long-term disability benefits you can appeal聽 the decision. This is your right and the聽聽

What is it administrative appeal? The appeal聽 is a formal request for a reconsideration of an聽聽

unfavorable decision made by the insurer, such聽 as a denial, a reduction, or a termination of聽聽

benefits. The process involved in a long-term聽 disability appeal depends upon the type of聽聽

LTD policy your claim is under. You may have an聽 employer-funded group disability plan which falls聽聽

under federal ERISA regulation or you may have a聽 private or individual disability insurance policy聽聽

which you bought yourself. Private LTD聽 claims are regulated by state insurance laws.聽聽

The laws regulating in each type of聽 disability insurance claim are very different.

ERISA, the employee retirement income securities聽 act is a federal law that regulates most group聽聽

disability insurance benefits provided by聽 employers, professional associations, or unions.聽聽

ERISA long-term disability appeals must follow聽 an extensive administrative appeals procedure.聽聽

You will have a deadline of 180 days聽 in which to file your initial appeal.聽聽

The administrative appeals process聽 is critical. The appeal becomes聽聽

the framework for the successful outcome of your聽 entire case. You need to be vigilant and fully聽聽

develop the record with pertinent evidence, such聽 as; medical records, medical expert opinions,聽聽

vocational expert opinions, letters from employers聽 and friends, medical literature and photographs.聽聽

You need to effectively argue聽 against the insurance company's聽聽
