affected by diabetes. Disability claims filed聽 by those who live with the disease are often聽聽
[34]
denied benefits even though claimants are truly聽 no longer able to work. For a person with diabetes聽聽
[39]
their body can't regulate their blood glucose聽 or blood sugar. Insulin is the main hormone used聽聽
[45]
by the body to regulate sugar. A diabetics body聽 cannot make enough insulin or can't process the聽聽
[52]
insulin produced by the pancreas. Diabetes is a聽 major cause of disability because it affects the聽聽
[58]
entire body. It's identified with many serious聽 complications and disabling symptoms. Disabling聽聽
[64]
chronic conditions may develop, such as; kidney聽 failure, cardiovascular disease, and damage to聽聽
[69]
the retina. Diabetics also experience poor聽 healing of wounds and gangrene and the feet聽聽
[75]
which may lead to feet amputation. People with聽 diabetes also suffer frequently from diabetic聽聽
[80]
neuropathy. Disability claims based on diabetes聽 are routinely challenged by insurance companies,聽聽
[86]
the Social Security Administration, and the聽 Department of Veterans Affairs. If this has聽聽

been your experience it may be time to seek legal聽 help in order to prove you're indeed disabled.

There are specific reasons why the Social Security聽 Administration will deny a claim. Your claim must聽聽
[105]
prove one of two things you must prove that your聽 condition meets or equals the medical description聽聽
[110]
of diabetes found in the Social Security listing聽 of impairments. You'll find diabetes listed聽聽
[115]
under section 9.0, Indra kin disorders, diabetes,聽 meticulous, and other pancreatic gland disorders,聽聽
[121]
or if your condition is not severe enough to聽 meet or equal the Social Security disability聽聽
[125]
listing. You must prove that your condition caused聽 significant functional limitations that disable聽聽
[130]
you from working. In making this evaluation the聽 Social Security Administration considers your age,聽聽
[135]
education, work experience, and your residual聽 functional capacity. Social Security recently聽聽
[142]
changed the requirements in their listing for聽 section 9.0. The section now states that you聽聽
[146]
meet or equal a listing by showing that diabetes聽 affects a specific area of your body. The Social聽聽
[152]
Security Administration then evaluates聽 the affected body system. In other words,聽聽
[156]
instead of being found disabled under Section聽 9.0 for diabetes you must refer to other聽聽
[161]
specific listings. For example, hyperglycemia聽 can cause long-term complications that affect聽聽
[167]
various body systems. The Social Security聽 Administration evaluates these conditions under聽聽
[171]
the affected body systems, cardiac arrhythmia,聽 intestinal necrosis, cerebral edema, and other聽聽
[178]
mood disorders. With proper preparation and聽 skilled legal representation many with diabetes聽聽
[183]
disability claims that are first denied by the聽 Social Security Administration can be approved聽聽
[188]
by the administrative law judge when the hearing聽 comes. The Department of Veterans Affairs presumes聽聽
[195]
that specific disabilities diagnosed in certain聽 veterans were caused by their military service.聽聽

For Vietnam veterans diabetes mellitus or type聽 2 diabetes is associated with exposure to Agent聽聽
[207]
Orange and is required to be at least 10 percent聽 disabling under the VA rating regulations. Basic聽聽
[214]
requirements must be met including; a medical聽 diagnosis of diabetes, evidence of service in聽聽
[219]
Vietnam. The VA then refers to the schedule of聽 rating disabilities when determining the level of聽聽
[224]
a veteran service-connected disability. Diabetes聽 is listed under the Indra consistent and is rated聽聽
[229]
according to a loss-of-function and the effect聽 on your ability to be employed. If the VA denied聽聽
[234]
you because they said your diabetes disability is聽 not service-connected, it existed before service,聽聽
[239]
or it isn't severe enough, you need聽 to consult qualified legal counsel.

Your diabetes may also be covered by your long聽 term disability insurance policy. If your diabetes聽聽
