but what do you need to do should this

occur firstly let's look at what you can

do and what you should be doing trying

to make contact with the tenant to

ascertain is there a problem and what

that problem is

is it quite simply that they can't pay

because they have fell onto hard times

or is it because they won't pay the two

are very different

first things first what i would always

recommend that you do is speak to your

tenants and see if there's a solution

that works for both of you from a

procedural point of view what process

should you be following in terms of

around there and knocking on the door

absolutely not should you be turning up

at their place of work oh no please no

what you should be doing as a landlord

is making contact with them in a formal

letter should be sent

again in 14 days and 21 days

trying to make contact with the tenant

see if they will talk to you and explain

the situation and when they will be

looking to make payment

do not be harassing them do not be

calling them every hour this would be

deemed as harassment

it's also okay to send them an email or

a text message whichever way you

communicate with them but don't be doing

this on a harassment basis

be doing this at scheduled set times if

your tenant is non-responsive or you

haven't been able to speak to them for a

is it worth you looking to universal

credit making an application for direct

payment it may be that the tenant is

receiving universal credit and having

the rent paid to them directly as a

landlord if your tenant is in a set

amount of arrears you are entitled to

have the payment paid to you direct

that way it alleviates the

responsibility of the tenant making that

if you don't know whether your tenant is

in receipt of universal credit it makes

no difference there's no harm by making

an application to universal credit for

direct payment if they're not in receipt

of universal credit you quite simply

will not be awarded the rent so you lose

nothing if you try most tenants want to

pay their rent particularly if they fall

action using everything that you're

allowed to do in terms of gaining

possession of your property

serve those rent demand letters seven

days 14 days 21 days along with on the

28th day and notice of possession

and take court action as soon as you are

legally able to

these tenants that can pay but won't pay

are the people that we need to act

quickest with

so what notice do you use section 8

notice

section 8 notice is the notice used when

a tenant is in two months of rent
[220]
arrears or more

and it comes with a 14-day notice period

in england this is the quickest route to

possession of your property should you

have a tenant that is choosing not to
[232]
pay section 21 is also an option but
[235]
comes with a much longer notice period
[237]
of two months why wait two months when
[240]
you can wait 14 days should

section 8 apply

most renters situations can be sorted

out via communication

speaking with your tenant to ascertain

what the challenges are and negotiating

a suitable payment plan moving forward

is always the best way to reduce those

arrears and ensure that they are not

escalating communication is key

where immediate action is recommended
