[4]
i'm Chantal Roberts and i'm an expert witness聽 for claims handling standards practices and聽聽
[9]
procedures i was an adjuster for 20 plus聽 years the art of adjusting is a vlog to help聽聽
[15]
professionals and lay people alike understand聽 a bit more about the insurance claims industry聽聽
[20]
today is election day a day where we can vote for聽 changes in an average insurance policy an insured聽聽
[27]
cannot make changes to the policy however this聽 is known as a contract of adhesion while there聽聽
[34]
are endorsements and endorsements are a way聽 for and ensured to make changes to the policy聽聽
[40]
an endorsement is still written by the聽 insurer since the insurer writes the聽聽
[46]
policy and the insurer does not have a聽 say in how it's worded in the event that聽聽
[51]
there is confusion or an ambiguity over a word聽 courts will generally rule against the insurer聽聽
[58]
or drafter of the contract if the wording question聽 is not defined in the policy courts will use the聽聽
[64]
everyday meaning of that word the everyday meaning聽 of a word is usually the one found in a dictionary聽聽
[72]
so the logic is that an insurer had the聽 opportunity to word the policy in a manner聽聽
[80]
it wanted to and if it didn't or its language聽 was not clear that's the fault of the carrier聽聽
[86]
coverage would then be awarded to the insured聽 this is an important concept for adjusters to聽聽
[93]
understand because it comes up often while聽 handling claims often the insured the agent or the聽聽
[100]
policy holder attorney will believe that a policy聽 says one thing and the adjuster and carrier will聽聽
[106]
think that the policy says another ambiguities聽 can either be semantic involving a choice of words聽聽
[113]
their meanings or their contextual uses in聽 a contract or syntactic ambiguities meaning聽聽
[121]
the in the arrangement of a word聽 involving sentence structure punctuation聽聽
[128]
nouns connectives verbs and their tenses it should聽 be noted that just because there's a definition聽聽
[136]
of a word in a policy that doesn't mean that聽 the word is or used to be ambiguous just like a聽聽
[143]
lack of a definition doesn't mean that聽 a word isn't ambiguous or is ambiguous聽聽
[149]
it's very confusing bill wilson who is an聽 insurance thought leader and author of when words聽聽
[155]
collide also points to the latin phrase no saitor聽 aso sai sis meaning it's known by its associates聽聽
[165]
this means that if there is a list of policy items聽 and one item is thought to be ambiguous then the聽聽
[172]
entire list should be taken into consideration聽 together so for example fruit farm is our insured聽聽
[180]
and its products are insured with fruity insurance聽 company a tomato blight has killed all of fruit聽聽
[187]
farms tomatoes they turn in a claim to fruity聽 insurance after an investigation the adjuster聽聽
[195]
bradford mcpair denies the claim stating tomatoes聽 are not a covered property because they're not聽聽
[201]
fruit mcpear quoted the following policy language聽 we cover the fruit you grow including apples pears聽聽
[210]
peaches grapes or plants which develop from聽 a flower and contains seeds tomatoes aren't聽聽
[216]
specifically listed in the definition but聽 the definition is not ambiguous based on聽聽
[222]
its associates therefore fruity insurance would be聽 incorrect in its coverage decision so this week i聽聽
[229]
discussed contracts of adhesion and contracts can聽 be confusing if there is a question in regards to聽聽
[237]
wording on a contract it's a good thing to聽 always talk with your adjuster or an attorney聽聽
[243]
every claim is different and every insurer has聽 different protocols for handling losses however聽聽
[249]
this being the litigated world that we're in see聽 below for some legalese few claims go to a trial聽聽
[257]
and picking an expert who has been opposed the聽 most or has gone to trial the most may not be聽聽
[261]
the correct expert failing to have a second聽 set of eyes on the claim to save expenses聽聽
[268]
isn't always the best way to resolve a loss as聽 an expert witness and former claims adjuster聽聽
