killed yep it may be true this case is

wild hey legal eagles it's time to think

like all of the lawyers that YouTube

just hired to go after a copyright troll
[32]
who may have been trying to extort a
[34]
bunch of individual creators YouTube has
[37]
filed a federal lawsuit against a
[39]
YouTube creator who they claimed was
[41]
trying to extort fellow creators and
[43]
actually may have swatted one of them
[45]
now before I begin I want to emphasize
[47]
that these are only allegations all of
[50]
these facts come from the complaint that
[52]
YouTube filed in federal court a
[54]
complaint is the document that you use
[56]
to start a lawsuit and it contains your
[59]
side of the story
[60]
YouTube is the plaintiff here that means
[62]
they started the lawsuit and because
[64]
we're still in the very early stages of
[66]
this particular lawsuit all of the facts
[69]
are gonna come from YouTube so take
[70]
everything with a grain of salt now
[72]
first let me give you some background to
[73]
help understand this lawsuit that
[75]
YouTube is filed Congress passed the
[77]
DMCA in 1998 to deal with copyright
[79]
infringing material online it allows
[81]
websites to not be responsible for
[84]
copyright infringing material that its
[86]
users upload under certain circumstances
[88]
the DMCA is one of two laws that give
[90]
websites a safe harbor the other being
[93]
the Communications Decency Act section
[94]
230 which is something I will definitely
[97]
cover in the future because it is in the
[98]
news every single day these days the
[100]
bottom line is that under the DMCA a
[102]
website isn't liable for copyright
[104]
infringing material so long as they take
[106]
down the offending material when they
[108]
receive a notice from the person that
[110]
owns the copyright this is called a DMCA
[113]
takedown notice you'll find it in 17 USC
[115]
512 which is a totally easy law to
[118]
understand you can look it up by
[120]
searching google for 17 USC 512 now
[123]
youtube asserts in its complaint that
[124]
one Christopher Brady issued a false
[127]
DMCA takedown notice to extort certain
[130]
youtubers people that made minecraft
[132]
video
[133]
basically the complaint alleges that he
[135]
claimed he owned the copyright to
[137]
minecraft and therefore demanded that
[139]
youtubers pay him money or he would
[141]
issue a DMCA takedown a third one now
[144]
YouTube has a system where if you
[146]
receive three DMCA takedown notices your
[149]
channel is deleted when a DMCA takedown
[151]
notice is levied against your channel
[153]
YouTube gives you a strike and three
[155]
strikes and you're out of the YouTube
[157]
game now allegedly Brady would issue two
[160]
DMCA takedown notices and then try to
[162]
extort hundreds of dollars from those
[164]
creators by threatening a third takedown
[167]
notice which would result in potentially
[169]
the deletion of these peoples channel
[171]
now if true this is illegal and violates
[175]
the DMCA section 512 this happens I've
[178]
talked to creators who have dealt with
[179]
false DMCA takedowns I myself have been
[182]
the victim of a false DMCA claim so this
[186]
is definitely something that exists in
[188]
the world but it's also relatively
[190]
unusual the big boys the music labels
[193]
and the movie studios rarely mess around
[196]
with DMCA claims now sure they abuse the
[199]
Content ID system that YouTube has
[201]
created but a DMCA takedown notice is a
[204]
little bit different it's created by
[207]
copyright law and YouTube doesn't have a
[209]
whole lot of control over it basically
[211]
from the people that I've talked to
[212]
behind the scenes none of the big
[214]
players will file a DMCA takedown
[216]
without talking to a lawyer first or
[219]
often they'll have the lawyer issue the
[221]
DMCA takedown why is that because it's a
[224]
big deal as paragraph 8 of YouTube's
[228]
complaint states to submit a takedown
[230]
notice using the forum parties must
[232]
affirmatively check a box next to a
[233]
statement that reads I acknowledge that
[235]
under Section 512 F of the DMCA takedown
[238]
any person who knowingly material
[239]
misrepresents that material or activity
[242]
is infringing may be subject to
[244]
liability for damages if you issue a
[246]
false takedown not only are you liable
[249]
for damages and in other words the loss
[252]
of revenue that comes from the videos
[254]
but you're also liable for attorneys
[256]
fees and when you're talking about
[258]
YouTube that's a lot of fees now I know
[262]
YouTube gets a lot of flack for taking
[264]
down videos pursuant to the DMC
[266]
takedown requests but YouTube actually
[268]
doesn't really have much choice in the
[270]
matter
[271]
that's apart from the whole Content ID
[272]
system which YouTube controls paragraph
[274]
9 of YouTube's complaint says the
[276]
YouTube receives thousands of DMCA
[278]
takedown requests each week through his
[280]
online web forum and also received
[281]
notices by email postal mail and
[283]
facsimile I guess that if anything this
[286]
is probably an understatement
[287]
I guess that YouTube probably deals with
[289]
on the order of millions of DMCA
[291]
takedowns per year and YouTube doesn't
[293]
really have much choice in how to deal
[295]
with these particular claims it's all
[297]
enshrined in copyright law both the time
[300]
frames and the the consequences so if
[303]
YouTube gets a DMCA takedown they don't
[305]
really have much choice but to take the
[307]
video off of YouTube otherwise YouTube
[310]
would potentially lose their copyright
[312]
safe harbor and become liable for
[314]
thousands if not hundreds of thousands
[317]
of copyright infringement actions per
[319]
year so let's talk about the actual
[321]
facts of this case in paragraph 21 of
[324]
the complaint YouTube alleges that in
[325]
January 2019 defendant Brady using
[328]
several falsified identities send you to
[330]
multiple notices of alleged copyright
[332]
infringement pursuant to the DMCA claim
[334]
the two videos uploaded by Kenzo and two
[336]
videos uploaded by Abby raids supposedly
[339]
infringed copyrights that he owned in
[341]
the next paragraph YouTube asserts he
[343]
represented that he was the original
[344]
creator of those videos and that he held
[345]
the copyright to them the complaint goes
[348]
on to assert that Brady tried to extort
[349]
a third youtuber and in fighting one of
[352]
those allegedly false DMCA takedown
[354]
notices that youtuber provided his true
[356]
home address as required by law that
[359]
makes sense that is one of the statutory
[361]
requirements to being able to fight a
[363]
DMCA takedown notice the problem as
[366]
alleged in this complaint is that part
[368]
of the DMCA allows you to issue a
[370]
subpoena to get that information when
[373]
it's uploaded the purpose of which is
[374]
that if you are issuing a DMCA takedown
[377]
you need to be able to take these people
[378]
to court if they file a counter notice
[381]
and put the video back up the complaint
[383]
goes on to assert that on July 10th
[385]
the third youtuber announced via Twitter
[387]
that he'd been the victim of a swatting
[389]
scheme that day and they go on to define
[392]
swatting as the act of making a bogus
[394]
call to emergency services in an attempt
[396]
to bring about the dispatch of a large
[398]
number of armed police
[400]
officers to a particular address if
[401]
that's true that this guy did use the
[404]
information he gained by abusing the
[406]
DMCA takedown process to issue a false
[410]
SWAT call against a fellow youtuber in
[413]
the hope that the SWAT team would be
[414]
called to this guy's actual house that's
[418]
a felony and this guy should be in jail
[419]
this is a despicable act if true people
[423]
have died because of swatting 'z because
[425]
if you're playing a video game that
[427]
involves gunfire and the SWAT team hears
[429]
the gunfire from the outside they might
[431]
come in with guns drawn and people have
[433]
died in the course of being falsely
[435]
swatted the bottom line is that YouTube
[437]
alleges that this particular individual
[439]
Brady falsified DMCA takedowns committed
[442]
perjury and used that information that
[444]
he gained to extort fellow youtubers and
[447]
may have even tried to kill one of those
[449]
youtubers frankly I was astounded when I
[451]
saw this lawsuit being filed by
[454]
YouTube's 17 USC 512 eff does in fact
[457]
give service providers like YouTube a
[460]
private right of action to sue over
[462]
false DMCA takedown notices I've just
[465]
never seen a service provider actually
[467]
file a suit like this if true this seems
[470]
like a very very good thing on behalf of
[472]
most youtubers and a blow against
[475]
potential people who are trying to abuse
[478]
the copyright process for their own ends
[481]
when they don't own the copyright to
[482]
allegedly infringing material this could
[485]
be the first of many lawsuits on behalf
[487]
of YouTube protecting its youtubers and
[490]
if indeed the allegations in the
[493]
complaint are true I think YouTube is
[495]
doing all of us a favor by getting rid
[498]
of some of these YouTube copyright
[500]
trolls I think YouTube is trying to send
[503]
a message against this troll and
[504]
potentially others they have the
[506]
resources to do it and I will repeat
[508]
that we don't know all of the facts this
[510]
is all one-sided so please do not Doc's
[513]
the defendant Brady or attack him in any
[516]
way online let this legal process play
[518]
out YouTube in its prayer for relief is
[521]
asking for compensatory damages
[522]
attorneys fees and an injunction in
[525]
other words a court order that forces
[527]
the defendant to stop this is probably
[530]
bad enough I checked and this case is
[532]
being litigated
[533]
a local firm in Omaha where the
[535]
defendant lives and also by a very
[537]
well-known attorney with one of the
[540]
top-tier law firms Wilson susini which
[542]
is the law firm that has handled Google
[544]
and YouTube's most important and famous
[546]
cases and I was curious how much
[548]
Wilson's tasini charges and according to
[550]
court documents if you can get a 10%
[552]
discount for a lead partner at Wilson
[555]
susini you will only pay $900 an hour in
[558]
other words if this defendant loses
[561]
he'll probably pay on the order of
[563]
$1,000 per hour for hundreds of hours of
[566]
attorney time also parenthetically that
[568]
Phil DeFranco covered this lawsuit
[570]
earlier today and although he did
[572]
generally a great job covering it he put
[574]
some special attention to the end of the
[575]
complaint specifically the prayer which
[577]
asks for such other further and
[579]
different relief as the court deems
[581]
proper under the circumstances kind of a
[583]
question mark saying they pray for such
[585]
other further and different relief as
[587]
the court deems proper under the
[589]
circumstances and so something even
[591]
potentially bigger here he kind of
[593]
freaked out about this that's a totally
[595]
normal thing to put in a complaint it's
[596]
just a catch-all a lawyers cya to allow
[599]
them to ask for something else not
[601]
specifically mentioned in the complaint
[603]
