ocean it's pretty awesome okay now question聽 today is who can put a lien on a property聽聽

i know you're going to be looking at my nose聽 only because i don't know if you can hear me聽聽

um and this is probably going to be short聽 because i don't know if anyone can hear me at all聽聽

um so who can put a lead on the property the real聽 answer to who can put a lien on a property is you聽聽

can put a lead the owner of the property is most聽 of the time gonna put the lien on the property聽聽

so the most common lien is a mortgage right you're聽 gonna borrow money and you're gonna sign paperwork聽聽

you're gonna sign paperwork that says i accept聽 the fact that there's a lien on this property if聽聽

i don't pay the note so the two parts of a regular聽 mortgage are a note which is i have to pay back聽聽

this amount of money with this these terms聽 and then there's a mortgage in new york聽聽

which is called a deed of trust in other states聽 or a mortgage deed of trust in other states聽聽

and that's the lien that says we can enforce this聽 lean if you don't follow the terms of the note now

how does this how does this affect real estate so聽 in general um when you buy a property you're gonna聽聽

have to pay off your uh i'm sorry when you buy聽 property the seller has to pay up all the liens so聽聽

if the guy owes more than you're聽 willing to pay you have an issue聽聽

right um that happens a lot and聽 that's something that you have to聽聽

negotiate with the with the um lender for a short聽 sale i don't like short sales in general i do them聽聽

but they're difficult because you have to deal聽 with an owner and then you have to deal with a聽聽

lender there are people who do them and i have no聽 problem with them and i've closed a bunch of them聽聽

but um to me it's one extra party that聽 you have to deal with now there are聽聽

other liens on property so there's something聽 called the mechanics lien so a licensed um聽聽

uh what are we talking about licensed contractor聽 can put a mechanics in our property unfortunately聽聽

very very easily um if he says that you didn't聽 pay him what happens unfortunately a lot聽聽

is that you pay a gc a general contractor uh x聽 dollars the general contractor decides not to pay聽聽

a subcontractor let's say a plumber or an聽 electrician and that permanent church can put聽聽

a mechanics lane on your property or a property聽 you're looking to buy in a situation where you聽聽

never even had an agreement with them and that聽 is a difficult thing that comes up unfortunately聽聽

a lot you're buying property you see a mechanics聽 lien and the sellers even know anything about it聽聽

doesn't even know what the person is and you have聽 to negotiate and very often you got to pay a guy聽聽

off to get rid of the lien even though you know聽 you had nothing to do with not paying him now

what is important when you talk about real estate聽聽

is that all these liens are going to show聽 up on the title report so for me after i

get a signed contract get a signed contract to聽 buy something i order a tie report title is going聽聽

to show all the liens now in other states you聽 may want you're very often going to run a title聽聽

report before you even go to contract if you're聽 buying something at auction because a lot of the聽聽
[195]
liens are going to stay on after you close聽 in new york one of the greatest things about聽聽

new york is you always get clean title nothing聽 goes no properties go subject to existing lanes聽聽

sorry except in very rare situations so also聽 if you're trying to do subject-to properties聽聽

then just explain what a subject to is and this聽 is a good method it works in 49 states you buy聽聽

a property and you keep the mortgage in place聽 and you make the payments then you figure out a聽聽

way to get a cash flow positive maybe by putting聽 tenants in who will pay you more than without or聽聽

maybe you pick it up and then you sell it and that聽 works because there are some people just want to聽聽

want to walk away from a property and want to聽 know about it and in 49 states you can get a聽聽

title company that will say sure we'll sell it聽 to subject to existing lease in new york it never聽聽

works that way um the title companies don't run聽 transactions in new york so their job really is to聽聽

only do two things make sure the taxes are paid to聽 make sure the liens are paid so they're not going聽聽

to let a lien stay in place number one number two聽 um there's a seller's represented by an attorney聽聽

an attorney is not going to recommend that his聽 client sell the property and let somebody else be聽聽

responsible for the mortgage because in the event聽 that that new buyer stopped paying the mortgage i聽聽

believe that that attorney would be starting聽 to malpractice less than it may actually lose聽聽

so almost impossible subject to but one of the聽 best things about new york is that you don't聽聽

there's a bird coming from you don't have聽 to worry about any liens on the property聽聽

because the seller's responsible pay them off now聽 theoretically if there's i just had a deal where聽聽

it said that there was a two million dollar聽 lien on it um and i said to the seller you聽聽

know is there two million dollars you know聽 sometimes it shows up it's like an sba loan聽聽

um the guy bought a business and they and聽 they uh cross collateralized all his property聽聽

but it was a typo it's like 200 000 lean so so聽 if something shows up you want it maybe to make聽聽

sure the seller knows it better to see what聽 the payoff is make sure it gets paid off but聽聽

you don't have to pay it off but you don't聽 have to be stuck with it so that is a huge聽聽

advantage of doing business in new york you get聽 everything free and clear that is great now um

you know there are other ways to put liens on聽 property so for example if i buy a product if聽聽

i'm looking to buy a property seller changes聽 their mind i can put a lead on that property聽聽

a list pendants lien based on my on my contract聽 but an attorney has to do it and if you're putting聽聽

a list pendants on a property it's a you know if聽 you do it wrong you know there was no basis for it聽聽

the court's gonna sanction the聽 attorney who did it and maybe you聽聽

also so you have to be careful it's not a聽 simple thing but you need to show grounds聽聽

for filing the list pendants which is the same聽 as when you go into a mortgage foreclosure聽聽

and it prevents the seller from selling to聽 anybody else so i would love to talk more聽聽
