in what was supposed to be their dream

homes and now their stories will be told

in the courtroom now that a class action

suit for damages has been filed here's

more in tonight's dial dalford

investigation

justin pollock his wife anna and their
[20]
four children moved down south from
[22]
boston for his job and have lived in
[24]
their youngsville home since 2013 but it
[26]
wasn't long before what was once their
[28]
dream home quickly became a nightmare
[31]
right away when we bought the home we
[32]
started having warranty issues with the
[34]
house mostly with windows leaking
[36]
and moisture and humidity problems in
[38]
the house same goes for carissa harrison
[41]
and her family they've had to come in
[43]
they'd have to change the ductwork
[45]
repeatedly because it was leaking
[48]
condensation they would they replaced
[50]
plenum after plenum they came in they
[52]
added a dehumidifier
[54]
they would come in and they would put
[56]
this glue and then all of a sudden this
[58]
glue or mud whatever they use would just
[60]
start dripping down like sweat and water
[63]
that was carissa harrison back in march
[65]
of 2021 she and her family have since
[67]
relocated out of state but they drove
[70]
back to show us the problem still hasn't
[72]
been repaired more than a year later
[74]
we've filed warranty claims over and
[77]
over and over and continuously they
[79]
would come in and try to fix the issue
[81]
but it's been nothing but band-aids both
[83]
the pollux and the harrisons lived in
[85]
the same neighborhood in dr horton built
[88]
homes along with subcontractor bail
[90]
mechanical while the companies have come
[92]
out and made several repairs the
[94]
homeowners say the issues seem to be
[96]
never ending in the
[98]
fall of 2016

they replaced that pair of windows and
[102]
took it upon themselves to also replace
[104]
our foyer window
[106]
and
[107]
on new year's eve of 16 going into 17 we
[110]
had water leaking so bad out of the
[112]
foyer window that wasn't leaking in the
[113]
first place
[115]
that it was behind the paint and it was
[116]
also coming out from the inside of the
[118]
light switches
[119]
to the point where it scared us enough
[121]
that we had to go turn off the circuit
[122]
breakers in the house because it became
[123]
a fire hazard and everything was arcing

inside of it the pollock's daughter

rachel also developed asthma due to the
[129]
mold growth her doctor connected the
[131]
asthma to the exposure to aspergillus an
[134]
air quality and mold test of the home
[136]
reveal an exact match between her
[139]
disease and the mold growing inside the
[141]
house
[142]
the first six months or so she was had
[144]
to be on a nebulizer three times a day
[146]
having breathing problems
[148]
we had to move out and go to a hotel for
[151]
two months a few doors down the road at

the harrisons in october of 2020 carissa

was learning a huge reason they had
[158]
experienced so many problems with their

brand new homes the telephone recording

building the same house anymore or like

this should have been installed from day

one like and then it's not though

it has nothing to do with us i'll tell

you what it is it's the code that we

have to build to we build to the federal

mandate code

and we're regulated by federal law we've
[187]
built to that code that code was not
[190]
designed for very human markets and the
[192]
man who wrote that law even said that

it's not designed for very humid markets

but we still have to adhere to what the
[199]
rest of the country

has been mandated to do that phone call

is now a key piece of evidence in the

latest development

a 36 page class action lawsuit filed on
[210]
behalf of a lafayette parish couple and
[212]
an unknown number of other homeowners
[214]
who now find themselves in a similar
[216]
situation after purchasing a home built
[219]
in south louisiana by dr horton
[224]
10 attorneys are handling the case one
[226]
of them lance bill says the ultimate
[228]
goal is to ensure these hard-working
[231]
middle-class families get justice for
[233]
not receiving the product they were
[235]
promised when the home was purchased
[237]
it's about holding dr horton accountable
[239]
for their actions and inactions now
[242]
since the suit was filed in early march
[245]
hundreds of people who own dr horton
[247]
homes have already called to join the
[248]
class action suit as of tonight email
[251]
requests for comment from dr horton have
[254]
gone unanswered if there's an ongoing
