uncommon but a local woman says her

board took it a little too far

a disagreement with her hoa ended up in

maryland's second highest court wmar 2

legal battle and how to end those feuds

before they escalate because if it

this fight involved defense and its
[23]
boundaries the fence cost the homeowner
[25]
roughly 8 thousand dollars the
[27]
litigation that followed amounted to
[29]
more than 40 thousand dollars and as
[31]
you'll hear it was all over a few inches
[34]
betty hooker lives in the autumn hills
[36]
neighborhood in waldorf this is her
[38]
backyard and this is the fence that
[41]
nearly cost her her home this dispute
[44]
started like in 2017.
[46]
that's around the time she put up the
[48]
fence after being granted permission by
[50]
the autumn hills homeowners association
[53]
but in march 2018 the hoa board
[56]
president said her fence encroached on
[58]
the community's common area this wooded
[61]
area behind betty's home exactly eight
[64]
inches by his measurement a few months
[66]
later the h-o-a sent a letter letting
[69]
her know the board would take legal
[70]
action if the fence isn't moved betty
[73]
obtained an estimate and went back and
[75]
forth with the h-a on who would pay for
[77]
it the hoa then filed a complaint in
[79]
circuit court in march 2019 asserting
[82]
the fence was still encroaching and
[85]
they're seeking a fine of 25 dollars per
[88]
day dating back to november 2018 plus
[91]
costs and attorneys fees at the hearing
[94]
betty represented herself i felt like it
[96]
was a
[98]
it was a frivolous case and the judge
[100]
will hear me but she lost judge danine
[103]
carrington martin ordered the hookers to
[106]
pay more than 22 thousand in fines and
[109]
17 thousand in attorney's fees when i
[112]
heard the ruling from the judge i just
[114]
it was unbelievable i immediately got up
[116]
and left the courtroom she then sought
[118]
legal help to file an appeal i believe
[120]
it was around the time when the warrant
[123]
had been issued for the sheriff's and
[125]
come and try to seize their house
[126]
january of this year the court of
[129]
special appeals heard her case instead
[131]
of helping the appellants the hoa
[134]
doggedly pursued litigation against them
[136]
racking up attorney's fees and by the
[138]
end of this case we're pursuing fines
[140]
and fees for over a year for an
[142]
encroachment of under one inch in one
[144]
corner of the property so you're saying
[146]
the whole dispute is over an inch
[148]
yes at the end of this case the dispute
[150]
was over an inch lesson is your honor it
[152]
only matters that they are encroaching
[155]
and if they are encroaching they are
[157]
encroaching this april the court ruled
[160]
that the hoa did not act in accordance
[162]
with its governing document the
[164]
declarations for the h.o.a say very
[167]
clearly different notices that
[169]
homeowners should get and the due
[170]
process that they deserve before any
[173]
further steps happen against them and
[174]
that was not followed here so the case
[177]
has been completely reversed and the
[178]
hookers all of the fines are taken away
[181]
of the attorney's fees they will owe to
[183]
the hoa are taken away and actually they
[186]
were awarded costs we tried speaking
[188]
with board president william henderson
[190]
about the decision
[191]
he didn't answer but his attorney sent
[193]
us this statement the hoa board in good
[196]
faith pursued the matter to fulfill
[198]
their duty to enforce the community
[200]
covenants the hoa was naturally
[203]
disappointed with the outcome of the
[204]
appeals case however the hoa respects
[207]
the decision of the court and is
[209]
complying with its mandate i feel
[211]
somewhat whole but not totally whole
[213]
because it's like it's been a lot of
[215]
stress we asked betty's attorney what

could have stopped this case from
[219]
spiraling again if they just go back to
[221]
their governing documents there's a lot
[223]
of due process already in those you know
[226]
a
[227]
six hour training session for boards you
[229]
know know your rights leaflet to
[231]
homeowners something that simple could
[233]
really help a lot we've reported on

legislative attempts throughout the
[236]
years to require licensing and training
[238]
for these community managers but they've
[240]
failed jessica added that lawyers can

help by settling the issue before it
