet
[492]
helps us have a third party that they
[494]
are connected to if we need to get in
[496]
touch with them or if we need to notify
[498]
people and I'll just add one more
[500]
another reason for the emergency contact
[502]
information is that if you ever in a
[504]
collection situation which we are you
[508]
know we working with a great collections
[509]
agency right now where we give them all
[511]
that so now they have more information
[513]
about that person so it actually has two
[515]
you know two good reasons why you want
[517]
to get that emergency contact for
[518]
everyone that's going to be living
[520]
the unit not just for the person signing
[521]
the lease you want that emergency
[523]
contact sorry taking Joshua's Thunder

that's just how I am

yes she's obviously writes a collection
[531]
so emergency contact infos very
[533]
important to this whole process pet
[535]
agreement form you know whether they
[538]
have a pet or not you know you can
[539]
determine that on your lease but it's
[542]
important to have something set up where
[544]
if you're gonna charge an extra that's
[546]
entirely up to you but it's important to
[549]
have some guidelines some agreement
[550]
their pets can make a mess if not
[553]
supervised so I'm handing over the keys
[555]
after that that's a given but I also
[558]
provide we like to provide them our
[561]
contact information it's not so much
[562]
just us contact their contacting them
[564]
but they have to get all of us so we try
[567]
to be as clear as possible how the
[569]
different forms of different avenues
[570]
that they can reach us and then lastly
[573]
in the state of New Jersey at least we
[575]
know this to be true as we have them
[577]
sign a w-9 form or a w.a form and that's
[580]
just a form that the banks over here
[583]
require that would give our tenants when
[585]
it's time to do a security deposit and
[587]
within those banks and stuff like that
[590]
so thank you yeah exactly so you want to
[593]
make sure you're gonna obviously be
[595]
giving your security deposit over to a
[597]
bank and and then gonna have certain
[599]
requirements certain forms that need to
[601]
get signed from the tenant not just not
[603]
just you so you need to figure out what
[606]
that is for your own state but for for
[608]
Jersey it's actually New Jersey it's a
[611]
w-9 form or aw8 form because sometimes
[614]
there's different forms for people who
[616]
are US citizens and non-us citizens so
[618]
you just want to make sure you're using
[619]
the right forms the only other thing you
[621]
missed was the same appreciation
[623]
absolutely so what is that job tell
[626]
everyone so every landlord has a
[628]
different approach some landlords
[629]
believe or not don't do this but we
[631]
prize ourselves we're proud of this
[633]
process of pretty much we have them oh
[636]
there's a sheet that we give them at
[638]
least signing making them aware that we
[641]
have
[641]
a program or something that's in place
[643]
where if they pay rent on time every
[646]
month at every corner they get into kind
[649]
of like a rolling up contest the contest
[652]
yeah a fun contest and then polling you
[654]
know and if their name gets pulled out
[656]
then they get a $50 gift card or at the
[659]
end of the year if they paid on time the
[661]
entire year then we give them a TV so
[663]
there's more details to that but you
[664]
know that's pretty much what it looks
[666]
like in movie should we share that with
[668]
them at that point before they even you
[671]
know before they even became a tenant
[672]
for a long time they write the beginning
[674]
you want to teach them how we're going
[676]
to reward for not just obviously you
[678]
know not victim but most importantly
[681]
like a positive incentive yeah it's not
[682]
in contrast yeah I think it puts a I
[685]
think it puts them in a good step
[686]
forward yeah and encourages them to want
[688]
to pay on time that they have any idea
[690]
not to you know so so I hope this was

lease signing process is more than just

the lease it's actually a process and

you should have a you should have a
[711]
system you should do it consistently and
[713]
you should create forms that are the
[716]
biggest things that people either miss
[718]
or the biggest things that can you know
[720]
bite you you know at a later date so you
[722]
want to really protect yourself and
[723]
we've had a lot of luck with that and we
[725]
create a little checklist so we don't
[727]
forget anything so I hope this has been
