video we're going to be covering what are the聽聽

three legal grounds to get a divorce in South聽
Africa? We're going to go through each ground聽聽
[19]
in detail and what you need to prove in order聽
to successfully get your divorce. So let's get聽聽

started with it. There are three legal grounds in聽
South Africa to get your divorce. The first one is聽聽
[32]
mental illness of your spouse and a lot of people聽
are going to be saying yes Aslam, that's the one,聽聽
[38]
that's the ground we need to prove. My partner is聽
insane and I want to divorce. It is a bit different聽聽
[46]
from what you think it is and the second is聽
continuous unconsciousness of your partner and the聽聽
[52]
last is irretrievable breakdown of the marriage.聽
Let's look at each of these three grounds in a bit聽聽
[58]
more detail so that we can understand it. The most聽
common from the three is irretrievable breakdown聽聽
[66]
of the marriage. This is, I would say maybe about 95聽% of divorces in South Africa are caused by聽聽
[73]
irretrievable breakdown of the marriage. That's the聽
most commonly used ground. What do I mean by that聽聽
[81]
and this particular ground, irretrievable breakdown?聽
Remember there's three grounds mental illness,聽聽
[88]
continuous unconsciousness and irretrievable聽
breakdown. We talking about irretrievable breakdown.聽聽
[96]
Under irretrievable breakdown, South Africa has a聽
no fault divorce system. This means that a person聽聽
[104]
can file for divorce without having to prove that聽
the other person which is the spouse did something聽聽
[112]
wrong, for example if they cheated or whatever, it聽
is there's no fault that's required for you to get聽聽
[119]
a divorce in South Africa. You don't have to prove聽
anything, all you have to do is show the judge聽聽
[125]
that there is no reasonable prospect of your聽
relationship continuing. The legal term for this聽聽
[133]
is called irretrievable breakdown of the marriage.聽
Examples of what are irretrievable breakdown聽聽
[140]
of the marriage: emotional abuse, physical abuse,聽
verbal abuse, if the other partner has an addiction聽聽
[148]
problem like drugs alcohol or gambling, if the聽
parties are no longer in love with each other.聽
[155]
These are commonly used examples for getting聽
your divorce in terms of irretrievable breakdown.聽聽

It doesn't mean that you must now聽
prove to the court that your partner聽聽
[167]
actually has an addiction problem, if you have聽
reasonable belief that they do have that and聽聽
[174]
you believe that the relationship cannot continue,聽
you genuinely believe that and that divorce is the聽聽
[180]
only option left, then you can rely on this ground聽
of irretrievable breakdown. It can also be a lack聽聽
[188]
of communication between husband and wife or you聽
no longer staying together and there is longer love.聽聽

So, in summary, with regard to this ground聽
of irretrievable breakdown, it is the most commonly聽聽
[203]
used ground. It doesn't require any fault from the聽
other party and you just believe that there's just聽聽
[209]
no hope of the relationship continuing. Let's look聽
at the other two grounds which was mental illness聽聽
[216]
and continuous unconsciousness. With regard to聽
mental illness, you have to if you're going to rely聽聽
[223]
on this ground of mental illness then you must聽
show that your partner was officially admitted聽聽
[230]
into a mental institution and that they have聽
been mentally ill for quite a long period of time.聽聽
[239]
You also need evidence to show maybe from聽
two psychiatrists, who can tell the court聽聽
[244]
that your partner is officially insane or not well聽
or they're not capable of making proper decisions.聽聽
[252]
It is a very high hurdle to overcome that's why I聽
don't advise my clients to take that route. You'd聽聽
[259]
rather take the route of irretrievable聽
breakdown of the marriage. The other one聽聽
[264]
is continuous unconsciousness, that was the other聽
legal ground you will have to also prove here that聽聽
[272]
your partner has been unconscious for a period聽
of at least six months and medical evidence from聽聽
[279]
two doctors must show that there's no reasonable聽
prospect of your partner regaining consciousness.聽聽
[286]
As you can see mental illness and continuous聽
unconsciousness have specific hurdles that need聽聽
[294]
to be overcome whereas the ground of irretrievable聽
breakdown, no fault is required, no real proof聽聽
[301]
is required. All you have to do is show the聽
relationship has no prospect of continuing,聽聽
[307]
it's just broken down completely. So the key聽
takeaway from this video is in South Africa聽聽

we have a no fault based system, you can聽
get a divorce without having to prove聽聽
[322]
the other party has done something wrong. You聽
can get a divorce on the basis of irretrievable聽聽
[329]
breakdown of the marriage relationship where聽
you believe there's no hope of the relationship聽聽
[334]
continuing. To actually get your divorce it's best聽
that you go to the Regional Magistrates Court, it's聽聽
[343]
a much more faster process than the High Court,聽
