investment in property so what about the

UK this is a question that clients put
[83]
to me well start with the basic
[86]
principles as a tier 1 investor you're
[89]
required to make your investment of 2
[91]
million 5 million or 10 million pounds
[94]
in the UK in the form of UK government
[97]
bonds or share capital or loan capital
[101]
in UK registered companies the companies
[105]
must be active and trading this means
[108]
they must be trading and not be dormant
[112]
there are some exclusions you should
[114]
bear in mind so funds that you are not
[117]
allowed to invest in your funds can't be
[120]
invested in open-ended investment
[122]
companies they can't be invested in
[125]
investment trusts companies or
[128]
investment syndicate companies and the
[130]
important restriction that I want to
[132]
focus on
[133]
the funds must not be invested in
[135]
companies mainly engaged in property
[140]
investment property management or
[143]
property development this means any
[148]
investment or development of property
[150]
which increases the value of property
[152]
with the view to earning a return
[154]
whether that's through rent or a future
[157]
sale is prohibited it doesn't permit the
[162]
management of property for renting us
[165]
out or for resale so the principle here
[168]
is that business income must be
[171]
generated from the supply of goods or
[173]
services it mustn't be generated from
[177]
the increased value of property or from
[181]
rent now this prohibition does not
[185]
exclude the provision of services in
[189]
relation to property so a client of mine
[191]
is investing into a business servicing
[195]
estate agents he isn't caught by the
[198]
prohibition so that's permissible hotels
[202]
in principle on court where rooms aren't
[205]
rented out and construction isn't
[209]
prohibited either in principle so you
[214]
should be alive to this distinction and
[216]
the exceptions if you want to discuss

points to bear in mind the funds must

not be invested by using deposits with a

bank building society or any other

enterprise whose normal course of

business includes the acceptance of

deposits now again there are some

exceptions you also can't use leveraged
[252]
investment funds including purchase of
[255]
stocks or other investments by using or
[258]
owed funds and you can't rely on money
[262]
that alone has been secured against
[265]
another party would have a claim on the
[267]
money if loan repayments were not made
[269]
so this includes a scenario of a bank
[272]
lending funds to you and then taking the
[275]
investments of security just an
[278]
additional point to note funds that you
[281]
claim that are available but haven't
[283]
been converted into money don't count so
[286]
equity in your property for example
[289]
which hasn't been sold in your house
[290]
let's say doesn't count it won't be
[293]
sufficient and this is because until the
[296]
sale of these assets is complete and
[298]
cash is transferred to the seller
[299]
there's no guarantee that the estimated
[302]
value of the assets will be realized
[304]
from the point of view of the UK
[306]
government now there are various other
[309]
points you need to bear in mind in terms
[310]
of the process for investing under the
[312]
tier 1 investor visa brude you've got to
[315]
make your investment within three months
[317]
of a so-called specified date for
[319]
