Today I'm gonna talk about how to get your

medical bills paid if you're injured
[8]
in a Florida car accident, truck accident,
[10]
or other type of vehicle accident.
[12]

- The first thing to note, is this video is gonna talk about
[18]
accident cases in Florida, those where someone else
[21]
is at fault and caused your injury.
[24]
Again, Florida has it's own auto insurance laws
[28]
in regard to getting your medical bills paid.
[30]
Every state has different laws,
[32]
this video only applies if you're injured in Florida.
[35]
The first thing that's going to happen,
[37]
or one of the first things that's going to happen
[38]
when you make a auto accident claim, an insurance claim,
[43]
with your own insurer, or the PIP insurer,
[45]
which I'll talk about in a little bit,
[47]
is they will send you what is called
[48]
a Notification of PIP Benefits.
[52]
It's an explanation of how your auto insurance,
[55]
the PIP insurer, is going to pay medical bills.
[58]
Now, that notification is a letter you'll receive.
[61]
One of the problems is
[62]
it takes some time to get that letter,
[64]
so you want to know immediately after your accident,
[68]
your car accident, how you get your medical bills paid.
[70]
That letter does a very good job, but a very basic job
[74]
of explaining PIP, the medical payments,
[77]
portion of your case, lost wages,
[79]
a little bit about your right to sue,
[82]
but in my opinion, it's too basic for your needs
[86]
if you're hurt in an auto accident in Florida.
[88]
The first thing to note is,
[90]
if you're injured in Florida, in most car accidents,
[93]
PIP, also known as no fault insurance,
[96]
is going to apply, regardless of fault.
[98]
In Florida, there's minimum limits of PIP.
[102]
Meaning, the PIP insurance,
[103]
personal injury protection insurance,
[105]
can be greater than these minimal limits,
[107]
but these are the limits, that if you have PIP,
[110]
they have to be a certain limit.
[113]
They are $10,000 for medical bills,
[116]
if you've sustained an emergency medical condition.
[119]
If you haven't sustained an emergency medical condition,
[123]
the limit, the PIP insurer has to pay $2500.
[128]
Another one of the minimal PIP limits in Florida
[131]
is for your lost wages.
[133]
The limit is $10,000, I'm gonna get more into that
[135]
in a little bit, but this video is primarily
[138]
on getting your medical bills paid.
[140]
Now whether you are insured with PIP,
[142]
or if you're not, you're gonna want to send a letter
[144]
to the PIP insurer.
[146]
This is a form letter that we have,
[148]
and you should be able to find online,
[150]
it's on our website, I'll put a link
[151]
in the description to this video below,
[153]
where you're going to ask the PIP insurer,
[155]
amongst many other things, if they have any defenses
[159]
for why they would not cover you with PIP insurance.
[164]
PIP may still pay your medical bills
[167]
even if you don't own a car in Florida.
[171]
You're gonna want to give your PIP information
[173]
to every single medical provider you treat with.
[175]
The hospital, and all your doctors.
[177]
If you fail to do that, and you also have health insurance,
[180]
in addition to the PIP not paying your medical bills,
[184]
PIP may not have to reimburse or pay back
[187]
the health insurance lien,
[188]
which if someone else caused your accident,
[190]
would result in a smaller settlement.
[192]
Now, PIP pays 80% of reasonable medical bills
[196]
related to your accident.
[197]
If you do not get treatment within 14 days
[199]
of a Florida accident, PIP does not have to pay a dollar,
[204]
a penny, zero.
[205]
PIP does not pay for massage or acupuncture.
[208]
Again, if you don't have an emergency medical condition,
[211]
If a doctor does not say you have an
[212]
emergency medical condition,
[214]
PIP will pay no more than $2500.
[217]
The formula is right here, PIP pays 80%
[220]
times your total medical bill.
[222]
We're gonna take an example,
[223]
assuming you have a $5000 medical bill.
[226]
In that case, PIP would pay 80% of $5000,
[229]
which would be $4000.
[231]
$5000, 80% times $5000 is $4000.
[235]
Now, PIP would only pay that amount
[237]
if you had emergency medical condition.
[239]
So, let's say that State Farm was your auto insurer
[242]
the PIP insurer, and there's this $5000 bill,
[244]
with an emergency medical condition,
[246]
State Farm would pay the hospital $4000.
[249]
Now, even if you have a $5000 medical bill,
[252]
and assuming State Farm pays $4000,
[254]
you're left with a thousand dollar bill.
[256]
How do you get that money?
[257]
You would need to sue the at fault parties
[259]
to get them to pay that outstanding medical bill.
[261]
You can also sue for additional things,
[263]
such as pain and suffering, and mental anguish,
[266]
and things of that nature, but this video
[268]
is focused on your medical bills.
[270]
If we take that same $5000 medical bill example,
[274]
but assume you did not have an emergency medical condition,
[277]
PIP would only pay $2500.
[280]
Now, even though $4000 was based on the calculations,
[283]
80% of $5000, they only have to pay up to the $2500.
[287]
We'll look at another example.
[289]
Assume your medical bill was $15,000.
[292]
80% of $15,000 is $12,000.
[294]
But PIP generally speaking, there's exceptions,
[298]
generally speaking, if you have basic PIP,
[301]
it's gonna pay only up to $10,000.
[303]
So even if your hospital bill is 15,
[305]
and 80% would be $12,000,
[307]
PIP is only gonna pay up to $10,000,
[309]
that $5000 you would have to sue
[312]
the responsible parties for.
[314]
Now, you may have a PIP deductible,
[316]
which I'm really not gonna get into that now,
[318]
there'll be another video on that.
[320]
But understand, just because you believe there's PIP,
[323]
sometimes an insurance company
[324]
will assert a coverage defense.
[326]
Such as, when the application was filled out,
[329]
somebody lied, or something of that nature.
[331]
So just be aware of that, and that's one of the reasons why
[334]
you want to send a written letter, certified,
[335]
to the PIP insurer, asking them for their defenses.
[338]
Another insurance that is on an auto insurance policy,
[342]
yours or someone else's that would cover you,
[344]
is called Medical Payments Coverage.
[346]
It is different from PIP, it pays medical bills,
[349]
it's also known as MedPay.
[350]
Now, MedPay will pay the amount that PIP did not pay,
[354]
up to the limit of the MedPay coverage.
[356]
Also, if you have Worker's Compensation,
[358]
if you are injured during the course and scope
[360]
of your employment, while you are working,
[362]
and there's Worker's Compensation Insurance available,
[364]
that can also pay your medical bills.
[367]
There's many other types of insurance coverage
[370]
that may pay your medical bills as well.
[372]
We have health insurance coverage,
[373]
which generally in Florida pays secondary to PIP.
[376]
That means your auto insurance,
[378]
or the auto, the PIP auto insurance
[379]
should be billed first, the health insurance company,
[382]
if they get billed before PIP,
[384]
and they know that it's a car accident,
[386]
they can deny payment, rightfully.
[388]
You're going to want to give your health insurance,
[390]
and any other insurance information,
[391]
to the hospital or doctors you treat with immediately.
[394]
It's gonna result in getting your medical bills paid faster.
[398]
If you wait to give your health insurance to the hospital,
[400]
for example, and you just give your PIP,
[402]
the PIP insurer is gonna get billed,
[405]
you may be trying to settle your case
[406]
with the at fault party,
[408]
and you need to get those bills to your health insurer
[411]
so they can then pay them,
[413]
and you can find out how much you have to repay
[415]
the health insurer.
[416]
You may have Medicare.
[417]
If Medicare pays some of your bills,
[419]
they're entitled to get paid back.
[420]
If you have an attorney, the amount of money that Medicare
[423]
is entitled to get paid back, and when I'm saying paid back,
[426]
I mean it from a total settlement against any other
[428]
responsible parties that caused your accident.
[431]
The same is true with Medicaid.
[432]
If you have Medicaid, and Medicaid pays bills,
[435]
Medicaid is entitled to get paid back.
[437]
Medicaid will reduce for your attorney's fees and costs,
[440]
which is one of the many benefits of hiring an attorney.
[442]
Hospitals, unfortunately, do not have to bill Medicaid.
[446]
Bills that PIP does not pay, you're gonna want to go after
[448]
the responsible parties whose
[450]
carelessness caused your accident.
[452]
And just remember, just because someone gets a ticket
[455]
in the accident, doesn't mean
[456]
they're automatically responsible.
[458]
In fact, in a civil trial, the jury will never be allowed
[461]
to hear that a ticket was issued.
[463]
That being said, most often,
[465]
the person who receives a ticket is generally at fault.
[468]
Now I've talked a lot about getting your bills paid.
[471]
In particular, the bills that PIP does not pay.
[473]
And I've said you go after the responsible party.
[476]
If the responsible parties are uninsured,
[478]
or underinsured, that means they don't have enough
[480]
insurance to pay for your injuries,
[482]
or they have no insurance, you're gonna want to make a claim
[484]
against any uninsured motorist insurance that exists.
[488]
It could be your own,
[489]
it could be someone who you lived with,
[490]
it can be the car that you were in
[492]
at the time of the accident.
[493]
And again, this video focuses on getting your medical bills

paid, you also may have a claim against the responsible
[500]
parties, or your uninsured motorist insurer
[503]
for any other damages, such as lost wages,
[506]
pain and suffering, mental anguish, scarring,
[509]
anything of that nature.
